NY unemployment can't see my income from out-of-state employer - now they want a year of paystubs?

I'm dealing with a strange situation with my unemployment claim. I've been working for a contracted company based outside NY for the past 3 years, but I physically work at a university here in New York. This company always does temporary layoffs during summer breaks. I just got laid off for the summer and filed for unemployment, but when I called NY unemployment today (shocked they actually answered!), the rep told me they have no record of my income from this out-of-state employer. They only see income from my small side gig that I do on weekends. Now they're saying I need to send in paystubs for EVERY MONTH going back a full year! Has anyone else who works for an out-of-state company run into this problem? Is this normal procedure or are they just giving me the runaround? I'm worried about how long this will delay my benefits.

Yep, happened to me too. My main employer is in New Jersey but I work remotely from NY. When I filed my claim, they could only see my NY-based side hustle income. I had to fax (yes, FAX!) 15 months of paystubs to them. Took about 3 weeks but they finally updated my claim with the correct income. Just make sure to include your claim ID on EVERY page you send them.

Thanks for your response! Did you have to call them after sending the paystubs or did they just process everything automatically?

I had to call them like 5 times before they actually processed it 😩 The fax went into some black hole at first. I finally got thru to someone who actually helped.

they still use fax machines??? what is this, 1995? 🤣

ikr? next they'll ask us to send in stone tablets with our claims carved into them 💀

After 3 weeks of getting nowhere with my claim I tried a service called Claimyr (claimyr.com) and it changed everything! Their system called NY unemployment for me, stayed on hold, then connected me directly to an agent who fixed my wage issues right away. Talking to an actual human got my benefits flowing within 2 days. Best decision I made after wasting weeks trying to reach someone on my own. Check out this video if you want to see how it works: https://youtu.be/Rdqa1gKtxuE

sounds too good to be true. you actually tried this?

100% tried it myself! After spending 4+ hours on hold everyday for a week straight, this was a lifesaver. It connected me to an actual agent who fixed my wage issues in one call.

hmm I've been burned by so many of these 'services' before... what makes this different? unemployment services are always tryna scam desperate people

0 coins

not a scam, it's just a hold service. they call and wait on hold for you, then call your phone when an agent picks up. that's it. saved me hours of time and frustration!

NY unemployment system is so broken when it comes to out-of-state employers. My company is based in Pennsylvania but I've worked in NY for 5 years. Had to send wage docs THREE separate times before they got it right. Just keep bugging them and document everything!

This is actually super common with multi-state employers. The wage reporting systems between states don't talk to each other well. What you need to do is get your employer to fill out a form called Request for Reconsideration. It's basiacally them confirming to NY that yes, you did work for them and earn X amount. Your HR department should know exactly what to do - this happens all the time.

Thanks for the tip! I'll reach out to HR right away to see if they can help with this form.

No problem. Just make sure you stay on top of HR. They tend to put these things on the back burner and unemployment won't do anything until they get the form.

Been dealing with ny unemployment for 4+ months now because of this exact issue. Out of state company, worked in NY, no wages showing up. Sent paystubs 3x and they keep "losing" them. The only thing that finally worked was getting help from my state assemblyman's office. Call your local rep - they have special contacts at DOL who can actually fix things.

I second this! My state senator's office fixed in 2 days what I couldn't fix in 2 months. They have a direct line to the higher-ups at unemployment.

I never thought about contacting my rep. That's a great idea if things get too delayed.

KEEP COPIES OF EVERYTHING YOU SEND THEM. I cannot stress this enough. They lost my paystubs twice and then tried to deny my claim saying I never sent anything. I finally had to use claimyr.com to get an agent on the phone who could actually help me. Worth every penny to finally get my benefits sorted out.

how long did it take from when you sent in your paystubs to when they updated your claim? I'm at 3 weeks now and nothing 😫

0 coins

Honestly it took 5 weeks the first time, then they "lost" my docs. Second time was about 3 weeks. When I used Claimyr to actually talk to an agent, they were able to locate my docs in their system and process them while I was on the phone. Got my first payment 2 days later.

They're just giving you the runaround. I've been through this whole process twice now. What will happen is you'll send all those paystubs, wait 3-4 weeks, then they'll say they never got them. Then you'll send them again, wait another month, then they'll process them incorrectly. It's literally the worst system ever.

The accuracy of this comment is painful 😭

Look, here's what you need to do step by step (I finally got this sorted after 2 months of headaches): 1) Send your paystubs certified mail so you have proof they received them 2) Call unemployment every 3-4 days to check on status - don't wait for them to contact you 3) Ask specifically for a "wage investigation" to be started - this is different than just sending in docs 4) Have your employer contact the Interstate Claims unit directly (there's a special number for employers) 5) If no progress after 3 weeks, contact your state representative's office 6) If still no progress, use claimyr.com to get a callback with an agent - they can actually look at your file while on the phone with you The system is completely overwhelmed and unless you're persistent, your claim will just sit there. I know it's frustrating but keep pushing!

Thank you so much for the detailed steps! This is incredibly helpful.

I'd add one thing - ask for the agent's name and ID number EVERY time you call. This way you can reference who told you what if they try to give you different information later.

The moment you said "out of state company" I knew exactly what your problem was gonna be lol. NY unemployment has the WORST system for handling interstate employment. My company is based in Massachusetts but I've worked in NY for years, and every time I need benefits it's the same nightmare. The wage verification takes forever.

dont waste ur time calling. they never pick up. i tried for 2 weeks straight with no luck. ended up using claimyr.com and got through in one day. the agent was able to see my paystubs had actually been received but not processed. she fixed it while i was on the phone.

another day, another company promising to fix the unfixable unemployment system lol

0 coins

nah man, it actually works. its just a service that calls and waits on hold so you dont have to. when an agent picks up, they call your phone. pretty simple but super helpful

0 coins

huh, that actually sounds useful. might give it a try since i've been trying to reach them for 3 weeks now 🤦‍♂️

The system isnt designed to handle multi-state situations well. I went through this exact thing last summer. They claimed my info wasnt in the system cause my employers headquarters is in California tho I work in Manhattan. After sending in all my stubs TWICE, I found out they had been putting it on a seperate claim number somehow?? The whole thing is a cluster. Just keep pushin em and eventually it'll work.

This right here is why New York unemployment is such a joke. Their computer systems cant talk to other states, they lose documents, and then they blame YOU for their incompetence. I'd start contacting your state representatives NOW before this drags on for months.

For real tho. NY unemployment still using computer systems from the stone age 🤣

I dealt with this EXACT situation a few months ago. Worked for a company based in Florida but worked remotely from NY. What ended up working for me after weeks of frustration: 1. Had my employer send a detailed letter on company letterhead confirming my employment dates, wages, and that I physically worked in NY 2. Used claimyr.com to actually get someone on the phone (game changer - saved me hours of hold time) 3. Asked specifically for a "wage reconsideration based on out-of-state employer" The key was actually talking to a human who could look at my file while I was on the phone. Once I got through to someone, it was resolved in about 10 minutes. The weeks of trying to do it through their online system and sending documents to their black hole fax line got me nowhere. Good luck! The system is frustrating but there is a way through it.

Thank you for sharing your experience. I'll definitely try these steps - especially getting that letter from my employer. Did you need to do anything special with claimyr or is it pretty straightforward?

Beth Ford

Super straightforward! You just tell them which number you need called, they wait on hold, then call you when an agent picks up. Saved me like 3 hours of hold time.

0 coins

you need to call the interstate claims unit directly. the regular agents don't know how to handle out-of-state employer situations. the number is different than the main unemployment line.

0 coins

Do you happen to have that number handy? I've been calling the main line.

0 coins

don't have it in front of me but if you google "ny unemployment interstate claims unit" it should come up. just be prepared to wait on hold FOREVER. I waited 2+ hours when I called them.

Its all about the tax withholding. If your company wasn't withholding NY state taxes, then NY doesn't show your wages. I bet if you look at your W-2, it shows the other state's withholding. You'll need to send in all those paystubs AND a letter explaining that you physically worked in NY even though the employer is based elsewhere.
