Won my unemployment appeal - when do I get paid by NYS Department of Labor?
So I finally got the decision letter yesterday that my unemployment appeal was successful! After 2 months of waiting and stressing about bills, they overturned the disqualification. The letter says my benefits are approved retroactive to when I first filed. But it doesn't say anything about when I'll actually see the money. Does anyone know how long NYS Department of Labor takes to process payments after winning an appeal? I have 8 weeks of back pay coming and really need to know if it'll be days or weeks.

Congratulations on winning your appeal! Usually takes 3-5 business days for NYS Department of Labor to release retroactive payments after an appeal decision. Your back pay should come as separate deposits for each week you were eligible. Make sure to keep filing your weekly claims even while waiting for the retroactive payments.

•Thank you! I was worried it would take forever like everything else with the unemployment system. Should I expect 8 separate deposits or will they combine some weeks?

OMG yes finally some good news for someone!! I'm still waiting on my appeal decision after 6 weeks. Did you have to provide additional documentation or did they just review what you already submitted? I'm so nervous they're going to deny mine too.

•I didn't have to submit anything new. The hearing officer just reviewed my original evidence and agreed that my former employer's claim was bogus. Keep your head up - if you have a solid case you should be fine!

From my experience, once you win the appeal, NYS Department of Labor processes it pretty quickly. The delay is usually in the appeal process itself, not the payment processing. You should see your retroactive payments within a week, and then your regular weekly benefits will resume on the normal schedule.

I had the same situation last year and it was about 4 days before I saw the first payment hit my account. But here's the thing - if you have trouble reaching someone at NYS Department of Labor to check on the status, I used this service called Claimyr (claimyr.com) that helped me get through to an actual agent. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really saved me hours of calling.

•Never heard of that but honestly anything is better than sitting on hold for 3 hours just to get disconnected

same thing happened to my cousin except it took like 2 weeks to get paid after winning appeal, not sure why some people get it faster

The appeal system is such a joke anyway. They disqualify people for the dumbest reasons and then act like they're doing you a favor when they fix their own mistakes. At least you got yours resolved but 2 months without income because of their incompetence is ridiculous.

•Tell me about it. I had to borrow money from family just to pay rent. The whole system needs an overhaul.

Congrats on winning your appeal! I went through the same thing about 6 months ago. In my case, it took exactly 5 business days from getting the decision letter to seeing the first retroactive payment. They processed mine as 2-3 payments rather than individual weekly deposits - I think they group them to make it more efficient. Just make sure your direct deposit info is still current in your account. And definitely keep certifying weekly like others said, even while waiting for the back pay. The system should automatically adjust everything once the payments start flowing.

•That's really helpful to know about the grouped payments - I was wondering if I'd get 8 separate deposits or if they'd combine them. Good point about double-checking the direct deposit info too. After all this waiting, the last thing I need is a payment delay because of outdated banking details!

Congrats Romeo! That's such a relief after 2 months of stress. I'm currently going through the appeal process myself (filed about 3 weeks ago) and posts like yours give me hope. Quick question - did you get any kind of notification before the decision letter arrived? Like an email or status change in your online account? I keep obsessively checking my mailbox and the NYS DOL website but haven't seen any updates yet. Really hoping mine goes as smoothly as yours did!

•Thanks for asking this - I was wondering the same thing! In my case, there was no advance notification at all. The decision letter just showed up in my mailbox one day with no email or status update on the website beforehand. The online portal still showed "pending" even after I received the approval letter. So don't stress too much about checking constantly - you'll probably get the physical letter before any online updates. Fingers crossed your appeal goes smoothly too!

Wow, congratulations Romeo! That must be such a huge relief after going through all that stress and uncertainty. I'm currently dealing with a similar situation - my employer contested my claim saying I was fired for misconduct (which is completely false), and I've been waiting 5 weeks now for my appeal hearing date. Stories like yours give me hope that the system does eventually work, even if it takes way too long. Did you have to do a phone hearing or was it handled through paperwork? And thanks for sharing this - it's really helpful to know what to expect with the payment timeline once the appeal is successful.

•Hey Justin, thanks for the kind words! I totally understand that stress and uncertainty - it's absolutely awful not knowing when you'll have income again. In my case, it was a phone hearing that lasted about 45 minutes. The hearing officer was pretty fair and let both sides present their case. My former employer's HR rep couldn't provide any solid evidence for their misconduct claim, which really helped my case. 5 weeks is still within the normal timeframe from what I've seen others post here, so try not to worry too much. Just make sure you have all your documentation organized and ready - pay stubs, any written communications with your employer, witness statements if you have them. The wait is brutal but hang in there!

Hey Romeo, congrats on winning your appeal! That's such a huge weight off your shoulders after 2 months of uncertainty. I went through something similar about a year ago and the payment processing was actually faster than I expected - got my first retroactive payment about 4 business days after receiving the decision letter. One tip that helped me: log into your NYS DOL account and make sure your direct deposit info is still accurate, because sometimes bank account details can expire or change during these long waits. Also, even though you won the appeal, keep filing your weekly certifications religiously - the system needs those to process your ongoing payments correctly. The retroactive payments usually come in chunks rather than individual weekly deposits, so don't be surprised if you see 2-3 larger payments rather than 8 separate ones. Hope this helps ease some of the anxiety while you wait for that money to hit your account!

•This is super helpful Sofia, thank you! I'm definitely going to check my direct deposit info right now - that's such a good point about details potentially expiring during the long wait. And good to know about the chunked payments rather than individual weekly ones. After 2 months of stress, I just want to make sure I don't accidentally delay things further by having outdated banking info. Really appreciate everyone sharing their experiences here - it's so much more helpful than trying to get answers from the actual DOL phone line!

Congratulations Romeo! What a relief that must be after 2 months of waiting and stress. I'm curious - did you use a lawyer for your appeal or represent yourself? I'm facing a similar situation where my employer is claiming I quit when I was actually laid off, and I'm trying to decide if I should get legal help or handle the appeal on my own. Also, just wanted to echo what others have said about keeping up with your weekly certifications even while waiting for the back pay. I made that mistake during my first claim and it caused all sorts of headaches. Fingers crossed your payments come through quickly!

•Hey Donna! I represented myself for the appeal - didn't use a lawyer. Since my case was pretty straightforward (employer claimed misconduct but had zero documentation to back it up), I felt confident handling it alone. For your situation with the quit vs layoff dispute, if you have any paperwork showing it was a layoff (emails, termination letter, etc.), you might be fine going solo. But if it's more he-said-she-said, a lawyer could be worth considering. The hearing process itself wasn't too intimidating - just be prepared to clearly explain your side and have any evidence ready. Good luck with your appeal!

Congratulations Romeo! That's fantastic news after such a long wait. I went through a similar appeal process about 8 months ago and it's such a relief when you finally get that approval letter. From my experience, NYS DOL was actually pretty efficient with the payment processing once the appeal was won - I got my first retroactive payment within 6 business days. They sent mine in 3 separate deposits over about a week, which seemed to be grouped by month rather than individual weeks. One thing I wish someone had told me: make sure to screenshot or save a copy of your decision letter, because the online system can be glitchy and sometimes doesn't reflect the appeal outcome right away. Also, don't panic if the first payment seems smaller than expected - they sometimes process the most recent weeks first and then send the earlier weeks in subsequent payments. Hope you see that money in your account soon!

•Thanks Mae, this is really helpful advice! I definitely didn't think about saving a copy of the decision letter - that's a great point about the online system being glitchy. And good to know the payments might come in a different order than expected. After waiting this long, I just want to make sure I don't miss anything that could delay the process further. Really appreciate everyone sharing their experiences here - it makes this whole stressful process feel a lot less isolating when you know others have been through the same thing and came out okay!

Congratulations Romeo! That's amazing news after such a stressful 2 months. I'm actually going through the appeal process right now too (just filed last week) and seeing success stories like yours really helps keep my spirits up. Based on what others have shared here, it sounds like you should see your money pretty quickly - seems like most people get their first payment within 3-7 business days once the decision is made. I'm keeping my fingers crossed that your 8 weeks of back pay comes through fast! Make sure to treat yourself to something nice once it hits your account - you've definitely earned it after dealing with all this bureaucratic nonsense.

•Thank you so much for the kind words and encouragement! It really does help to know others are going through similar situations - this whole process can feel so isolating when you're dealing with it alone. I'm keeping my fingers crossed for your appeal too! The waiting is absolutely the worst part, but from everything I've read here, it sounds like most people with legitimate cases do eventually get approved. And you're right about treating myself - after 2 months of stress and living off borrowed money, I'm definitely planning a small celebration once that first payment hits! Wishing you all the best with your appeal process.

Congratulations Romeo! That's such wonderful news after what sounds like an incredibly stressful two months. I'm currently in week 4 of waiting for my own appeal hearing, so seeing your success really gives me hope that the system does work eventually. From what I've read in other posts here, it seems like NYS DOL is usually pretty quick with the payment processing once they make the decision - most people seem to get their first retroactive payment within a week. Just wanted to add my voice to what others have said about keeping up with your weekly certifications while you wait for the back pay. I made the mistake of stopping those during my initial claim thinking it didn't matter, and it caused delays later. Hope you see that money hit your account soon - you definitely deserve it after dealing with all this bureaucratic mess!

•Thanks Zoe! It really is such a relief to finally have this resolved. Week 4 of waiting sounds brutal - I remember that feeling of checking the mail obsessively and refreshing the DOL website constantly. You're absolutely right about keeping up with the weekly certifications though. I almost stopped doing them around week 6 thinking "what's the point if I'm not getting paid anyway" but thankfully kept going. From what everyone's shared here, it sounds like those certifications are crucial for the system to process everything correctly once the appeal goes through. Hang in there - hopefully you'll get your hearing scheduled soon and can put this whole nightmare behind you!

Congratulations Romeo! That's such great news after everything you've been through. I went through a similar appeal process about 4 months ago and I know exactly how stressful that waiting period can be. In my case, NYS DOL processed the retroactive payments pretty quickly once the decision was made - I got my first payment about 5 business days after receiving the approval letter. They sent mine in 2 larger deposits rather than 8 separate weekly payments, which actually worked out better for me. One thing I'd suggest is double-checking that your direct deposit information is still current in your online account, just to avoid any potential delays. Also, definitely keep filing your weekly certifications while you wait for the back pay - the system needs those to keep everything in sync. After 2 months of financial stress, you deserve to get paid quickly! Hope you see that money in your account very soon.

•Thanks for sharing your experience Chloe! It's really reassuring to hear that most people seem to get their payments processed within that 5-7 business day window. I'm definitely going to check my direct deposit info right now - that's such a smart suggestion and something I hadn't even thought about after all this time. The idea of getting 2 larger deposits instead of 8 separate ones actually sounds way better too. After reading everyone's responses here, I'm feeling much more optimistic about getting this resolved quickly. This community has been so much more helpful than trying to get information from the actual DOL!

Congrats Romeo! I just went through this exact same situation about 3 months ago and can totally relate to that mix of relief and anxiety - finally winning the appeal but then wondering when you'll actually see the money! In my experience, NYS DOL was surprisingly efficient once the decision was made. I got my first retroactive payment exactly 4 business days after receiving the approval letter, and they sent it in 3 separate deposits over about 10 days (seemed to be grouped by benefit year periods). One thing that really helped me was logging into my account and updating my direct deposit info even though it hadn't changed - apparently that can sometimes speed up the processing. Also echoing what others said about continuing those weekly certifications religiously! The back pay is automatic once approved, but you need those current certs to keep your ongoing benefits flowing smoothly. After dealing with 2 months of financial stress, you should hopefully see that first payment hit your account by early next week. Fingers crossed it comes through quickly for you!

•Thanks Liam! That's really encouraging to hear about the 4-day timeline - sounds like most people are getting their payments within that first week after the decision. The tip about updating direct deposit info even if it hasn't changed is brilliant - I never would have thought of that but it makes sense that it might refresh something in their system. I'm definitely going to do that today along with double-checking everything else in my account. It's so helpful to hear from people who've actually been through this process recently rather than trying to decipher the vague information on the DOL website. Really appreciate you taking the time to share your experience!

Congratulations Romeo! That's such amazing news after 2 months of stress and uncertainty. I'm actually in a similar boat - just got my appeal decision last week after a 7-week wait, and like you, I'm trying to figure out the payment timeline. From what I've been reading online and from others' experiences, it sounds like NYS DOL is usually pretty quick with processing payments once the appeal decision is made - most people seem to get their first retroactive payment within 3-7 business days. I'm expecting about 6 weeks of back pay myself, so I totally understand that mix of relief and anxiety about when the money will actually show up! One thing my cousin mentioned (she went through this last year) is to make sure you keep doing your weekly certifications even while waiting for the retroactive payments, because the system needs those to process everything correctly going forward. Really hoping both of us see our payments hit our accounts soon - we've definitely earned it after dealing with all this bureaucratic mess!
