How long after NY unemployment hearing will judge send decision?

I had my hearing with a judge last Friday for my NY unemployment appeal. I was let go back in August and my employer claimed misconduct, which I totally disagree with. I had pretty solid evidence showing I was following company guidelines and had positive performance reviews right up until they restructured my department. The hearing lasted about 45 minutes and I thought it went well, but now I'm just anxiously waiting. Has anyone gone through this process recently? How long should I expect to wait before getting the judge's decision? I'm down to my last few hundred dollars and really need this resolved soon.

I had my hearing in december and got my decision in the mail 3 weeks later. The judge ruled in my favor thankfully. Make sure ur checking ur mail everyday cuz they only send paper notices for this stuff. I think they say it can take up to 6 weeks but mine came faster. Good luck!

Thanks for the info! Did they also send you any kind of email notification or was it just the mail?

Just mail. Kinda annoying they dont use email for something so important but thats ny unemployment for ya 🙄

Mine took exactly 4 weeks to arrive. No email, just snail mail like we're living in 1995 or something.

After getting nowhere with the unemployment office for weeks, I tried this service called Claimyr (claimyr.com) and they got me connected with a live rep who helped me track down my appeal status. Turns out my decision had actually been made but never mailed to me correctly. Talking to an agent got my $ unlocked so fast. They also have this helpful video if you want more info: https://youtu.be/Rdqa1gKtxuE

wait hold up - does this actually work or is it just the usual BS? I've called like 50 times and can't get through to anyone.

It definitely works! I was super skeptical too but I was desperate. They basically call repeatedly for you and then connect you when they get a human. Saved me literally days of being on hold.

hmm I've been burned by so many of these 'services' before... what makes this different? 🤔

The difference is it actually connected me to a real person at unemployment. I was able to get my appeal status and fix the issue with my address that was causing the delay. Was totally worth it for me.

another day, another company promising to fix the unfixable unemployment system lol

Listen I get the skepticism. I felt the same way. But after 3 weeks of trying to call myself with no luck, this actually worked. Just sharing what helped me 🤷‍♀️

From my experience and what ive heard from others, 3-6 weeks is typical. My friend just went thru this in october and it took about a month. But the system is so backed up right now who knows

my desision took 8 weeks to come (this was in feb/march) and i had to call multiple times to follow up. The judges are WAY behind schedule because of all the appeals. if u need $$ fast u should look into emergency assistance programs while u wait.

0 coins

Thanks for being honest. 8 weeks sounds brutal. Did you end up winning your appeal at least?

0 coins

yep i won. the wait was worth it but it was stressful af. ended up having to borrow money from family which sucked.

It really depends on how complex your case is and how busy your particular judge is. Some areas of NY have fewer judges handling more cases. I've seen people get decisions in 2 weeks and others wait 2+ months. The law says they're supposed to issue a decision within 30 days, but that's more of a guideline than a rule they actually follow 😒

0 coins

Yup, the "30 day rule" is a complete joke. I waited 74 days for mine last year. The system is completely broken.

My friend got hers in 10 days! But I think thats super rare. Probably depends on the judge.

Here's what I learned from my own unemployment appeal process (which took forever): First, the timeframe varies wildly. In theory, ALJs are supposed to issue decisions within 30 days of the hearing, but with the current backlog, 4-8 weeks is more realistic. My decision took 5 weeks. Second, calling regularly helps. The regular phone lines are useless, but I had success using claimyr.com to get through to a live agent who could check on my status. Without that I'd probably still be waiting. Third, check your mail EVERY day. They only send paper notices for appeal decisions. Fourth, if it's been more than 6 weeks, contact your state representative's office. They can sometimes light a fire under the department. Fifth, prepare for either outcome. If you win, it could still take 1-2 weeks for payments to start. If you lose, you'll have 20 days to appeal to the next level. The whole system is frustrating, but hang in there! And definitely try to get to a live agent to check on your status - it made all the difference for me.

This is incredibly helpful, thank you for taking the time to write all this out. I'll definitely check out that service if I don't hear anything in the next couple weeks.

I second contacting your state rep if it drags on! My rep's office got my decision unstuck after 7 weeks of nothing.

Did the claimyr thing actually work? Seems sketchy.

0 coins

Yeah, it worked for me. I was skeptical too but I was desperate after weeks of trying to call myself. It basically just keeps calling for you until it gets through, then connects you to the agent. Saved me hours of hold time.

Don't hold your breath. I'm still waiting on mine from NOVEMBER 😡 The whole ny unemployment system is a complete joke

0 coins

November?? That's insane! Have you tried contacting them about it?

0 coins

I've called at least 20 times. Either can't get through or get someone who has no idea and just tells me to "keep waiting" 🤬

0 coins

You need to contact your state assembly person. That's way too long to wait.

0 coins

One thing nobody has mentioned - check your online account too. Sometimes the decision appears there before you get the mail.

The wait is different for everyone tbh. Mine took 37 days exactly (yes i counted every single day lol). The judge ruled that my company was wrong to deny me benefits. Waiting was the worst part but it was worth it in the end when i got that backpay. hope u get good news soon!

0 coins

37 days sounds rough but at least you won! Did you get paid pretty quickly after the decision?

0 coins

Got my first payment 5 days after the decision letter and backpay hit about a week after that. Once they decide in your favor things move pretty fast.

I won my appeal in september, it took exactly 4 weeks and 3 days to get the decision in the mail. Be prepared to wait but also dont lose hope! From what i've seen, judges tend to side with the workers more often than employers in these cases. The system is defiantly designed to be frustrating but hang in there

Based on everyone's experiences here, it sounds like 3-6 weeks is pretty typical, though some people have waited much longer. I just went through this process myself last month and got my decision after exactly 28 days. The waiting is absolutely the worst part - I was checking my mailbox twice a day! A few things that helped me stay sane during the wait: I set up a simple calendar to track the days, kept all my documentation organized in case I needed to appeal further, and tried to stay busy with job applications. Also definitely keep checking your online account regularly - sometimes the status updates there before the mail arrives. Your case sounds solid with the performance reviews and evidence of following guidelines. Try not to stress too much about the outcome (easier said than done, I know). The fact that your hearing went well is a good sign. Hang in there!

This is really reassuring to hear from someone who just went through it! 28 days doesn't sound too bad. I like your idea about setting up a calendar to track - might help me feel more in control of the situation. Did you end up winning your case?

I'm going through the exact same thing right now! Had my hearing last Tuesday and the waiting is killing me. My employer also claimed misconduct but I have emails showing I was following all their procedures. The judge seemed to really listen to my side of things and asked good questions about their documentation (which was pretty weak tbh). From reading everyone's responses here, it sounds like 4-6 weeks is realistic even though they say 30 days. I'm trying to stay positive but it's hard when you're running low on money. At least we're not alone in this - the system really does seem broken when people are waiting months for basic decisions. Fingers crossed we both get good news soon! 🤞

Hey Sofia! It's so comforting to know someone else is going through this exact situation right now. The timing is almost identical too - sounds like we both had our hearings around the same time. The waiting really is the hardest part, especially when money is tight. I keep reminding myself that if the judge was asking good questions about their weak documentation, that's probably a positive sign. Based on what everyone here is saying, it sounds like we should hopefully hear something in the next few weeks. Let's keep each other posted on how it goes! 🤞

I'm in a similar boat - had my hearing two weeks ago and the anxiety is real! My employer tried to claim I was "insubordinate" but I had documented everything showing I was just questioning unsafe practices (which is literally my right). The judge seemed really interested in my documentation and kept asking my employer for specific examples they couldn't provide. Reading through everyone's experiences here is both helpful and terrifying - the range from 2 weeks to 8+ weeks is wild! I've been checking my mailbox obsessively and refreshing my online account multiple times a day. The worst part is not knowing if no news is good news or if something got lost in the system. For what it's worth, your case sounds strong with the performance reviews and evidence of following guidelines. Department restructuring layoffs disguised as "misconduct" seems to be a common tactic employers use. Hopefully we'll both get good news soon and can finally breathe again!

Giovanni, your case sounds really strong too! Questioning unsafe practices is absolutely your right and the fact that your employer couldn't provide specific examples when the judge asked is a huge red flag for their case. I'm dealing with the same obsessive mailbox checking - it's driving me crazy! 😅 You're totally right about the restructuring/misconduct thing being a common employer tactic. It seems like they think they can just slap a "misconduct" label on layoffs and avoid paying unemployment. From what I'm reading here, judges seem to see right through that nonsense most of the time. The waiting is brutal but at least we're all in this together. Hoping we all get our good news soon! 🙏
