Can you get back unemployment benefits after Washington ESD disqualification?
My Washington ESD unemployment claim got disqualified 2 months ago because they said I quit my job voluntarily (which I didn't - I was laid off due to budget cuts). I tried appealing but missed the deadline by a few days because I was dealing with some family issues. Now I'm wondering if there's any way to get my benefits reinstated or if I can file a new claim? I'm really struggling financially and need to know if I have any options left. Has anyone been in a similar situation with Washington ESD?

You might still have options even after missing the appeal deadline. Washington ESD sometimes allows late appeals if you have good cause for the delay. Family emergencies can qualify as good cause. You should contact them immediately to explain your situation.

•Really? I thought once you missed the deadline that was it. How do I contact them about this? I've been trying to call but can never get through.

•The phone lines are always busy. You can try the online messaging system through your SecureAccess Washington account, but that's slow too. Good cause appeals have strict requirements though - you'll need documentation of your family emergency.

I actually got my benefits back after a disqualification! It took forever though. You need to prove you were laid off, not that you quit. Do you have any paperwork from your employer about the layoff?

•I have an email from HR about the budget cuts but that's about it. They didn't give me any official layoff notice. Would that email be enough?

•That email could help but you might need more documentation. Try to get a letter from your former employer stating it was a layoff due to budget cuts, not a voluntary quit.

I had a similar issue with Washington ESD and couldn't get through on the phone for weeks. I ended up using this service called Claimyr that actually got me connected to a real person at Washington ESD. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. It was a lifesaver for me.

•Never heard of Claimyr before. Does it actually work? I'm getting desperate trying to reach someone at Washington ESD.

•It worked for me. They basically handle the calling and waiting for you, then connect you when they get through. Saved me hours of being on hold.

•Hmm, sounds too good to be true. How much does it cost?

Washington ESD is THE WORST when it comes to actually talking to someone. I've been trying for 3 weeks to get through about my own claim issue. The system is completely broken!!!

•I feel your pain. It's like they don't want to help anyone. Makes me wonder if they're deliberately making it hard to contact them.

•Probably! The less people they have to deal with, the less benefits they have to pay out. It's all about saving money.

For good cause appeals, you typically need to file within a reasonable time after the good cause ends. Since your family issues have presumably resolved, you should act quickly. The longer you wait, the harder it becomes to justify the delay.

Atticus Domingo
•What's considered 'reasonable time'? It's been about 3 weeks since things settled down with my family situation.

•Three weeks might still be acceptable depending on the circumstances. Washington ESD evaluates each case individually. Document everything about your family emergency and when it ended.

wait can you even file a new claim if you had one disqualified?? I thought once you were disqualified that was it

•You can file a new claim if you've worked and earned enough wages since the disqualification. But it's usually better to try to fix the existing claim first if possible.

•oh ok that makes sense. so OP should probably try the appeal route first then

Update: I tried using that Claimyr service someone mentioned and it actually worked! Got connected to a Washington ESD representative in about 30 minutes instead of waiting on hold for hours. She explained that I can still file a good cause appeal for my missed deadline.

•That's great! Told you it worked. What did they say about your appeal?

Atticus Domingo
•They said I need to submit form and provide documentation of my family emergency. The rep was actually really helpful once I got through to her.

•Awesome news! Keep us posted on how the appeal goes. Fingers crossed for you!

Similar thing happened to my brother last year. Washington ESD denied his claim, he appealed, and eventually got all his back pay. Took like 2 months but he got every penny he was owed.

Atticus Domingo
•That gives me hope! Did he have to do anything special during the appeal process?

Paloma Clark
•He had to provide a lot of documentation and had a phone hearing. But once he proved he was laid off and didn't quit, they reversed the decision.

I'm still skeptical about using third-party services to contact government agencies. Seems like there should be a better way to reach Washington ESD directly.

•I agree it shouldn't be necessary, but when you're desperate and need to pay bills, sometimes you have to use whatever works. The system is broken.

•Fair point. I guess if it gets results when nothing else works, it might be worth it.

Make sure you gather ALL your documentation before you submit your appeal. Washington ESD will want to see everything - termination paperwork, pay stubs, any communication with your employer about the layoff.

•Good advice. I'm putting together a folder with everything I can find. Better to have too much documentation than not enough.

Heather Tyson
•Exactly. And make copies of everything before you submit. Sometimes things get lost in their system.

This whole thread is making me anxious about my own claim. I'm waiting for adjudication right now and worried they'll find some reason to disqualify me too.

•Don't worry too much. As long as you were honest on your application and have documentation of your job separation, you should be fine. Most claims get approved eventually.

•Thanks, that's reassuring. This whole process is just so stressful when you're already dealing with being unemployed.

I work in HR and see this kind of thing all the time. Employers sometimes report job separations incorrectly to avoid paying higher unemployment insurance premiums. It's worth fighting if you know you were laid off.

Atticus Domingo
•That's really interesting. I never thought about employers having a financial incentive to misreport separations. Makes me even more determined to fight this.

Jenna Sloan
•Definitely fight it. The unemployment system is designed to help people who lost their jobs through no fault of their own. You deserve those benefits if you were laid off.

How long does the good cause appeal process usually take? I'm in a similar situation and need to know what to expect.

•It varies, but typically 2-6 weeks for Washington ESD to review good cause appeals. If they accept your good cause, then you still have to go through the regular appeal process for the underlying disqualification.

•Ugh, so it could be months before I see any money. This system is so slow.

I used Claimyr too after seeing it mentioned here. Got through to Washington ESD in about 45 minutes when I'd been trying for days on my own. Worth checking out if you're stuck like I was.

Just want to add that you should keep filing your weekly claims even while your appeal is pending. If you win your appeal, you'll get back pay for all the weeks you filed.
0 coins
Atticus Domingo
•Wait, I can still file weekly claims even though I'm disqualified? I thought I wasn't supposed to do that.
0 coins
Noland Curtis
•Yes, you should keep filing to preserve your right to those weeks if your appeal is successful. Just make sure to mark that you're appealing your disqualification.

Good luck with your appeal! I went through something similar and it worked out in the end. Don't give up - you have rights as an unemployed worker.

•Thank you for the encouragement! It's been really stressful but this thread has given me hope that I can get this resolved.

•You got this! Just stay organized with your paperwork and be persistent. The system is slow but it does work eventually.

One more tip - if you have any witnesses to your layoff (coworkers, supervisors who weren't involved in the decision), their statements can help support your case.
0 coins
Atticus Domingo
•That's a great idea! I have a coworker who was laid off the same day. I'll ask her if she'd be willing to provide a statement.

•Perfect! Having corroborating evidence from someone else who was there makes your case much stronger.

This is exactly why I hate dealing with government agencies. They make simple things so complicated and then you can't even reach anyone when you need help.

Atticus Domingo
•I feel you. It's frustrating when you're already stressed about being unemployed and then the system that's supposed to help you is so hard to navigate.

•Exactly! Like we don't have enough to worry about already.

•Wait, I think there might be some confusion here - the final update was posted by Sadie Benitez, but this whole thread was started by Atticus Domingo. Are you the same person with a different account, or did someone else also submit an appeal? Just want to make sure we're all following the right case!
