NY unemployment still withholding backpay after transferring jobs - computer flagged my claim for reporting 0 hours
I switched jobs about 10 weeks ago and during the transition period, I claimed unemployment for 2 weeks when I had 0-7 hours of work. Apparently, their system automatically flags accounts when you report minimal hours worked. The unemployment rep told me they needed to review my case and it would take "up to 5 weeks" to clear up. Well, here we are almost 3 months later, and I'm still waiting for them to release my back payments. I called again last month and the agent swore they fixed everything in the system and said I would definitely get paid the following week. Spoiler alert: nothing happened! Supposedly I'm "still on the waiting list" for back payment review. At this point I'm just frustrated beyond belief... if NY unemployment wants to keep my money that badly, they can have it. Not worth the stress anymore.

Same thing happened to me bro. The system is designed to make u give up. I was on hold for weeks after my job cut my hours and I reported less than 10 hours. Call them and keep bugging them. that's the only way I got them to fix it.

Happened to me when I went from full-time to part-time. The key is documentation! Take screenshots of EVERYTHING. Document every call - date, time, who you talked to. Email them through the portal and save copies. When you finally reach someone who can help, having all this documentation will make it harder for them to dismiss you. Also try reaching out to your state representative - they sometimes can cut through the red tape.

Get a confirmation number for this submission. 4) If they say it's already in process, ask for the exact department reviewing it and the estimated completion date. 5) Contact your state assembly member or senator's office. Call them and explain you're having a hardship due to NYSDOL delays. They have special channels to expedite cases. 6) Check your spam folder daily - sometimes determination notices go there. 7) If they told you it was fixed but no payment arrived, there might be a payment release issue separate from the claim issue. The NY unemployment system is extremely backed up with these transition cases, but being persistent and reaching the right people WILL eventually get your money. Don't let them keep what's rightfully yours.

Your probably getting flagged for fraud investigation. That's what happened to me when I had a similar situation. Once your account gets that flag, it takes forever to clear.

•They never admitted it was a fraud flag specifically but one agent slipped and mentioned "security review" which is basicly the same thing. It eventually resolved after I sent in like 5 different proofs of identity and employment records. took about 12 weeks total.

Have you tried seeing if your claim has an "effective date" issue? That's what happened to me. When I switched jobs the system put the wrong effective date which caused the computer to flag it as potential fraud. Had to have a specialist fix the dates and then backdate the payments.

the ny unemployment system has been like this for YEARS. during covid it was even worse - people waiting 6+ months for payments. what worked for me was contacting my state assemblyman's office. they have special contacts at DOL.

•Yep, call them and say you need help with an unemployment issue that has been ongoing for X months. They'll have you fill out a form with all the details and a release so they can inquire on your behalf.

Ok, but have you tried looking at your payment history in your online account? Sometimes the system will show a payment was "released" but with an "outstanding issue" code next to it. That can tell you exactly why it's held up.

•Go to your payment history, then look at the status column. If it says anything other than "processed" there should be a code. Click on the code and it'll give you the reason. If you don't see that, check the "messages" section of your account.
