Can I file for ESD unemployment today after my last work day yesterday? Confused about waiting period!

My job at the restaurant ended yesterday (they cut our staff by 40% due to slow season). I've worked there for almost 2 years steady. I want to apply for unemployment benefits ASAP but I'm confused about the waiting week. If I file my initial claim today, will this count as my waiting week? Or do I need to wait until next week to file so that this upcoming week becomes my waiting period? I'm worried about making a mistake that might delay benefits. Also, do I need to do the 3 job search activities during the waiting week? This is my first time applying for unemployment in Washington and I'm totally lost.

You should file your initial claim immediately! The waiting week doesn't start until your claim is approved and processed. The sooner you file, the sooner your claim starts getting processed. Your waiting week will be the first eligible week after your claim is approved, and yes, you DO need to complete and document your 3 job search activities even during the waiting week.

Thank you! I'll file today then. Do you know roughly how long it takes for claims to get processed these days?

This is partially correct but I want to clarify: the waiting week isn't necessarily the first week after you apply. It's the first week you're eligible for benefits after your claim is approved. If there are issues with your claim that require adjudication, your waiting week might not start until those are resolved. But yes, absolutely file ASAP!

DEFINITELY file today! ESD takes forever to process claims sometimes. I waited a couple weeks after my last day thinking I needed to and it just delayed everything. The waiting week doesn't start ticking until your claim is approved anyway. And YES you absolutely must do your job search activities during the waiting week! I got denied because I didn't realize this and it was a huge hassle to fix.

That's scary! I'll make sure to do the job searches. Do I need special documentation or just the basic info about where I applied?

I got laid off in January and here's what I learned: Apply immediately, the waiting week is the first week you're eligible after approval (not when you apply). You MUST do 3 job search activities even in the waiting week. Document everything - employer name, contact info, position, how you applied, date, etc. ESD sometimes audits these!

Great advice. And if you're having trouble getting through to ESD with questions about your claim (which is common), I'd recommend trying Claimyr. It helped me get through to an actual ESD agent when I kept getting disconnected. They have a video that explains how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. The website is claimyr.com. Saved me hours of frustration when my claim had issues.

When I filed last year the system was SO confusing!! Just apply now, but know that they might ask for more info later which slows everything down. My friend and I both applied the same day and she got approved in 2 weeks while mine took over a month because of "identity verification" even though we had similar situations!

Yeah the ID verification thing is ridiculous. They made me upload my documents THREE TIMES because their system kept glitching. Then they never told me it was resolved until I finally got through on the phone.

To directly address your question: File your claim immediately. According to ESD rules, your claim will be effective the Sunday of the week you file. The waiting week is the first week you're eligible for benefits (meet all eligibility requirements including job searches) after your claim is processed. So if you file today, and there are no issues requiring adjudication, your waiting week would likely be this current week. You won't receive benefits for the waiting week, but you must complete job search activities and file a weekly claim for it. There's absolutely no advantage to delaying your application. Only disadvantages as it pushes back when you might receive benefits.

Thank you for the detailed explanation! That makes much more sense. I'll apply today and start my job searches right away. Hopefully there won't be any issues with my claim.
