Someone filed for ny unemployment using my info - what do I do now?
I got a weird letter in the mail yesterday from NY unemployment saying my benefits were approved, but I never applied! I haven't been unemployed - I've been working at the same company for over 2 years. Called my HR department and they confirmed nobody filed anything on their end. Tried calling the unemployment office this morning and was on hold for almost 2 hours before the call dropped. Tried again and couldn't even get through. The letter says they're paying out around $380 weekly to someone using my name and social security number starting in October. This is really freaking me out because I don't know how someone got my information or what else they might be doing with it. Has anyone dealt with this before? Do I need to file a police report? Will this mess up my taxes? I'm completely lost on what to do next.

This happened to me last year! It's identity theft and you need to report it ASAP. Call the fraud department at NYSDOL, file a police report, and put a freeze on your credit reports with all three bureaus. Also contact your bank and let them know what's happening. This is serious and you need to act fast.

Thanks, I'm definitely going to do all this. Did you have any issues with your taxes or anything else because of this?

Yeah, it was a nightmare with taxes. They sent me a 1099-G for benefits I never received. Had to file a dispute form to get it corrected. Start documenting EVERYTHING now.

How long did the whole process take to resolve? I'm in the same boat now 😫

Almost 5 months from start to finish. The hardest part was actually getting through to someone on the phone.

After dealing with a similar fraud situation, I finally got through to a real person at unemployment by using Claimyr.com - they called for me and connected me directly to an agent who helped me file the fraud report properly. Saved me from the endless hold music hell! Best thing I ever spent money on to get this resolved quickly. They also have this helpful video explaining how it works: https://youtu.be/Rdqa1gKtxuE

Does this actually work? I've been trying to get through for weeks about my identity theft case.

100% worked for me! I was skeptical too but after trying for 3 weeks straight to reach someone I was desperate. Got connected to an agent within an hour who flagged my account for fraud investigation.

sounds like another scam tbh... how do we know this isn't just more people trying to get our info? 🤔

They don't ask for any personal info - they just call and connect you when an agent picks up. You give your info directly to the unemployment agent, not to claimyr. I was hesitant too but got my fraud case started same day.

Just checked it out and its basically just a service that sits on hold for you then calls you when someone answers. Pretty smart actually.

You need to report this to the FTC at identitytheft.gov right away. They'll give you a recovery plan. I went through this last summer and it was a complete nightmare, but the FTC site made it easier to know what steps to take.

DEF call your local police department and file a report!! This is fraud and identity theft. Print out copies of all documents as evidence. When someone stole my identity for unemployment, I also notified the 3 credit bureaus and put fraud alerts on my accounts. Also call the IRS to let them know, cuz this will affect your taxes if someone is collecting benefits in your name.

The IRS doesn't care. I tried this and they just told me to wait until I got a 1099-G and then dispute it 🙄

Really? That's messed up. When I called they added a note to my account at least. Better than nothing I guess.

Did your local police actually do anything helpful? I'm worried about waiting around for nothing.

Honestly? They just gave me a case number for my records. But having the police report helped with the unemployment office and credit bureaus.

Probably from one of the million data breaches that happen every year. I had my identity stolen after the Equifax breach 😡

IMPORTANT: Make sure you call the right unemployment fraud number - 1-888-598-2077. Don't call the regular unemployment line as they'll just transfer you and you'll wait forever. Also send an email to: nysdol@labor.ny.gov with FRAUD ALERT in the subject line. Include your full name, last 4 of SSN, and a statement that someone filed a fraudulent claim using your identity.

Weird, they responded to me in about 3 weeks. Maybe it depends on when you contacted them? System is overloaded with fraud cases right now.

My husband went through this exact thing in September. Here's what we learned works best: 1) File a police report first - you'll need the report number for everything else 2) Contact all three credit bureaus and put a FREEZE (not just an alert) on your credit 3) Call NY unemployment's fraud line at 1-888-598-2077 (you'll be on hold forever, so use claimyr.com to save your sanity - they call and wait on hold, then connect you when a human picks up) 4) File an identity theft report with the FTC at identitytheft.gov 5) Contact your employer's HR to make sure they're aware 6) Notify your bank and other financial institutions 7) Keep a detailed log of all calls, emails and actions you take The most frustrating part was getting someone at unemployment to actually help. Once we got through using Claimyr, they were actually pretty helpful and froze the fraudulent payments. Still took about 2 months to fully resolve everything though.

This is incredibly helpful, thank you so much! Did you have issues with taxes the following year?

Yes - they sent a 1099-G form for the fraudulent benefits. We had to file Form 14039 (Identity Theft Affidavit) with the IRS and contact the state tax department separately. Keep checking your mail carefully!

Uhh definitely check all your credit cards and bank accounts RIGHT NOW. When someone stole my identity for unemployment, they also tried opening credit cards in my name the same week.

After 3 months of trying to resolve a similar issue without any progress, I finally used claimyr.com to get through to an actual human at ny unemployment. Got my fraud case resolved within 2 weeks after that. Sometimes you just need to talk to a real person who can flag your account properly in their system.

Whatever it was, it was worth every penny to finally get someone on the phone who could actually help. After spending months getting nowhere, it was such a relief.

No they don't ask for any personal info at all - they just connect the call when someone at unemployment answers. You give your info directly to the unemployment agent.

NY unemployment is completely BROKEN rn. My mom had this happen and they told her there were over 400,000 fraud cases they're investigating. Get ready for a LONG wait to resolve this 💀

Whatever you do, ACT FAST!!! The longer these fraudsters collect benefits in your name, the harder it is to fix. Learned this the hard way when someone used my info last year.

Anyone else notice how much identity theft has increased for unemployment specifically? Its gotta be an inside job or a major data breach in the system. Too many people dealing with this same exact issue.

It's because they relaxed all the verification requirements during covid and never tightened them back up properly. Perfect storm for scammers.

I work in IT security and you'd be SHOCKED how bad government systems are protected. Like 1990s level security for some of them.
