PA UC disqualification after RESEA deadline - does finding a job exempt me?
So frustrated right now! I just got hit with a disqualification letter from PA UC because I supposedly didn't complete my RESEA program on time. Here's what happened: I was supposed to complete it by January 25th, but they didn't even call me to schedule until the 27th! I finished everything on the 29th, but apparently that wasn't good enough. The kicker is I actually found a full-time landscaping job back in November (starts this spring when the season begins). Since I already secured employment, was I even required to complete RESEA at all? This seems ridiculous - I found work but now might lose benefits for the few months until my job actually starts because of their scheduling delay. Has anyone dealt with this situation? Can I appeal this disqualification?

Unfortunately, finding a job doesn't exempt you from RESEA requirements while you're still claiming benefits. Even if your job starts in the future, you're still required to complete all UC mandated programs until you actually stop filing weekly claims. The good news is you have a valid reason to appeal since they contacted you after the deadline. File your appeal ASAP (you only have 15 days from the date on the determination letter) and explain exactly what happened with the scheduling. Bring any proof you have of when they contacted you to schedule.

Same thing happend to me last yr!!! UC is TERRIBLE with there scheduling. I had to wait 3 months for my appeal hearing but I won because I had proof they called me late. SAVE THE VOICEMAIL if you still have it!!

When you appeal, make sure to clearly explain that you DID complete the RESEA program, just not by their deadline because THEY contacted you late. Also emphasize that you've secured employment starting in spring. While that doesn't technically exempt you from RESEA, it shows good faith that you're actively solving your unemployment situation. Appeals can take 8-12 weeks to be scheduled right now, so be prepared to wait. In the meantime, keep filing your weekly claims even if they show as disqualified so you don't miss out on back payments if you win your appeal.

The PA UC system is DESIGNED to trip people up with these technicalities! They schedule RESEA sessions after deadlines ON PURPOSE so they can disqualify people and save money. One important detail: in your appeal, request a backdating of the RESEA deadline based on when they actually contacted you. Reference UC RESEA policy which states they must provide reasonable time to complete requirements. Also, you should specifically request 'relief from fault overpayment' status in case they try to claim you were overpaid for weeks before the disqualification.
