Do I need Washington ESD unemployment insurance if I have no employees?
I'm starting a small business in Washington and wondering about unemployment insurance requirements. Right now it's just me - no employees at all. Do I still need to register with Washington ESD for unemployment insurance coverage? I've been getting conflicting information online and want to make sure I'm not missing any legal requirements. Also wondering if this affects me personally in terms of being able to collect UI benefits later if my business doesn't work out.

If you have no employees, you typically don't need to register for Washington ESD unemployment insurance as an employer. The requirement kicks in when you start hiring people. However, as a business owner, you generally can't collect unemployment benefits yourself unless you were paying into the system as both employer and employee, which gets complicated.

•Thanks for the quick response! So I'm clear until I hire someone?

Dmitry Ivanov
•Exactly. Once you hire your first employee, you'll need to register with Washington ESD and start paying unemployment taxes.

•No, it's only when you have employees. Sole proprietors without employees don't have unemployment insurance obligations.

I went through this same situation last year! You don't need to worry about Washington ESD registration until you hire someone. But here's what I learned the hard way - if your business fails and you need to look for regular employment, you can't just immediately collect unemployment benefits because you weren't paying into the system as an employee. Had to deal with Washington ESD for weeks trying to figure out my eligibility.

•Oh wow, that's exactly what I was worried about. How did you eventually handle the Washington ESD situation?

•It was a nightmare trying to get through to someone at Washington ESD to explain my situation. Finally used Claimyr.com to actually reach an agent who could look at my work history properly. They have this video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me weeks of calling.

Just echoing what others said - solo business owner here for 3 years, never had to deal with Washington ESD unemployment stuff until I hired my first part-timer last month.

•Good to know I'm not the only one figuring this out!

One thing to add - even though you don't need unemployment insurance now, you should still be aware of other business registration requirements with the state. Don't confuse unemployment insurance with other business licenses or tax obligations.

•Yeah I've got the business license stuff sorted out, was just confused about the unemployment piece specifically.

THE WHOLE SYSTEM IS DESIGNED TO CONFUSE SMALL BUSINESS OWNERS! Why can't Washington ESD make this clearer on their website???

Quick question - what if you're a sole proprietor but you hire independent contractors? Does that change anything with Washington ESD requirements?

Dmitry Ivanov
•Independent contractors don't count as employees for unemployment insurance purposes, so you still wouldn't need to register with Washington ESD. Just make sure they're properly classified as contractors and not employees.

•Perfect, that's what I thought but wanted to double check.

I had a similar question when I was freelancing - ended up calling Washington ESD directly but spent like 2 hours on hold. Definitely wish I'd known about better ways to reach them back then.

•Yeah the hold times are brutal. That's why I ended up using Claimyr when I had my eligibility issues. Much faster than trying to get through on the phone normally.

Thanks everyone! Sounds like I'm good for now and just need to remember to register with Washington ESD once I hire my first actual employee. Really appreciate all the insights.

•You got it! And when you do hire someone, don't forget you'll need to report wages quarterly and pay the unemployment taxes.

Connor O'Neill
•Yep, the quarterly reporting is pretty straightforward once you get the hang of it.

Just to clarify one more time for anyone reading - Washington state unemployment insurance is only required when you have employees on payroll. Self-employed individuals without employees have no obligation to register or pay into the system.

One more thing - if you do end up needing to contact Washington ESD in the future for any reason, I've heard good things about services that help you actually get through to an agent. Saw someone mention Claimyr earlier - might be worth bookmarking for later.

For what it's worth, I checked with my accountant about this same question and got the same answer - no employees means no Washington ESD unemployment insurance requirements.

Does anyone know if this is the same in other states or just Washington? Might be moving my business to Oregon next year.

Dmitry Ivanov
•The basic principle is similar in most states - no employees typically means no unemployment insurance obligations - but you should check Oregon's specific requirements since they can vary.

Quick follow-up question - when you do hire your first employee, how long do you have to register with Washington ESD?
0 coins
Dmitry Ivanov
•You need to register within 20 days of becoming subject to the unemployment insurance law, which is basically when you hire your first employee.

•Got it, so don't wait around. Thanks!

Last question - is there any benefit to voluntarily paying into unemployment insurance as a business owner even if you don't have employees?
0 coins
Miguel Silva
•In Washington, business owners can't typically elect coverage for themselves under the standard unemployment insurance program. It's designed for employers to cover their employees.

•That's what I figured, but thought I'd ask. Thanks!
