NY unemployment tax refund for $10,200 non-taxable benefit still missing - anyone receive theirs?
Has anyone received their income tax refund for the $11,800 non-taxable unemployment amount yet? I filed before the amount became non-taxable. I'm married filing jointly and thought by September 2025 I would receive the overpaid tax back, but so far nothing. It's been almost 3 months since I heard anything from NY tax department. Starting to worry they forgot about me or something went wrong with my filing. The IRS notice said they would automatically adjust returns but I'm wondering if I need to call someone?

The NY Department of Taxation is still processing these refunds in batches. According to their website, joint filers with combined incomes over $75,000 are in the final processing group. They're estimating completion by mid-October 2025. If you don't receive anything by November 1st, then you should contact them directly. It's frustrating, but they're dealing with millions of adjustments.

I got mine last week! But I'm single filing and my total income was under $60k. My brother who filed jointly with his wife is still waiting too. There was an announcement that they're processing the simpler returns first, then moving to joint filers, especially those with multiple income sources. If you received unemployment from both NY and another state, that might also delay processing.

•Congrats on getting yours! We only received NY unemployment, but we both had it at different times during the year. I guess that might make our return more complex to adjust. Just worried something got lost in their system.

•I feel your frustration! After waiting 2 months with no updates, I tried calling the tax department directly but couldn't get through to anyone - just endless hold music. The agent confirmed my refund was in process but had been flagged for additional review because of my spouse's self-employment income. At least now I know what's happening instead of being in the dark.

I thought this was supposed to be automatic??? My tax guy said we dont need to do anything and they would just send the money. Im confused now do we need to file something extra??

•no you dont need to file anything extra your tax guy is right. the system is just slow AF like everything with unemployment lol. i was told it would take 12-16 weeks for joint filers

The official guidance from NYSDOL states they are processing these in batches based on complexity, not just when you filed. Joint returns with unemployment benefits for both spouses get processed in the later batches. Here's what affects your place in line: 1. Filing status (single processed before joint) 2. Number of W-2s and income sources 3. Whether you had unemployment from multiple states 4. Income level (lower incomes processed first) 5. Whether you amended your return after the law change If you meet several of the "complexity factors," you'll be in the last batch. The final batch is scheduled to complete by October 15, 2025. If you don't receive anything by November 1st, THEN you should contact them for a status update.

I'd recommend checking your tax transcript on the NY Department of Taxation website. It won't tell you exactly when your refund will arrive, but it will show if an adjustment has been calculated. Look for a line item that says "Unemployment Compensation Exclusion Adjustment" or similar. If you see that, it means your return has been processed and the refund should be coming soon.

Anyone else have issues where they got a letter saying their refund was adjusted but the amount seems wrong? I was expecting around $1,200 back but they only sent $780. I'm trying to figure out if I should contest this or if there's something I'm misunderstanding about how they calculate it.

•The refund amount depends on your tax bracket. The $11,800 exclusion doesn't mean you get all taxes paid on that amount back - you get back whatever tax rate you paid on it. So if you were in the 22% federal bracket and 6.5% NY state bracket, you'd get back about 28.5% of the excluded amount, minus any adjustments for credits that might have been affected. It's complicated, which is why so many returns are taking time to process correctly.

•It's not free but honestly worth every penny after I spent hours trying to call myself. They got me a callback within about 45 minutes when I'd been trying for days with no luck. The peace of mind knowing my refund wasn't lost in the system was totally worth it.

UPDATE: I finally got an email from NY Tax Department yesterday saying my return has been adjusted and I should receive the refund within 2-3 weeks! Looks like they're working through the backlog after all. Thanks everyone for your help and advice!
