How long to file for unemployment - Washington ESD deadline confusion
I got laid off from my restaurant job last Friday and I'm confused about timing for filing my unemployment claim. Some people are telling me I need to file right away, others say I have weeks. What's the actual deadline with Washington ESD? I don't want to mess this up and lose benefits because I waited too long. Also heard something about a waiting week - does that mean I should wait a week before filing or file immediately and then wait? Really need to get this right.

You should file as soon as possible after your last day of work. Washington ESD doesn't pay benefits for weeks before you file your initial claim, so waiting costs you money. There's no waiting week anymore - they eliminated that during COVID and never brought it back.

•Oh thank god about the waiting week thing. So I should have filed yesterday then? Can I still get benefits for this week if I file today?

Miguel Herrera
•Yes file TODAY. Your benefit year starts the Sunday of the week you file, so if you file today you can claim benefits starting from this past Sunday.

The sooner the better! I made the mistake of waiting two weeks after I got laid off thinking I'd find something quick. Lost out on $1,200 in benefits because Washington ESD won't backdate claims.

•Ouch that's expensive mistake. Filing online right now then.

•same thing happened to my brother, he waited almost a month and couldn't get any of those weeks back

File immediately but be prepared for potential delays getting through to Washington ESD if you need help. I've been trying to reach them for three weeks about an adjudication issue. If you run into problems reaching an agent, I recently discovered Claimyr (claimyr.com) which actually got me connected within an hour. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•What kind of adjudication issue? Should I expect problems with my claim?

Yara Nassar
•Not necessarily - mine was because I had some contract work mixed with W2 employment. Most straightforward layoffs process pretty quickly.

•How much does that Claimyr thing cost? Seems sketchy to pay to reach a government agency.

File within the first week after your last day of work. Technically you can file up to a year later but you'll lose all those weeks of benefits. Washington ESD is very strict about not backdating claims except in rare circumstances with good cause.

Ava Thompson
•What counts as good cause for backdating?

•Usually serious illness, military deployment, or other circumstances completely beyond your control. Getting bad advice or not knowing the rules doesn't qualify.

Just file online at secure.esd.wa.gov it takes like 20 minutes. Don't overthink it.

•Is the online system pretty straightforward? I'm not great with computer stuff.

•Yeah it walks you through everything step by step. Have your social security card and employment info ready.

THE SYSTEM IS BROKEN! I filed the day I got laid off and it's been 6 weeks with no payment. They keep asking for more verification documents. File fast but don't expect anything quickly.

•What kind of verification are they asking for? That's not typical for a standard layoff.

Amina Diop
•Identity verification, then work search records, then they wanted bank statements. It's ridiculous!

•That sounds like you might have gotten caught up in fraud prevention measures. Did you move recently or have any other complications?

file asap but also start looking for work immediately because the job search requirements are no joke

•How many jobs do you have to apply to per week?
0 coins
Miguel Herrera
•Three job search activities per week minimum. Can be applications, networking events, job fairs, etc. Keep detailed records.

I waited 3 days after getting fired and still got all my benefits. You don't have to file the exact same day as long as it's within the same week.

Keisha Jackson
•That's because your benefit year started the Sunday of that week regardless. But waiting longer than a week would have cost you.

•Right, exactly. Just wanted OP to know they don't have to panic if they can't file today.

Make sure you have all your employment info ready before you start the application. Last employer contact info, dates worked, reason for separation. It'll save you time.

•Do I need pay stubs or anything like that?

StarGazer101
•Not usually for the initial application, but have your last few pay stubs handy in case they ask for income verification later.

File today! I'm a former Washington ESD employee and the number one mistake people make is waiting. Every week you don't file is money you can't get back.

•As a former employee, any insider tips for getting through the system smoothly?

Javier Torres
•Be completely honest on your application, keep detailed records of everything, and respond to any requests for information immediately. Most delays happen because people don't provide requested documents quickly enough.

•This is solid advice. Also screenshot everything in case the system glitches.

One thing nobody mentioned - if you're filing late in the day on Friday, the system might be slow because everyone files on Fridays. Try early morning if possible.

Ava Thompson
•Good point, I'll try first thing tomorrow morning then.

Paolo Romano
•Yeah the system definitely crawls on Friday afternoons and Sunday evenings.

Quick question - does the restaurant industry have any special rules for unemployment? I know some seasonal industries do.
0 coins
Javier Torres
•No special rules for restaurants unless it was a seasonal operation. Regular unemployment rules apply.

Ava Thompson
•It was a regular restaurant open year-round, so I should be good then.

Don't forget you'll need to file weekly claims too once your initial claim is approved. Set a reminder for the same day each week.
0 coins
Ava Thompson
•How do the weekly claims work? Do I have to report job searches every week?
0 coins
Malik Johnson
•Yes, you report your job search activities and any work/income for that week. Miss a weekly claim and you lose that week's benefits.
0 coins
Miguel Herrera
•The weekly claims open on Sunday morning and you have until Saturday night to file. Don't wait until the last minute.

Update on the Claimyr thing I mentioned earlier - it's actually really reasonable cost-wise and saved me hours of calling. Worth it if you need to talk to Washington ESD about anything complicated.

Isabella Santos
•How exactly does it work? Do they call for you or just help you get through?
0 coins
Yara Nassar
•They handle the calling and waiting, then connect you when an agent is available. Much better than spending your whole day redialing.

Also heads up - if you worked in multiple states recently, your claim might be more complicated. Washington ESD might need to coordinate with other states for wage records.
0 coins
Ava Thompson
•I've only worked in Washington, so that shouldn't be an issue for me.
0 coins
Ravi Sharma
•Then you should have a pretty straightforward process. Just file ASAP and you'll be fine.

one more thing - if you get denied for any reason don't panic, you can appeal. but the appeal deadline is only 30 days so don't wait
0 coins
Ava Thompson
•What are common reasons for denial?
0 coins
Javier Torres
•Misconduct, voluntary quit without good cause, or not meeting wage requirements. Since you were laid off, you should be fine unless there were performance issues.

The bottom line is file NOW. Every day you wait is money lost. The Washington ESD system isn't perfect but it works if you follow the rules and file on time.

Just wanted to add that if you have any issues reaching Washington ESD after filing, that Claimyr service someone mentioned earlier really does work. Used it last month when my claim got stuck in adjudication.
0 coins
Ava Thompson
•I'll keep that in mind if I run into problems. Hopefully my claim goes through smoothly.

•Most do! But it's good to know the option exists if you need it.

Perfect timing on this thread - I just got laid off yesterday and was wondering the same thing. Filing my claim now too!

•Sorry to hear about your layoff but glad the thread helped! Good luck with your claim.

•Make sure you both keep good records of your job search activities from day one. It's much easier than trying to reconstruct them later.
