NY unemployment backpay for missed weeks - anyone actually received it?

Has anyone actually gotten approved for backpay with NY unemployment? They're claiming I wasn't certifying when I ABSOLUTELY was every single Sunday without fail (this is so frustrating!!). I spoke with a rep who told me to send an email requesting the backpay, which I did right away, but it's been 2 weeks and I haven't heard anything. They owe me 4 weeks of payments but have only paid me for 2 so far. I'm getting worried they're just ignoring my request. What's the actual timeline for backpay decisions? Should I call again or is there a better way to follow up?

yep same thing happend to me, they said i wasnt certifying for 6 weeks but i swear i was. took them like 3 months to fix it lol

3 MONTHS?? I can't wait that long! Did you have to keep calling them or did they eventually just fix it on their own?

I successfully received backpay last month after a similar issue. Here's what worked for me: 1. Document everything - dates you certified, confirmation numbers if you have them 2. Send a follow-up email after 2 weeks if no response 3. Call and speak specifically with a claims specialist (not just any rep) They may request that you complete Form TC-403B (Request for Backdated Benefits). Make sure to be very specific about which weeks you're missing and provide any screenshots of your online account if possible.

Thank you so much! I didn't know about that form. I don't think I have confirmation numbers but I do have bank statements showing the pattern of deposits that suddenly stopped. I'll try calling again tomorrow morning.

The TC-403B isn't always required. Sometimes they just fix it internally if you get the right rep. I had this happen in 2024 and they just fixed it after I called three times.

Just to add some context here - this is actually a pretty common system issue in 2025. The NYSDOL upgraded their certification tracking system in January and there have been multiple reports of certification records not being properly linked to claims. The backpay request process should take 10-14 business days according to official guidelines, but with current volumes, many requests are taking 3-4 weeks minimum. Your best bet is to follow up with a call at the 3-week mark. Make sure when you call that you specifically mention you've already submitted the backpay request email and are following up on its status. Ask them for a reference number for your backpay request - they should be able to provide this.

Thank you for this - it helps to know it's a system issue and not just me. I'll call next week which will be the 3-week mark. I'm worried because rent is coming up and I was counting on that money.

I had this EXACT same problem in February because of their system upgrade. It took me 5 WEEKS to get my money and I had to call at least 6 TIMES!!! The DOL is completely incompetent. Don't expect them to fix anything unless you harass them constantly. The whole system is designed to make us give up!!!

After trying to reach someone at NY unemployment for 3 weeks about my backpay (similar situation, they missed 5 of my certifications), I finally used Claimyr to get through to a live agent. It worked surprisingly well - got connected to a claims specialist in about 20 minutes instead of spending days trying. They found all my missing certifications and approved my backpay on the spot. You can check them out at claimyr.com - they have a video showing how it works: https://youtu.be/Rdqa1gKtxuE Honestly wish I'd known about this earlier instead of wasting weeks trying to get through on my own.

I'm desperate enough to try anything at this point. I'll look into it, thanks for the suggestion.

Arent you supposed to print out your certification confirmations? I always take screenshots of everything when I certify just in case. I had a problem last year where they said I didnt certify for 2 weeks but I showed them my screenshots and they fixed it right away.

I didn't know I was supposed to do that... I just assumed the system would work properly. Lesson learned for the future I guess.

While screenshots are helpful, they're not required. The system should maintain accurate records of all certifications. If there's a discrepancy, NYSDOL can check their system logs to verify certification attempts. Don't worry if you don't have screenshots - just be persistent with your follow-up.

so i had this issue in january where they missed 3 of my weekly certifications. i emailed and called for like a month with no answer. then i went to my assemblyman's office and they have ppl there who deal with unemployment issues. they fixed it in like a week! try your local rep's office maybe

That's a great idea, I hadn't thought of contacting my local representative. I'll try the other suggestions first but will definitely keep this as an option if nothing else works. Thanks!

Quick update on timelines based on recent cases I've seen: For backpay requests submitted in May 2025, NYSDOL has been processing them in about 3-4 weeks. If your request was sent 2 weeks ago, you should follow up next week if you haven't heard anything. When you follow up, ask specifically for: 1. Confirmation that your backpay request was received and is in the system 2. The current status of your request 3. An estimated timeline for resolution 4. A reference/ticket number for your case Keep detailed notes of every call including the rep's name, date and time of call, and what they told you. This documentation can be helpful if you need to escalate the issue.

Thank you so much for this detailed information. I really appreciate the specific questions to ask - that helps a lot. I'll definitely keep track of everything.

Just to let you know - I've seen several cases resolved in the past month where the backpay was approved and then appeared as a separate lump sum payment, distinct from regular weekly benefits. So when checking your payment history, look for a separate payment entry rather than assuming the missing weeks will be added to your regular weekly deposits.

That's good to know! I'll keep an eye out for a separate payment. Hopefully I'll see something soon.

That's EXACTLY what they want you to do!!! The system is DESIGNED to be confusing and difficult so people just give up. Don't let them win!
