NY unemployment tax refund seems way off - should my spouse have gotten more?

So my spouse finally got their unemployment tax refund from that tax break they announced back in June, but the amount seems seriously off. They were on unemployment for almost 8 months during 2022 after getting laid off from their construction job. The refund we got was only $287, which seems ridiculously low considering how much tax was withheld originally (around $2,100). From everything I've read online, people in similar situations are getting much more back. We're in the 22% tax bracket, so I was expecting at least $1,000 or more. Has anyone else had this issue? Is there someone specific we can contact to question this? The IRS website is completely unhelpful and you can never get through on the phone. I'm wondering if ny unemployment reported something wrong to the IRS or if they made some kind of calculation error. We really need that money right now with rent going up again.

I had the same problem! My refund was only $342 when I should have gotten at least $1,200 based on what was withheld. I tried calling the IRS but gave up after being on hold for 2 hours. Their website is basically useless for this specific issue too. From what I understand, you need to file an amended return (Form 1040-X) to dispute it, but its such a headache.

Ugh that's what I was afraid of. Did you end up filing the amended return? Was it complicated?

I started to but it's actually pretty complex if you don't know exactly what you're doing. I'm probably gonna hire someone to help me with it cuz I dont wanna mess it up and make things worse 😩

dont bother with amended return yet. call the NY tax dept directly first. Sometimes the issue is on their end with how they reported your unemployment income. save yourself the hassle if possible

After 3 weeks of trying to reach someone at the IRS about my refund issue, I finally got through using claimyr.com - it's this service that waits on hold for you and calls when an agent picks up. Talking to a live person got my refund situation fixed in 20 minutes! Saved me from filing an amended return and waiting another 6 months. Check out this video about how it works: https://youtu.be/Rdqa1gKtxuE

is this for real? seems too good to be true with all these government agencies impossible to reach

Yeah it actually works! I was skeptical too but was desperate after trying for weeks. The service calls and stays on hold, then rings your phone when a human picks up. Talking to an actual agent was what I needed to fix the refund issue.

I used it last month to reach NY unemployment after 2 weeks of failed attempts. Got a callback with an agent in about 2 hours. Best money I've spent considering how much back pay I was owed. claimyr.com

They have a bunch of different government agencies you can call, including both IRS and unemployment offices. You just pick which one you need when you sign up.

To be honest, the whole unemployment tax refund system has been a mess from the start. My sister got almost $1,800 back but I only got $420 despite us having almost identical situations. I think they're just processing these inconsistently. You should definitely challenge it.

I work as a tax preparer, and I've seen a lot of issues with the unemployment tax break refunds. Here's what could be happening: 1. The IRS might be calculating based on incorrect information from NYSDOL 2. They might not be accounting for all unemployment payments your spouse received 3. Your overall tax situation might have other factors affecting the refund amount 4. There could be offsets for other debts that reduced the refund 5. They might have calculated using a lower tax bracket than what applies to you Your best options are: - Call the IRS directly (though getting through is nearly impossible) - Use a service like claimyr.com to get you through to an agent without the wait - Consult with a tax professional who can review your specific situation - File an amended return if you're certain the amount is wrong Don't just accept the lower amount if you think it's incorrect. The difference could be significant depending on your tax situation.

Thank you for this detailed response! Do you know if there's a deadline for disputing this? We filed our taxes on time but just got this refund last week.

You generally have 3 years from the date you filed your original return to submit an amended return. So if you filed in April 2023 for tax year 2022, you'd have until April 2026. But don't wait - the sooner you address it, the better.

What about offset debts? My friend had his refund reduced because of old student loans. Could that be happening here?

Jacinda Yu

•

Absolutely - that's a common reason for unexpected refund amounts. If there are federal/state debts (student loans, back taxes, child support), they can take from the refund. The IRS should have sent a letter explaining any offsets.

Check if your spouse had any other income during those 8 months. Even small gig work or part time stuff can affect the calculation. We thought ours was wrong too but turns out my hubby's side hustle was the reason.

Nope, literally zero other income during that time. He was applying for jobs everyday but construction was really slow last year in our area.

the whole ny unemployment tax break thing is a JOKE. everyone i know got different amounts that make zero sense. the government is just throwing darts at a board to decide these refunds i swear 🤡

fr fr the system is rigged. my cousin got double what I got even tho we made about the same on unemployment. total BS

Same here! What makes me mad is there's no transparency about how they calculate it. Like show your work, IRS! 🤬

Did you receive a letter from the IRS explaining the adjustment? They should have sent one showing their calculation. If not, that's the first thing you should request when you get hold of someone.

We just got a direct deposit with no explanation. Been checking the mail daily but nothing so far explaining the calculation. Really frustrating!

Cass Green

That's definitely not right. You should have received a letter before or shortly after the deposit. You might want to check your online IRS account if you have one set up - sometimes the letters are available there before they arrive by mail.

My wifes unemployment tax refund was wayyyy off to. They only gave us like $230 when we should have gotten at least $900. I spent WEEKS trying to talk to someone but its impossible to get thru. finally I used this service claimyr.com that got me an actual human on the phone at the IRS. Turns out they had calculated based on the wrong tax year!!! Once I talked to them they fixed it and we got the rest of the money in like 3 weeks.

I literally just went through this exact situation last month! If you filed jointly, the calculation gets more complicated because it's based on your combined income and tax bracket. What worked for me was filing Form 911 (Taxpayer Advocate Service request) - they assigned someone to review my case and I got an additional $743 about 3 weeks later.

Hazel Garcia

•

Oh I've never heard of Form 911! Where do you submit that? And did you need to provide any documentation with it?

Madison Tipne

You can download it from irs.gov and mail it in, or some IRS offices accept it in person. I included copies of our tax return, the unemployment statements, and a letter explaining why I thought the refund was incorrect. The advocate called me within 10 days.

Did your husband opt to have taxes withheld from his unemployment payments? Some people don't realize they have to check that box when they first apply, and if no taxes were withheld originally, there's not much to refund.

Hazel Garcia

•

Yes he definitely had taxes withheld! That's why I'm so confused about the small refund amount.

Try calling right when they open - I got through after only 45 min wait that way. But yeah the whole system is broken af

•

ive tried that! they just put you in a queue and then disconnect after 2 hours saying 'call volume too high' like THANKS FOR NOTHING

•

Seriously try claimyr.com - that's the only way I got through. They call and wait on hold so you don't have to, then connect you when a human answers. Saved me from going insane with the hold music lol

Whatever you do, DON'T call the general IRS number. You need to specifically call the Economic Impact Payment line at 800-919-9835. They handle the unemployment tax adjustments too. Still hard to get through but better than the main line.

Theres a really helpful Facebook group called "Unemployment Tax Refund Issues" with like 30,000 members all dealing with this. Tons of people there with the same problem and they share what worked for them. Some people had to wait 6+ months but eventually got the correct amount after disputing.

Thanks! I'll check that out. Good to know we're not the only ones dealing with this mess.

Did u check ur tax transcripts online? Sometimes they process refunds in batches and you might have another payment coming. My initial unemployment refund was small but then 3 weeks later I got a second larger deposit without any warning.

0 coins

Hazel Garcia

•

I didn't know you could check that online! How do you access tax transcripts?

0 coins

Henry Delgado

•

Go to irs.gov and create an account (if you dont already have one). Then look for "Get Transcript Online" - you can see all your tax records there. Look for codes 846 which means a refund was issued.

Someone in another thread mentioned that the refund could be lower if your spouse received other government benefits besides unemployment. Things like SNAP or Medicaid can affect the calculation in weird ways.

If all else fails, find your local congressperson's office and ask for help with an IRS issue. I was getting nowhere for MONTHS with my unemployment tax refund problem until I contacted my rep. Their office has special channels to resolve these issues and fixed mine in 2 weeks.

This right here is the real pro tip! Congressional caseworkers have direct lines to IRS problem solvers that regular people can't access. They helped me too when I was getting nowhere.

That's actually a great idea I hadn't thought of. Will definitely try this if we can't resolve it through normal channels.

Look at your original tax return and check how much unemployment compensation was reported on line 7 of Schedule 1. Then check if you received the full 10.2% of that amount. If not, definitely challenge it.

Yo I thought they were done issuing these unemployment tax refunds??? I never got mine at all and was on unemployment for half of 2022. Now I'm worried I missed out completely 😳

They're still processing them in batches! My brother just got his last week. Check your tax transcript online to see if there's any pending refund.
