How long for unemployment appeal decision - NYS Department of Labor taking forever?
Filed my unemployment appeal with NYS Department of Labor back in early December after getting denied for 'voluntary quit' even though I was actually laid off due to company downsizing. Had my phone hearing January 8th and the judge seemed to understand my situation - my former employer barely participated and couldn't provide documentation. It's been almost 3 weeks since the hearing and still no decision posted on my.ny.gov. My savings are completely gone and I'm behind on rent. Does anyone know how long these appeal decisions usually take? Getting really desperate here.

Appeal decisions from administrative law judges typically take 2-4 weeks after the hearing date. Since you had your hearing on January 8th, you should receive the written decision within the next week or so. The decision will be mailed to you and also posted in your my.ny.gov account. If you win the appeal, you'll receive back payment for all the weeks you were denied.

mine took 6 weeks last year but that was during the summer when they were super backed up. your hearing went well so thats a good sign. the employer not showing up with documents usually works in your favor

I waited 8 weeks for my appeal decision and then it got overturned anyway! The whole system is broken. You can try calling NYS Department of Labor but good luck getting through to anyone who can actually help. I must have called 200 times before giving up.

Wait are you still filing your weekly claims during the appeal? Because if you win you'll get back paid for all those weeks but only if you kept filing. A lot of people don't realize this and lose out on benefits.

Three weeks isn't that bad honestly. My cousin waited 2 months for his decision last spring. The judges are overwhelmed with cases right now.

I went through a similar situation last year and the waiting is absolutely brutal. Three weeks is actually pretty normal timing - mine took about 4 weeks after the hearing. The fact that your employer barely participated and couldn't provide documentation is definitely a good sign for your case. In the meantime, have you looked into emergency rental assistance programs? Many counties in NY have programs that can help with rent while you're waiting for the appeal decision. Also make sure you're applying for food assistance if you haven't already - you can do it online through myBenefits.ny.gov. Hang in there!
