NY unemployment stalled for 5 months - need a lawyer to make them move?

My spouse has been pending since 2/25/2022. Getting so frustrated that we're thinking about hiring a lawyer to speed things up. NY unemployment seems to be dragging their feet for everyone who's waiting on payments. Maybe if they were held accountable legally they'd process claims faster? Five months of waiting is ridiculous. He tries calling every single day but hasn't reached a real person yet. We've sent multiple messages through their website portal but get absolutely nothing back. Anyone have any suggestions on what we should do next?

I had the same problem but even worse - waited 7 months!!! What finally worked for me was using Claimyr.com. It's this service that calls for you and connects you with an actual human at unemployment. Best money I ever spent - talking to a rep got my benefits released within days after months of nothing. They have a video showing how it works too: https://youtu.be/Rdqa1gKtxuE

wait this actually works? i've been trying for weeks to get through the phone system and just keep getting hung up on 😖

0 coins

Yeah it seriously saved me. I was about to give up completely but their system actually gets you through to someone. Totally worth it when you think about all the benefits you're missing out on while waiting.

sounds like one of those ads that pops up everywhere. anyone ACTUALLY try this besides this random comment? 🤔

I used it last month. Got a callback in about 40 mins. Agent fixed my claim right there on the phone.

not falling for another unemployment 'hack'... these never work

0 coins

Not a hack - it's just a service that stays on hold so you don't have to. The agents are the same actual NY unemployment people, Claimyr just gets you connected to them.

Lawyers cost $$$ and unless you have a HUGE claim, probably not worth it. My brother-in-law is an attorney and told me unemployment cases are notoriously hard to push forward unless theres clear evidence of wrongdoing. most lawyers wont even take them tbh

0 coins

Thats what i was worried about. We're already struggling without the benefits, so spending money on a lawyer seems risky..

exactly. and even if u win theres no guarantee of extra $ for your troubles. you'd just get what u were owed anyway

Here's what you need to do to get your NY unemployment claim unstuck (I was in your exact situation last year): First, documentation is key. Keep a detailed log of EVERY attempt to contact them - dates, times, confirmation numbers, everything. This will be crucial later. Second, expand your outreach. Don't just call the main unemployment line - that's a black hole. Contact your state representative and senator. Many have staff dedicated to unemployment issues. Email them with your claim details (minus SSN/personal identifiers) and specifically ask for intervention. Third, try the callback feature through claimyr.com - this was literally the only way I could actually talk to a human being after 4 months of trying. Once I got someone on the phone, my claim was resolved in 20 minutes. Fourth, if you have any documentation from your employer confirming your situation (layoff notice, etc.), have that ready when you finally reach someone. Fifth, check if there are any specific identity verification issues. Many claims are stuck in limbo because of [ID.me](https://ID.me) verification problems that nobody tells you about. Don't give up - the system is designed to be frustrating, but persistence pays off. Getting a real human on the phone is the key turning point for most people.

This is super helpful, thanks for taking the time to write it out! I'm gonna try contacting my state rep tomorrow

0 coins

Going to try all of this starting tomorrow. We did the ID.me thing months ago but maybe something went wrong?

0 coins

That's actually really common - the ID.me verification sometimes doesn't properly link to your unemployment account even when you think it completed successfully. Definitely mention that specifically when you reach someone.

omg plz dont waste ur money on a lawyer yet. ny unemployment is a complete trash fire rn. try sending a message to ur state assembly person first, seriously. my claim was stuck for 3 months and my assembly dude got it fixed in like a week once i reached out 🙌

Four months?? I've been waiting for 8 MONTHS and still nothing!!! The system is completely broken. I've filed complaints with the DOL Inspector General, written to my senator, and even filed a FOIL request (NY's version of FOIA). Nothing works. We need a class action lawsuit not individual lawyers.

8 months??? thats criminal! how are you surviving???

barely. moved in with my parents at 37 years old. not where i saw myself heading but here we are 🤷‍♂️

Class action is a good idea actually. Has anyone started organizing something like that? Would definitely sign on.

CONTACT YOUR STATE SENATOR NOW!!! I cannot stress this enough. After 6 frustrating months my claim was fixed in 3 DAYS after contacting my state senator's office. They have special contacts at unemployment who actually respond to them. Skip the lawyer and go straight to your elected officials.

Do you just call their office or is there a specific way to contact them about unemployment issues?

0 coins

I filled out the contact form on my senator's website and put "URGENT: NY Unemployment Claim Assistance" in the subject line. Then got a call from their office the next day. They took my info and had a DOL liaison reach out within 48 hours.

Most of these claims stuck in limbo are because of suspected fraud. Not saying YOU committed fraud, but the system flags accounts for the smallest things. Missing info, typos, similar addresses, multiple claims from same IP (like apartments), etc. When u finally reach a human they can usually clear the fraud flags in minutes.

0 coins

This is 100% accurate. My claim was flagged because I moved during the pandemic and my new address matched someone else who had filed a fraudulent claim (totally different person). Took 5 months to sort out.

Has he tried calling right when they open? I had to call at exactly 8:00am like 15 times in a row but eventually got through. The afternoon calls are useless, everyone's trying then.

0 coins

Yea, he's tried at open, mid-day, right before close... nothing works 😩

0 coins

that sucks. the system is totally overloaded. might be worth trying claimyr.com that others mentioned. a friend used it and it worked

0 coins

They're hoping you'll give up. That's literally their strategy. The longer they delay, the more people get frustrated and stop pursuing their claims. DON'T GIVE UP. That's exactly what they want.

Have you tried the online chat? Sometimes its actually faster than calling (which is ridiculous but whatever). I got thru after waiting 2 hrs but at least i didn't have to keep redialing.

0 coins

I had no idea there was an online chat option! Will definitely try that tomorrow.

0 coins

The chat is hit or miss. I got connected once but then they said they couldn't help with my specific issue and i needed to call anyway 🤦‍♀️

There's a phone service called claimyr that got me through to unemployment when I was desperate. Google it - worth every penny when you're waiting on thousands in benefits.

0 coins

another day, another company promising to fix the unfixable unemployment system lol

0 coins

No seriously, it works. I was skeptical too but when you're desperate enough you'll try anything. They just deal with the hold time for you and connect you when a real person picks up.

The legal aid society sometimes takes unemployment cases for free if you qualify financially. Maybe worth looking into before paying for a private attorney.

0 coins

check if ur husbands employer is contesting the claim. my boss was being shady and telling unemployment i quit when i was laid off. took forever to sort out.

0 coins

Good point - I'll ask him to check with his former employer directly.

0 coins

I got my claim fixed by literally showing up in person at a DOL office. They say not to do this but I was desperate. The security guard tried to turn me away but I (politely) refused to leave until someone helped me. Got my issue resolved same day after months of waiting on the phone.

0 coins

This works sometimes but is super risky - some offices will help, others will call security on you. Depends which location and who's working that day.

0 coins

Make sure his claim isnt stuck because of a simple identity verification issue. So many people are waiting for months when all they need to do is upload an ID document or verify something basic. With no way to know thats the problem!
