Do I need unemployment insurance for my business in Washington state?
I'm starting a small consulting business and trying to figure out all the required insurances. Do I need to get unemployment insurance coverage through Washington ESD if I'm going to hire employees? What happens if I don't register properly? I've been reading the Washington ESD website but it's confusing about when exactly you need to start paying into the system.

Yes, if you're hiring employees in Washington state, you're required to register with Washington ESD for unemployment insurance. You need to register within 30 days of hiring your first employee or within 30 days of having a payroll of $1,000 or more in any calendar quarter.

•Thanks! Do I need to register before I hire anyone or can I wait until after?

•You can wait until after, but don't delay too long. The 30-day window starts ticking once you meet the requirements.

I went through this last year when I started my landscaping company. You definitely need to register with Washington ESD. The penalties for not registering can be pretty steep - they can go back and assess taxes plus interest and penalties.

•What kind of penalties are we talking about? I'm in a similar situation and getting worried.

•They can assess back taxes for up to 4 years plus a 25% penalty and interest. Not fun. Just register as soon as you need to.

•Tell me about it! I called them three times and got different answers each time.

•If you need to actually talk to someone at Washington ESD, I found this service called Claimyr that helps you get through to an agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Way better than sitting on hold for hours.

The basic rule is pretty simple - if you have employees, you need unemployment insurance. Independent contractors don't count, but be careful about misclassifying workers. Washington ESD is cracking down on that.

•What's the difference between employees and contractors for this purpose?

Jessica Nguyen
•Employees work under your direction and control. Contractors are independent. But Washington has strict tests for this - look up the ABC test on the Washington ESD website.

•The ABC test is no joke. I thought my workers were contractors but Washington ESD reclassified them as employees and hit me with a huge bill.

What about if you're just a sole proprietor with no employees? Do you still need unemployment insurance?

Nick Kravitz
•No, sole proprietors without employees don't need to register for unemployment insurance. You can't collect unemployment benefits on yourself anyway.

•But if you incorporate or form an LLC and pay yourself wages, then you might need to register depending on your ownership percentage.

I'm going through the registration process right now and it's actually not that bad once you get started. You need your federal EIN and some basic business info.

•Mine was approved within a few days. Pretty quick actually.

Don't forget you'll also need industrial insurance through L&I if you have employees. That's separate from unemployment insurance but equally required.

•Ugh, more bureaucracy. Is there a list somewhere of all the insurance requirements for Washington businesses?

•Check the Department of Commerce website - they have a good business startup checklist.

Been running my business for 5 years now. The unemployment insurance payments aren't that expensive for most small businesses. It's based on your payroll and your experience rating.

•What's an experience rating?

•It's based on how many of your former employees have filed unemployment claims. New businesses start at a standard rate.

If you're really stuck trying to get answers from Washington ESD, I used claimyr.com to get through to an actual person. Saved me tons of time instead of waiting on hold forever.

•Is that legit? Sounds too good to be true.

•Yeah it's real. They basically handle the waiting for you and connect you when an agent is available. Worth it when you actually need to talk to someone.

Make sure you understand the quarterly reporting requirements too. You'll need to file reports and pay taxes every quarter once you're registered.

•Late fees and penalties. They're pretty strict about the deadlines.

does anyone know if family members count as employees for this? thinking about hiring my spouse

•Spouses generally don't count for unemployment insurance purposes in sole proprietorships or partnerships. But if you're incorporated, they might.

•Check with an accountant on this one. The rules get weird with family members.

The registration process is all online now through SecureAccess Washington. Much easier than it used to be when you had to mail in forms.

Pro tip: Keep good records from day one. Washington ESD can audit your business and they'll want to see payroll records, worker classifications, etc.

•How far back can they audit?

Ella Knight
•Usually 3-4 years, but longer if they think there was fraud or gross negligence.

I tried calling Washington ESD about business registration questions and could never get through. Finally used that Claimyr service someone mentioned and got my questions answered in like 20 minutes.

•Worth it to actually talk to someone instead of guessing. Check their website at claimyr.com for details.

Bottom line - if you're hiring people, register with Washington ESD. The penalties for not doing it are way worse than just following the rules from the start.

•Agreed. Better safe than sorry with government requirements.

As someone who just went through this process last month, I can confirm you definitely need to register if you're hiring employees. One thing that helped me was calling the Washington ESD Business Services line directly - they have a separate number for new business inquiries that's usually less busy than the general unemployment line. The registration itself is pretty straightforward once you have your federal EIN. Just don't put it off because those penalties add up fast if you're late.
