Has anyone gotten a NY unemployment tax refund for the federal $10,200 exclusion yet?
I've been waiting for months since I heard about the tax exclusion that passed for unemployment benefits. The federal part was processed back in August but I'm still waiting on New York state to process their portion of the refund. I filed my taxes in March 2023 before they announced the exclusion and reported about $12,400 in unemployment income. So I should qualify for the $10,200 tax break, which would mean getting back around $680 from NY state. Anyone else still waiting? Has anyone actually received their state refund yet? The NY unemployment site is useless and calling them is impossible.

Yeah Im still waiting too. Federal came thru like early september but absolutely nothing from NY state. When I try to check the status on their website it just says "in process" but its been saying that for like 3 months now. Frustrating as hell.

Exactly the same for me. "In process" forever. Do you know if there's any timeframe they've announced for getting these out?

After struggling with the NY unemployment refund situation, I finally found a solution that worked. Used this service called Claimyr (claimyr.com) to get through to an actual person at the tax department. Totally worth it - talking to an agent got my $ unlocked so fast after months of nothing happening. Check out this video for how it works: https://youtu.be/Rdqa1gKtxuE

Yeah it actually does! I was super skeptical too but I was desperate after 4 months of waiting. They basically call for you and then connect you when they get a human on the line.

sounds like those ads that pop up everywhere. anyone ACTUALLY try this besides this one person?

I used it last week actually. Got through in about 45 mins when I had been trying for days on my own with no luck. The agent I talked to said they're backed up but was able to check my specific case.

It's not some miracle fix to get your money faster, it just gets you through to an actual person instead of the automated system hell. But talking to someone was the only way I got answers.

I got mine about 2 weeks ago. Filed my taxes in April. Only got about $542 back tho from NY. The federal portion came in July.

ok so I FINALLY got mine yesterday. Filed in February and it took until freaking November to get the state refund. Check ur bank accounts ppl, they're not sending notifications. It just showed up.

Did they send it to same account as your original refund? Or did they mail a check?

Same account as original refund. No notice at all, just appeared in my account as a deposit from NY State Tax.

It said "NYS DTF REFUND" on my bank statement. Amount was less than I expected tho, only got $623 when I thought it would be more like $700.

Honestly I think NY unemployment is the most incompetent agency in the country. 🤡 How hard is it to follow the federal guidlines??? Every other state has finished processing these refunds months ago. I'm starting to think they're just hoping we forget about the money we're owed.

Not to defend them but several other states are just as bad. My brother lives in California and is still waiting on his too.

fair enough but its the principal of it. they take our money instantly but take FOREVER to give any back 💯

Factz. And they charge interest and penalties if WE are late but they can take as long as they want.

For anyone still waiting - I talked to a tax specialist last week (through claimyr.com) who confirmed they're still processing these in batches based on when you filed. If you filed later in the year you're in the last batch. They said by December everyone should have received it. Keep checking your accounts because they don't always send notices. The agent also mentioned that if your NY adjusted gross income was over $150,000, you might not be eligible for the full exclusion. The state implemented a phase-out that reduces the $10,200 exclusion amount as your income increases. If you're still waiting after December, you need to call them directly and have your: - Original tax return info ready - Unemployment income amount - Federal adjusted gross income They can look up your specific case and tell you exactly what's going on. Of course, good luck getting someone on the phone without using a service like Claimyr. Hope this helps someone!

THANK YOU for this detailed info. So much more helpful than the generic "we're processing claims" BS on their website.

Good to know about the December timeline, I was wondering if I should just give up. Also had no idea about that income limitation - that might be why some ppl are getting less than expected.

Just to add to this - I spoke with someone yesterday and they confirmed this timeline. Also if your income was over that threshold, they calculate a partial exclusion.

The whole system is designed to be frustrating so people just give up. Been in the unemployment system for years and its always been this way. NEVER count on getting anything on time from ny unemployment.

This right here ⬆️ its by design. The more people who give up, the more money they keep.

did anyone else have to amend their return? I filed with H&R Block and they told me I need to file an amended state return to get the exclusion but everything I read online says it should be automatic?

You shouldn't have to amend. NY is supposed to be adjusting automatically based on what the IRS sent them. H&R Block might just be trying to charge you for an amendment you don't need.

I was told the same thing by Jackson Hewitt but when I called NY tax dept they said DO NOT AMEND. They're doing it automatically and if you amend it actually slows down the process.

Here's the weird thing - my brother got his NY refund in August, I got mine in October, and my neighbor is still waiting. We all filed around the same time in March. Makes no sense how they're processing these. I think its just random at this point.

Has anyone tried contacting their state representative about this? I emailed mine last week and surprisingly got a response. They said they'd look into it and actually followed up asking for my info to check my specific case.

This is actually really good advice. State reps can often cut through red tape faster than we can on our own.
