TWC case pending for 5 weeks - employer not responding to my claim?

I lost my job at a small marketing agency about 5 weeks ago and applied for unemployment right away. My claim is still showing as 'pending' in the system with no updates or notifications. I'm starting to worry it's because my former employer hasn't responded to TWC about my claim. Does anyone know how long TWC will wait for an employer to respond before making a decision? Can they just leave my case pending indefinitely? I've already completed five payment requests but haven't received anything, and my savings are getting dangerously low. I tried calling but can't get through to anyone who can tell me what's happening with my claim.

Two months?? Did you do anything to speed up the process or just wait it out?

The employer has 14 calendar days to respond to a TWC claim notice. If they don't respond within that timeframe, TWC is supposed to make a determination based on the information they have from you. However, with the current backlog, many claims are taking 4-6 weeks even without employer response issues. A few things to consider: 1. Continue requesting payments every two weeks even though you're not receiving benefits yet 2. Check your correspondence inbox on the TWC portal for any requests for additional information 3. Make sure you're completing your required work search activities (minimum 3 per week) If your claim is pending beyond 6 weeks, that's when you should really start pursuing more aggressive contact options.

Thank you for the detailed response! I have been doing all my payment requests and work searches. There's nothing in my correspondence inbox asking for more information, so I guess I'm just stuck waiting. It's just stressful not knowing if there's a problem or if it's just normal processing time.

Omg this is EXACTLY what happened to me!! My employer ghosted TWC and my claim sat there for SEVEN WEEKS!!! I called every day and only got busy signals or was hung up on. The system is COMPLETELY BROKEN. I finally had to contact my state representative's office before anyone would look at my claim. Don't just wait - you need to be aggressive or you'll be waiting forever!!!!

Seven weeks is crazy! Did contacting your state rep actually help? I might try that if I don't see movement soon.

I went through a similar situation last quarter. When employers don't respond, TWC is supposed to proceed with the information they have, but they're severely backlogged right now. Here's what worked for me: 1. I used Claimyr (claimyr.com) to get through to a live agent. They have a service that helps you bypass the busy signals. Their video demo (https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh) shows how it works. I was skeptical at first but it actually connected me with a TWC agent who could see my file. 2. Once I got through, I found out my case was assigned to an examiner but was in a queue waiting for review. The agent was able to flag it for priority handling. 3. I received my determination letter 3 days later, and my first payment hit my account the following week. Keep documenting everything and make sure you continue filing your payment requests even while waiting.

I second this advice! I was stuck in pending for almost 2 months until I finally got through to a TWC agent. Once a human actually looked at my claim it was resolved in like 48 hours.

just curious - what reason did they give for your separation? that can affect how long they take to process. i was laid off due to business closure and mine only took 10 days to approve back in january

They said my position was eliminated, but there might be more to it. The company was having financial issues, but they also hired someone new shortly after letting me go (in a slightly different role though). I'm wondering if that's complicating things.

Your employer has 14 days to respond to TWC after they receive notification of your claim. If they don't respond, TWC should make a determination based on the information you provided in your initial application. However, there are a few things to understand about the process: 1. The 14 days starts after TWC sends the notice to your employer, not from when you file your claim 2. If your separation reason is anything other than a straightforward layoff (reduction in force), TWC may need to conduct a more detailed investigation 3. Even if your employer doesn't respond, TWC is currently taking 4-8 weeks to process claims due to high volume Make sure you're continuing to request payments every two weeks and completing your work search requirements (minimum 3 activities per week). When TWC does make a determination, they'll pay you retroactively for all the weeks you properly requested payment. If you need immediate assistance with bills while waiting, consider contacting 211 Texas for information about emergency assistance programs in your area.

This is very helpful, thank you. I'm definitely keeping up with my payment requests and work searches. I'll give it another week before trying more aggressive options to get through to someone.

Has anyone checked your work search activities yet? Sometimes they put claims on hold to verify that stuff before they start paying out. The whole process is seriously messed up - they expect us to live on air while they take their sweet time figuring everything out!

Quick update - I just heard from a friend who works at workforce solutions that TWC is currently processing a backlog of claims from companies that went through mass layoffs in March. Individual claims like yours might be delayed because they're prioritizing the large batches. Not sure if that helps, but it might explain some of the delay.

That actually makes a lot of sense. There were several big tech layoffs in Austin recently. At least it's not specifically my claim that's the problem. Thanks for the insight!

One more thing to check - log into your TWC account and go to the "Claim and Payment Status" section. Look for any status messages or pending issues listed there. Sometimes there are specific hold reasons that don't generate correspondence but are visible in that section of your account. It might give you more insight into why your claim is delayed.

I just checked and it says "Claim Status: Pending" with no additional information. Under payment status it says "No payments have been processed for this claim." Frustratingly vague!
