How long after winning unemployment appeal do I get payment from NYS Department of Labor?
Won my unemployment appeal hearing last Thursday and the judge ruled in my favor. My claim was originally denied for 'voluntary quit' but I proved it was constructive dismissal. The hearing officer said NYS Department of Labor would process the decision within 10 business days but didn't say when I'd actually get paid. My claim shows 'appeal decision pending implementation' right now. Has anyone been through this? How long did it take to get your back pay after winning? I'm owed about 8 weeks of benefits and really need this money.

Congratulations on winning your appeal! The implementation usually takes 7-14 business days after the hearing decision. Once your claim status changes from 'appeal decision pending implementation' to 'approved,' you should see your back pay within 2-3 business days. Make sure you keep filing your weekly claims even if they show $0 - this keeps your claim active and ensures all your weeks get paid retroactively.

•Thank you! I've been filing my weekly claims the whole time even though they weren't paying. Should I expect one lump sum or will they pay each week separately?

same thing happened to me but it took almost 3 weeks to get paid after winning my appeal. nysdol moves slow even when they owe you money. keep checking your payment history and make sure all your weeks show up as payable

•Three weeks seems like forever when you're waiting for back pay. Did you have to do anything special or did the money just show up eventually?

The back pay usually comes as separate deposits for each week you were denied, not one lump sum. If it's been more than 15 business days since your hearing decision, I'd recommend calling NYS Department of Labor to check on the implementation status. I had success using Claimyr (claimyr.com) to get through to an actual agent when I couldn't reach anyone directly. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped me get answers about my appeal payment delays.

•Never heard of that service but might be worth trying if the regular phone lines don't work. NYS Department of Labor phone system is impossible to navigate when you actually need help.

won my appeal in march and STILL waiting for some of my back pay... they paid most of it but there's like 2 weeks missing and nobody can tell me why. appeal process is just the beginning of the headache

•You should definitely follow up on those missing weeks. Sometimes certain weeks get flagged for additional review even after an appeal win. Check your payment history to see if those weeks show any special status codes.

Just curious - did you have a lawyer for your appeal hearing? I'm thinking about appealing my denial but not sure if I need legal help or can represent myself.

•I represented myself. As long as you have good documentation and can clearly explain why the denial was wrong, you don't necessarily need a lawyer. The hearing officers are pretty fair in my experience.

I went through this exact same situation about 6 months ago - also had a constructive dismissal case that was initially denied. After winning my appeal, it took exactly 12 business days for my claim status to change from "appeal decision pending implementation" to approved. The back pay came in separate deposits over about 4 days, one for each week I was owed. Total of 6 weeks in my case. One thing to watch out for - make sure you check that all your weeks are actually marked as payable in the system. I had one week that got stuck in limbo and had to call to get it resolved. The waiting is nerve-wracking but hang in there, the money should come through soon!

•This is really helpful to know the timeline! 12 business days sounds reasonable compared to some of the horror stories I've heard. Did you have to do anything special to make sure all your weeks were marked as payable, or did you just notice one was missing when you checked your payment history?

I went through the appeal process about a year ago for a wrongful termination case. After winning, it took about 10 business days for the status to update and then another 3-4 days for the actual payments to start hitting my account. Like others mentioned, they came as separate deposits - one for each week I was denied. The total process from hearing decision to having all my back pay was about 3 weeks. One tip: screenshot your payment history page regularly so you can track if any weeks get missed. I had to call once because a holiday week got skipped somehow. Also keep all your appeal paperwork handy in case you need to reference it when calling DOL. Congrats on your win - the waiting is stressful but you should see your money soon!

•Really appreciate the detailed timeline and practical tips! Taking screenshots of the payment history is smart - I wouldn't have thought of that but it makes total sense given how glitchy these government systems can be. The 3-week total timeframe from decision to full payment gives me a realistic expectation. I'll definitely keep my appeal documents organized in case I need to reference them when calling. Thanks for sharing your experience!

I'm currently going through a similar appeal process for constructive dismissal and this thread has been incredibly helpful! It sounds like the typical timeline is 10-15 business days for status change plus another few days for payments to start coming through. @Sean O'Donnell - did you have to provide specific documentation during your hearing to prove the constructive dismissal? I'm trying to gather everything I need before my hearing next week. The fact that you were able to successfully represent yourself gives me confidence that I can too. Fingers crossed my case goes as smoothly as yours!

•@Sadie Benitez Good luck with your hearing next week! For my constructive dismissal case, I gathered emails showing unreasonable work conditions, documentation of policy changes that made my job impossible, and witness statements from coworkers who could verify the hostile environment. The key was showing a clear pattern that any reasonable person would have felt forced to quit. I also brought evidence that I tried to address the issues internally before leaving. The hearing officer really focused on whether I had exhausted all reasonable alternatives before quitting. Make sure you can clearly explain why staying wasn t'a viable option. You ve'got this!

I'm dealing with a similar situation right now - won my appeal for constructive dismissal two weeks ago and still waiting for the back pay to come through. My status just changed yesterday from "appeal decision pending implementation" to "approved" so hopefully the payments start soon. It's frustrating how long this process takes when you're already struggling financially from being denied benefits you were rightfully owed. Thanks for sharing your experience and congrats on your win! Did you have to keep certifying for benefits during the appeal process or did you stop until the decision came through?

•@Fatima Al-Sayed Congrats on getting your status changed to approved - that s'a great sign! You should definitely see payments start within the next few days. I kept certifying the whole time during my appeal process, even though the claims showed $0. The DOL representatives specifically told me to keep doing this so all my weeks would be captured for back pay once the appeal was resolved. It s'definitely frustrating how long everything takes, especially when you re'already dealing with financial stress from the original denial. Hopefully your payments start flowing soon now that you re'approved!

I went through almost the exact same situation last year - constructive dismissal appeal that I won after being initially denied for "voluntary quit." From my experience, once your status changes from "appeal decision pending implementation" to approved, the back pay usually starts hitting your account within 3-5 business days. In my case, I received separate deposits for each week I was owed (mine was 7 weeks total), and they came over about a week period. The whole process from hearing decision to receiving all back pay took about 18 business days total. Keep filing your weekly certifications even if they show $0 - this ensures all your weeks get processed for back pay. If it goes beyond 20 business days total, definitely call to follow up. The waiting is stressful when you really need the money, but it should come through soon. Hang in there!

•@Isabella Ferreira Thank you so much for sharing your timeline! It s'really reassuring to hear from someone who went through the exact same situation. 18 business days total from hearing to full payment seems pretty consistent with what others have shared. I m'at day 8 since my hearing decision, so hopefully I m'getting close to seeing that status change. The separate deposits over a week period makes sense - I was wondering if it would all come at once or be spread out. Really appreciate you mentioning to keep filing weekly certifications at $0, I ve'been doing that but wasn t'100% sure it was the right thing to do. The waiting is definitely stressful when you re'counting on this money, but hearing these success stories helps keep me optimistic!

I went through this same process about 8 months ago - also won an appeal for constructive dismissal after being denied for voluntary quit. From my experience, once you win the appeal, the implementation phase typically takes 10-14 business days. You'll know things are moving when your status changes from "appeal decision pending implementation" to "approved." After that status change, expect your back pay to start hitting your account within 2-4 business days. The payments usually come as separate deposits for each week you're owed - so for your 8 weeks, you'll likely see 8 different deposits over the course of about a week. Keep filing your weekly claims even though they show $0 - this is crucial for getting all your back pay processed correctly. If it goes beyond 15 business days since your hearing decision without a status change, definitely call to follow up. The whole process from hearing decision to receiving all back pay typically takes 3-4 weeks total. I know the waiting is brutal when you really need the money, but your appeal win is the hard part - the payment should follow soon. Congrats on your victory!

•@Abby Marshall This is exactly the kind of detailed timeline I was hoping to see! The 3-4 week total timeframe from hearing decision to full back pay seems to be the consistent experience across everyone who s'shared. I m'particularly glad you mentioned the separate deposits - knowing to expect 8 different payments over about a week helps set realistic expectations. I ve'been diligently filing my weekly claims at $0 this whole time, so it sounds like I m'doing everything right on that front. The 10-14 business day window for status change gives me a good benchmark to watch for. Really appreciate you taking the time to share such specific details - it definitely helps ease the anxiety of waiting when you know roughly what timeline to expect. Thanks for the congratulations too!

I just went through this exact situation about 3 months ago - won my constructive dismissal appeal after being initially denied for voluntary quit. The timeline was almost exactly what others have described: 11 business days for my status to change from "appeal decision pending implementation" to "approved," then the back pay started coming in about 3 days later. I was owed 9 weeks and received 9 separate deposits over about 6 days. One thing I'd add that hasn't been mentioned much - make sure you have direct deposit set up if you don't already. Paper checks would have added another week or two to the process. Also, when the payments do start coming, they might not be in chronological order - mine came somewhat randomly but all 9 weeks eventually showed up. The total process from hearing decision to receiving my last back pay deposit was about 3.5 weeks. Keep doing those weekly certifications at $0 and hang in there - you're almost at the finish line!

•@Beatrice Marshall That s'a great point about direct deposit - I hadn t'even thought about how much longer paper checks would take! I do have direct deposit set up so that should help speed things along. It s'interesting that the payments came in random order rather than chronologically - good to know so I don t'panic if they seem out of sequence. 3.5 weeks total timeline is right in line with what everyone else has shared, which gives me confidence I m'on the right track. I m'at about day 9 since my hearing decision, so hopefully I ll'see that status change soon. Really appreciate everyone sharing their experiences - it s'made this waiting period so much less stressful knowing what to expect!

I went through this exact same process about 4 months ago - also won a constructive dismissal appeal after initially being denied for voluntary quit. The timeline was very similar to what others have shared: took about 13 business days for my status to change from "appeal decision pending implementation" to "approved," then back pay started hitting my account 2 days later. I was owed 6 weeks and got 6 separate deposits over about 5 days - they didn't come in order which was confusing at first but they all eventually showed up. Total time from hearing decision to receiving all back pay was just over 3 weeks. Keep filing those weekly claims at $0 like you've been doing - that's crucial! One tip: check your online account daily once you hit the 10-day mark after your hearing. The status change happens pretty suddenly and then things move quickly after that. The waiting is nerve-wracking when you need the money, but you've already won the hardest part. Your back pay should start flowing soon - congrats on your appeal victory!

•@Sofia Martinez Thanks for sharing another consistent timeline! It s'really reassuring to see that pretty much everyone is experiencing the same 10-15 business day window for status change followed by payments within a few days after that. Your tip about checking the online account daily after the 10-day mark is super helpful - I ll'definitely start doing that religiously. It sounds like once that status flips to approved "things" happen pretty fast. The random order of payments seems to be the norm based on what you and others have shared, so I won t'worry if they don t'come chronologically. Really appreciate you taking the time to share your experience - this whole thread has been incredibly valuable for setting realistic expectations during this stressful waiting period!

I'm currently waiting for my appeal decision after a hearing two weeks ago for a similar constructive dismissal case. This thread has been incredibly helpful in understanding what to expect once I hopefully win. The consistent timeline everyone is sharing (10-15 business days for status change, then payments within a few days) gives me realistic expectations. One question - did anyone have issues with their employer trying to contest the appeal decision after losing? My former employer seemed pretty upset during the hearing and I'm worried they might try to drag this out further somehow. Also wondering if there's any notification when your status changes or if you just have to keep checking the website daily like Sofia mentioned?

•@Anita George In my experience, once the hearing officer makes their decision, that s'pretty much final for the initial appeal level. Your employer can t'really contest it at that point - they would have to file their own higher-level appeal to the Board of Review, which is expensive and time-consuming for them. Most employers don t'bother unless it s'a really significant case. As for notifications, I didn t'get any email or text alerts when my status changed - I just had to keep checking the website daily. I set a phone reminder to check every morning around 9am once I hit the 10-day mark. The status change happened overnight on a Tuesday for me, so definitely check regularly. Good luck with your decision - sounds like you re'in a similar boat to all of us and should hopefully see a positive outcome soon!

I just won my constructive dismissal appeal last week and this thread has been so helpful! I'm on day 6 since the hearing decision and my status still shows "appeal decision pending implementation." Based on everyone's experiences here, it sounds like I should expect the status change sometime in the next week or so, then payments shortly after. I was initially denied for "voluntary quit" but had solid documentation showing my employer created impossible working conditions that forced me to leave. The hearing went well and I represented myself successfully. I'm owed 5 weeks of back pay and really need this money to catch up on bills. It's reassuring to see so many people with similar cases who eventually got their full back pay. The waiting is definitely stressful but knowing the typical 3-4 week total timeline helps manage expectations. Thanks to everyone who shared their experiences - it makes this process much less scary when you know what to expect!

•@Chloe Taylor Congratulations on winning your appeal! You re'right on track with the timeline - day 6 is still well within the normal range. Based on everyone s'shared experiences here, you ll'likely see that status change sometime between days 10-15, so you ve'got a bit more waiting ahead but you re'definitely getting close. It sounds like you had strong documentation for your constructive dismissal case, which is exactly what these hearing officers need to see. The fact that you successfully represented yourself is really impressive too! Five weeks of back pay will definitely help you catch up on those bills. I d'recommend starting to check your online account daily once you hit day 10, just like others have suggested. The waiting is tough when you re'dealing with financial stress, but you ve'already cleared the biggest hurdle by winning the appeal. Your money should start flowing within the next couple weeks!
