NY unemployment owes me 5 weeks of backpay - anyone actually get theirs?

I'm so frustrated with the New York unemployment system right now. I was certifying my benefits every single Thursday for months without any issues, then suddenly in April they stopped paying me. When I finally got through to someone in May, they claimed I hadn't been certifying for those weeks - which is complete BS! I have screenshots proving I certified each week. The rep told me to submit a backpay request through their online portal and said it would take 2-3 weeks to process. It's been over a month now and I haven't heard anything back. The system shows they owe me for 5 weeks of payments but have only paid me for the most recent 3 weeks. Has anyone actually managed to get their backpay after being told they 'missed' certifications? I'm starting to think they're just hoping I'll give up.

Same thing happened to me! They claimed I didnt certify for 3 weeks in March but I DID. I even had email confirmations. Took me literally 6 months of calling and emailing to finally get my backpay. The key is documentation - if you have any proof at all that you certified (screenshots, confirmation emails, etc) don't give up. I would call them every other day until I got resolution.

6 MONTHS?? Omg I'm gonna lose my mind. Did you have to do anything special to finally get them to pay you? Or was it just persistence?

0 coins

Just pure persistence honestly. And I got lucky with one agent who actually took the time to look into my case properly. She saw that there was proof I had certified and pushed it through within a week after that.

This is why I ended up using claimyr.com - I couldn't stand being on hold for hours just to get disconnected. Having someone else wait on hold was a lifesaver.

After weeks of calling and getting nowhere with backpay, I found this service called Claimyr that helped me finally get a human on the phone! They do the waiting on hold for you then call when a real person picks up. Talking to an agent got my money released within 48 hours after explaining my situation. Best decision I made during this whole unemployment nightmare! Here's a video that explains how it works: https://youtu.be/Rdqa1gKtxuE

Sounds sus. Does this actually work or is it just another scam trying to profit off desperate people?

0 coins

Not a scam at all - it literally just waits on hold for you. I was skeptical too but it worked perfectly. They don't touch your benefits or anything, just connect you with an actual agent so you don't have to wait 4+ hours on hold.

0 coins

yo I've seen people talking about this. how long did it take before you got connected to someone?

0 coins

They were calling for about 1.5 hours (which I didn't have to sit through), then I got a call when an agent picked up. Honestly I'd still be waiting for my backpay if I hadn't talked to someone directly.

0 coins

wait another service to pay for when they already owe us money?? this whole system is a joke 🤡

0 coins

I get it, but for me it was worth it to finally get my $2800 in backpay released. I was at my breaking point after weeks of getting nowhere.

0 coins

I had the EXACT same issue! They claimed I didn't certify for 7 weeks when I absolutely did. Here's what worked for me: I filed a complaint with my state representative's office. No joke, I got a call back from unemployment within 48 hours after my rep's office contacted them. They fixed my backpay issue immediately after that. Politicians' offices have special contacts at unemployment that can actually get things done.

The NY unemployment system is COMPLETELY broken. I've been fighting for backpay for 3 months. Every time I call I get a different answer. One rep told me my claim was approved for backpay, next one said there was no record of that. Another said I needed to submit additional documentation, then another said that was unnecessary. It's like they're deliberately making it confusing so people give up.

0 coins

This is 100% what they're doing. They WANT you to give up. Don't. Keep fighting and documenting everything.

0 coins

Oh I'm not giving up, they owe me over $3000 at this point. Been keeping a spreadsheet of every call, who I talked to, what they said... gonna use it all if I need to escalate further.

OK so I went through this whole backpay nightmare last year and eventually got paid. Here's my comprehensive guide on getting your NY unemployment backpay: 1) Document EVERYTHING. Screenshots, emails, dates/times of all certifications, and keep a log of every person you speak with. 2) Submit your backpay request through the online portal AND also send a detailed email to the backpay department (backpayrequest@labor.ny.gov) 3) After 2 weeks of no response, start calling daily. Be polite but firm. Ask specifically for a Tier 2 specialist who handles backpay issues. 4) If still no resolution after 3 weeks, contact your state assembly member and state senator. They have dedicated staff who handle unemployment issues and special contacts at NYSDOL. 5) As a last resort, file a complaint with the Department of Labor ombudsman office. Alternatively, if you're struggling to even get someone on the phone (which is often the hardest part), I used claimyr.com to get through. They wait on hold so you don't have to, then call you when an agent is on the line. Completely worth it to finally resolve my backpay issues. Don't give up! The system is frustrating by design, but persistence pays off eventually.

Thank you SO MUCH for this detailed response! I didn't even know about the backpayrequest email address. Going to try all of these steps.

0 coins

Can confirm this works. I followed almost exactly this process and finally got my 6 weeks of backpay after 2 months of fighting.

0 coins

That email address doesn't work anymore, they changed it to backpay.requests@labor.ny.gov - just letting people know so their emails don't bounce back

0 coins

Thanks for the correction on the email! Things change so frequently with their system.

unpopular opinion maybe but i had better luck just physically going to a dept of labor office than dealing with phone/email. waited in line for 3 hours but actually got my backpay issue resolved same day. if ur near a physical office might be worth trying

0 coins

Which office did you go to? I'm in Brooklyn and willing to try this approach.

0 coins

i went to the one in manhattan on varick street. bring ALL your documentation, id, etc. and get there when they open!

I hate to be pessimistic, but after 4 months I gave up on getting my backpay. The amount of time and stress I was spending trying to get it wasn't worth it anymore. I just accepted the loss and moved on with my life. Sometimes that's the best option for your mental health.

0 coins

This is exactly what they want you to do. The system is designed to be so frustrating that people give up. It's how they save millions of dollars they rightfully owe to workers.

0 coins

Maybe so, but at some point you have to weigh the cost to your mental wellbeing vs. the money. For me, it wasn't worth it anymore.

0 coins

I respect that decision. Everyone has to decide what's best for them. Sometimes walking away is the right choice.

Check if your claim might have been flagged for identity verification without them telling you. This happened to me - they secretly put a hold on my account saying I needed to verify my identity but NEVER TOLD ME. I only found out after getting someone on the phone. After I verified my identity, all my backpay was released within a week.

Demi Hall

That's insane! How do I check if this happened to me? Is there somewhere in my online account I can see if there's an identity verification hold?

0 coins

Unfortunately there's no way to see it online. You have to actually talk to someone. When you do, specifically ask "Is there an identity verification hold on my account?" If they say yes, ask them to send you the verification form immediately.

0 coins

The most ridiculous thing is how they claim you didn't certify when you literally have proof that you did. This happened to thousands of people during their system "upgrade" last year. Their database clearly lost certification records but they refuse to admit it. Classic government incompetence 🙄

0 coins

hey OP - check your spam folder! i was waiting for months before i realized all their emails were going to my spam. they had actually been trying to contact me for additional info before they could process my backpay.

Demi Hall

Just checked and nothing there 😔 But thanks for the suggestion! I'll keep checking it regularly from now on.

This is probably going to sound crazy, but try calling right when they open, but on Wednesday specifically. For some reason, I've had WAY better luck getting through on Wednesdays, and the agents seem less overwhelmed. I got my backpay processed after 6 weeks of trying by following this weird Wednesday morning strategy.

0 coins

I've had the same experience! Wednesday mornings around 8:05am (not right at 8, but a few minutes after) seems to be the sweet spot. Got through in under 20 minutes last Wednesday.

0 coins

this actually makes sense. monday they're swamped from weekend. tuesday they're still catching up. by wednesday it's the calm before the end-of-week storm

0 coins

This won't be a popular opinion, but the best way to get your backpay is to be a KAREN (sorry!!). I was nice for 2 months and got nowhere. Then I started being super assertive, asking for supervisors, taking names, stating laws and regulations they were violating, and suddenly my backpay appeared within a week. You can be polite AND firm, but you have to advocate strongly for yourself in this system.

0 coins

Sad but true. Being assertive works with these agencies. The squeaky wheel gets the grease 💯

0 coins

Just be careful not to be TOO aggressive or they might flag your account for 'special handling' which is code for 'we're going to make this person wait even longer' lol

After struggling to get through on the phone for weeks and getting disconnected every time, I finally tried claimyr.com and got connected to a real person at NY unemployment within 2 hours. Explained my backpay situation and the agent was able to see that I had actually certified correctly. They released all my payments the next day. Sometimes you just need to actually talk to the right person who can see what really happened.

0 coins

how much does that service cost? seems weird to pay money to get money that's already owed to you

0 coins

Lim Wong

i get that, but when they owe you thousands in backpay and you can't get through to anyone, it becomes worth it. i was at my wit's end after waiting 5+ hours on hold multiple times and getting nowhere.

0 coins

Don't listen to anyone telling you to give up. I fought for 5 months and finally got all my backpay ($7600). The system is designed to discourage you from pursuing what's rightfully yours. Stay persistent and document absolutely everything. Request your calls be escalated to a supervisor. If all else fails, contact your state representative - that's what finally worked for me.

0 coins

Y'all need to stop complaining and just do what I did. File a formal complaint with the NY Department of Labor Inspector General. Google the form, fill it out detailing exactly how they're violating their own policies by claiming you didn't certify when you have proof you did. I got a call back within 3 DAYS and my backpay was released a week later. They don't mess around with inspector general complaints.

0 coins

This is actually really good advice. The IG complaints go to a completely different department that has authority over the regular unemployment office. They take these complaints seriously.

0 coins

imma try this tomorrow. been fighting for my backpay for 2 months with no luck. thanks for the tip 🙏

Demi Hall

Do you have a link to the specific form? I'm finding a few different complaint forms online and not sure which is the right one.

0 coins

Here you go: https://ig.ny.gov/form/complaint-form-long The key is to specifically mention that you have evidence of certifying (screenshots, emails, etc) that contradicts what their system shows. That's what gets their attention.
