How long after appeal decision unemployment benefits start again - NYS Department of Labor timing?
My unemployment appeal hearing was last Tuesday and the judge ruled in my favor, reversing the NYS Department of Labor's disqualification decision. The hearing officer said my termination wasn't misconduct and I should receive benefits. It's been 8 days now and I still don't see any payments in my account or changes to my claim status online. Does anyone know how long after appeal decision unemployment payments typically resume? I have bills piling up and really need to know what to expect for timing.

Congratulations on winning your appeal! From my experience, it usually takes 1-2 weeks for NYS Department of Labor to process a favorable appeal decision and update your claim. They have to manually adjust your account and calculate any back pay owed. Keep filing your weekly claims during this time - those weeks will get paid retroactively once everything processes.

•Thank you! I've been continuing to file weekly but wasn't sure if I should. Good to know about the back pay calculation - I'm owed about 6 weeks since the disqualification.

took them almost 3 weeks to pay me after my appeal decision last year. they said the delay was because they had to recalculate everything and remove the disqualification from my record. super frustrating but the back pay did come through eventually

•Three weeks seems really long! Did you have to do anything special to follow up or did it just happen automatically?

The timing depends on several factors after your appeal decision. NYS Department of Labor has to remove the disqualification code from your account, recalculate your benefit amount if needed, and process any overpayment offsets. If you had other issues on your claim besides the misconduct disqualification, those might cause additional delays. Check your online account daily - when it processes, you'll see your claim status change from disqualified to active.

•My claim just shows the original disqualification still. Should I be worried that nothing has changed yet after 8 days?

•Not necessarily. The system updates can be slow, especially if they're processing a lot of appeals. If it goes past 2 weeks, then I'd start making calls to follow up.

OMG this is exactly what I'm going through! My appeal decision was 2 weeks ago and STILL nothing. I'm so stressed about money I can barely sleep. How is this legal that they can take so long after we already proved they were wrong??

•I understand the stress, but unfortunately NYS Department of Labor appeals processing just takes time. The good news is you'll get all the back pay you're owed once it goes through. Hang in there!

If you're having trouble getting through to NYS Department of Labor by phone to check on your appeal processing status, I had good luck using Claimyr recently. It's a service that helps you actually reach an agent - you can check it out at claimyr.com. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. I was able to get through and get an update on my claim timing after weeks of busy signals.

•Never heard of that before. Is it legit? I'm desperate to talk to someone about when my payments will start.

•Yeah it's legitimate. I was skeptical too but it actually worked. Just helps you get past the busy phone lines to reach a real person at NYS Department of Labor.

Won my appeal in October and got paid the following week. Guess I got lucky with the timing. The back pay was nice though - got like $4800 all at once for the weeks I missed.

•Wow, one week is really fast! What was your appeal about if you don't mind me asking?

•Mine was also a misconduct disqualification that got overturned. Maybe they processed yours faster because it was October and they weren't as backed up? I'm hoping mine doesn't take the full 3 weeks like some people are experiencing.

I'm going through the exact same situation right now! Had my appeal hearing 10 days ago and won, but my online account still shows the disqualification. It's so frustrating when you're already stressed about money and then have to wait even longer after proving they made a mistake. I've been trying to call but can never get through - just endless busy signals. Really hoping it doesn't take the full 3 weeks some people are mentioning here. The uncertainty is almost worse than the original denial!

•I totally feel your frustration! The waiting after winning an appeal is almost cruel when you're already financially stressed. I'm at 8 days myself and checking my account obsessively. From what others are saying here, it seems like anywhere from 1-3 weeks is normal, which is a huge range when you're broke. Have you tried that Claimyr service someone mentioned? I'm thinking about giving it a shot since the regular phone lines are impossible.

I'm in a similar boat - won my appeal 12 days ago and still waiting for payments to resume. From what I'm seeing in this thread, it really seems to vary wildly from 1 week to 3+ weeks depending on how backed up they are and how complex your case is. The most frustrating part is having no way to get a real timeline from NYS Department of Labor since their phone system is basically unusable. I've been continuing to file my weekly claims like others suggested, and I'm trying to be patient, but when you're behind on rent it's really hard not to panic. At least we know the back pay will eventually come through - that's something to look forward to!

•I'm also waiting after winning my appeal - it's been 6 days for me. Reading everyone's experiences here is both helpful and nerve-wracking! The range from 1 week to 3+ weeks is so unpredictable. I'm in the same situation with rent coming due and just trying to stay positive that the back pay will make up for this stressful waiting period. It's reassuring to know I'm not alone in this frustrating limbo between winning the appeal and actually seeing the money. Keeping my fingers crossed we all get our payments soon!

I went through this exact same situation last year and I know how stressful the waiting is! In my case, it took about 10 days after my successful appeal for the payments to start flowing again. What I learned is that NYS Department of Labor has to do several things behind the scenes - remove the disqualification flag, recalculate your weekly benefit amount, and process all the back weeks you're owed. The system update happens all at once, so one day you'll check and suddenly see weeks worth of payments deposited. Keep filing your weekly claims during this time because those will all get paid retroactively. I know it's hard when bills are piling up, but try to hang in there - the back pay when it comes will help catch you up. You've already done the hard part by winning your appeal!

•Thank you for sharing your experience and timeline! It's really helpful to hear from someone who went through the exact same thing. 10 days gives me hope since I'm at 8 days now. I've been continuing to file weekly like you and others suggested, so that's reassuring to know those will get paid back. The idea that it all updates at once actually makes me feel better - I was worried something was broken since my account still shows the old disqualification status. Really appreciate the encouragement about hanging in there!
