NY unemployment tax confusion - was the $10,200 tax break included in my 2025 refund?
Does anyone know if I'll still get the NY unemployment tax break refund separately? My taxes were filed after they announced the $10,200 unemployment income wouldn't be taxed, but I'm totally confused about whether that adjustment was already calculated in my federal refund or if I'm supposed to get a separate payment. I've heard conflicting things from friends who also collected unemployment. Anyone gone through this and know how it actually works? The IRS website explanation is making my head spin!

The timing of your tax filing is what matters here. If you filed AFTER the American Relief Plan was implemented in April 2025, then yes, your tax preparer or tax software should have already excluded that $10,200 of unemployment income from taxation. You can check your tax return - Line 8 of your 1040 should show a reduced amount of unemployment compensation after the adjustment. If you filed BEFORE April, then the IRS is supposed to be automatically adjusting returns and sending additional refunds, but they're doing it in phases and many people are still waiting.

Thank you! I filed in late April, so I guess it should be included already. I'll check line 8 of my 1040. The thing is my refund seemed smaller than I expected, that's why I was wondering if something was missing.

If you filed in March, before the tax law change, you should be getting an automatic adjustment. The IRS started processing these in batches based on filing date and complexity. Simple returns (single filers no dependents) were processed first, then married filing jointly. They're still working through them. If it's been more than 8 weeks, you might want to check your tax transcript on the IRS website for any updates - it often shows pending refunds before they're issued.

Here's what's actually happening with the unemployment tax exclusion: 1. If you filed BEFORE the law changed in April 2025: The IRS is supposed to automatically recalculate your taxes and issue a refund for any overpayment. They're processing these in batches and many people are still waiting. 2. If you filed AFTER the law changed: Your tax preparer or software should have already excluded up to $10,200 of unemployment from your taxable income. This would be reflected in your original refund amount. To check if it was already applied, look at Schedule 1 of your tax return. Line 7 shows total unemployment compensation, and Line 8 shows the unemployment compensation exclusion (up to $10,200). If Line 8 has an amount listed, you already received the benefit in your original refund. Keep in mind this only applies to federal taxes, not state. New York state taxes still apply to all unemployment income regardless.

This explanation is super helpful, thank you! Just checked my Schedule 1 and there IS an amount on Line 8, so I guess it was already calculated. Wish my tax software had made that clearer when I was filing. And good point about NY state - I totally forgot the exclusion doesn't apply to state taxes.

THE IRS IS ABSOLUTELY LYING ABOUT THESE AUTOMATIC ADJUSTMENTS!!!! I filed in February and STILL haven't received my additional refund. Called 14 times and got 6 different answers. One rep said it was coming in July, another said September, another said I needed to file an amended return (WHICH IS NOT TRUE). They're hoping people just forget about their money!!! DEMAND your refund!!

Your brother got lucky then. Facebook groups are FULL of people still waiting. They're clearly prioritizing certain returns and pushing others to the bottom of the pile. I've paid taxes for 32 years and THIS is how they treat us?!

Thanks everyone for the explanations! I just double-checked my tax forms and found the exclusion on Schedule 1. Mystery solved - it was already included in my refund. I think I was expecting more because I forgot about the state tax portion still being due. Really appreciate all the help!

kinda related but my unemployment 1099-G form for 2024 has wrong amount on it, anybody know how to get that fixed? i tried calling NY unemployment but cant get through

You need to request a corrected 1099-G. Try using the message system in your NY.gov account, specifically selecting "Tax Form" as the subject. If that doesn't work after a week, that's another situation where Claimyr can help get you through to someone who can fix it - incorrect tax documents need to be addressed quickly.
