TWC said I quit when I was fired - 6 weeks waiting for appeal decision
I lost my job on Nov 28 and filed for unemployment on Dec 11. When TWC contacted my employer, they claimed I voluntarily quit - which is 100% NOT TRUE! I was fired without warning after 3 years with no write-ups. I submitted my statement explaining what happened about 5 weeks ago, and now I'm just stuck waiting. My payment status shows 'pending' with no updates. This is week 6 of waiting and I haven't heard a single thing from TWC about my appeal. My savings are almost gone and my rent is due next week. Does anyone know how long these employer dispute cases take to resolve? Is there anything I can do to speed up the process or at least get some update on where things stand? The online portal shows nothing helpful.

Ugh, I went through EXACTLY the same thing last year! My boss fired me then told TWC I abandoned my job. The wait time for these employer disputes is ridiculous - mine took almost 8 weeks before they made a determination. And that was AFTER I had to do a phone interview with a TWC examiner which didn't happen until week 6. Have you had your phone interview yet?

•they'll send you a letter with the hearing date. check ur mailbox not just the online portal. sometimes they send stuff only by mail and nothing shows online

These employer disputes typically take 6-8 weeks to resolve since TWC has to investigate both sides of the story. When an employer claims you quit but you say you were fired, it creates what's called a "separation issue" that requires a determination interview. You should receive a notice in the mail with the date and time of your interview - but these are often scheduled 4-6 weeks out from your initial claim due to backlogs. In the meantime, make absolutely sure you're still requesting payment every two weeks on your assigned day, even though you're not receiving benefits yet. If you don't keep requesting payments, your claim could be closed. Also, continue doing and documenting your 3 work search activities each week. If the determination is eventually made in your favor, you'll receive all back payments for the weeks you properly requested.

Mine only took 4 weeks but my manager didn't fight it too hard and basically admitted they let me go when pushed. Sounds like your employer is being difficult. Just keep doing those work searches and payment requests!!! Super important

The TWC phone lines are completely jammed these days. After trying for two weeks to get through (constant busy signals and disconnections), I found this service called Claimyr that got me connected to a TWC agent in about 20 minutes. Cost money but saved me days of frustration. Turns out they had mailed the interview notice to my old address even though I'd updated it online. Might be worth checking into since you're at week 6 with no interview scheduled yet.

•Yes, they answered all my questions and even updated some info in my file that was wrong. The key is knowing what to ask when you get through. Have your claim ID ready and specifically ask: 1) Is my interview scheduled yet? 2) What date? 3) Is there anything else holding up my claim? 4) What's the current status of my separation dispute? Write everything down!

Another important thing to know - if you haven't received any communication by mail about your interview yet, it's possible it got lost or was sent to the wrong address. TWC is still working through some mail issues from when they changed their processing system last month. You can try sending a message through the UI portal asking for the status of your separation dispute and interview schedule, but responses there can take 7-10 business days. If you do get through on the phone, make sure to ask about the "Appeal Deadline" that would be listed on your Determination Letter. You don't want to miss that appeal window if TWC initially sides with your employer.

im in week 9 of waiting!!! its horrible. they said my employer claimed misconduct but i was actually laid off with 15 other people in my department. The TWC system is a JOKE and they dont care about us at all!!! i've called 47 times and never gotten through. cant pay my car payment now. this is RIDICULOUS!!!

•Google "Texas state representative" + your zip code. Their offices have staff specifically for helping constituents with state agency issues like TWC problems. They can sometimes work magic when you're stuck in bureaucratic limbo. Worth a try!

u need to keep calling. busy signals are normal, just keep hitting redial. took me 143 calls to get thru last tuesday but when i did the lady fixed everything. oh and make sure ur calling the right number for ur area code, they have different ones

UPDATE: I finally got through to TWC this morning after using that Claimyr service someone recommended! The agent confirmed my interview is scheduled for next Wednesday at 1:30pm. Apparently they sent the notice last week but to my old address even though I updated it online when I filed. The agent updated my address again and said I should receive a determination within 7-10 days after the interview. She also explained that my former employer is claiming I walked off the job after an argument with my supervisor, which is completely false. I was told to leave after I questioned a new policy that violated our employee handbook. I have documentation and witness statements ready for my interview. Thanks everyone for your advice and support! I'll update again after my interview next week.
