What happens after unemployment appeal hearing with NYS Department of Labor?

I had my unemployment appeal hearing last Tuesday morning via phone with the administrative law judge. The whole thing lasted about 45 minutes and my former employer participated too. The judge said she would review all the evidence and testimony before making a decision. It's been 6 days now and I haven't heard anything back from NYS Department of Labor. How long does it usually take to get the written decision after the hearing? Will they email it to me or send it by mail? I'm really anxious because I've been without benefits for over a month while this appeal was pending.

The administrative law judge typically has 30 days to issue a written decision after your hearing, though many come back within 10-14 business days. NYS Department of Labor will mail the decision to your address on file and also post it to your online account. You should receive both the full written decision and a summary of the ruling. If you win the appeal, they'll release any back benefits owed to you within 7-10 business days of the decision.

Thank you! Should I keep filing my weekly claims while waiting for the decision even though I'm currently disqualified?

mine took exactly 2 weeks to get the decision after my hearing last year. won my case and got like $4800 in back pay. definitely keep filing weekly claims or you'll lose those weeks even if you win

That's encouraging to hear! I've been filing weekly even though it keeps saying $0. Glad it worked out for you.

If you're having trouble getting through to check on your appeal status, I had success using claimyr.com to get connected directly to a NYS Department of Labor agent. They can tell you if your decision has been issued yet. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped me avoid the busy signal nightmare.

How much does that service cost? I've been calling the regular number for days and can't get through.

The site has their pricing info but honestly it was worth it for me to avoid spending hours on hold. Got through in like 20 minutes.

THE WHOLE APPEAL PROCESS IS A JOKE!!! Had my hearing 3 weeks ago and still waiting. They drag their feet on purpose hoping you'll give up. Keep calling and demanding updates because they won't prioritize your case otherwise.

I understand the frustration but 3 weeks isn't unusual. The judges do have a legal timeframe they have to follow.

Just curious what was your hearing about? I have one coming up next month for attendance issues and I'm nervous about what to expect

Mine was for misconduct - my employer claimed I violated company policy but I had documentation showing I followed proper procedures. My advice is to gather all your evidence beforehand (emails, attendance records, company handbook policies, etc.) and be prepared to explain your side clearly. The judge will ask both you and your employer questions. Don't be too nervous - the judge was actually pretty fair and let me present everything I needed to. Good luck with yours!
