NY unemployment - can I claim final week when BYE is tomorrow?
My benefit year ending date is tomorrow. I know I need to file a new claim after that, but I still have one final week to certify for (this past week). Can I still certify on Sunday for my last week even though my BYE will have passed? Or do I need to file the new claim first before I can certify for that final week? Anyone been through this before? The website isn't clear about the exact process and timing.

Yes, you can still certify for the last week before your BYE date. I was in this situation back in February. Just log in and claim like normal on Sunday for the previous week. Then after that you'll need to file a new claim for the new benefit year.

ā¢Thanks! Did you have any issues or delays getting paid for that final week?

ā¢Nope, payment came through normal time. Just make sure you file your new claim right after certifying for that final week so theres no gap.

ā¢This is actually wrong info. You need to call and have them manually release the payment for that week. Happened to me last month.

ā¢Weird, I didn't have to call at all. Maybe depends on your specific situation? The system let me certify no problem.

After struggling with this exact problem, I found this service called Claimyr (claimyr.com) that connected me to an actual human at unemployment. Saved me hours of calling and the agent walked me through exactly what to do with my final certification. They got me a callback with a live agent on my phone and talking to someone made all the difference. Here's a video that explains how it works: https://youtu.be/Rdqa1gKtxuE

ā¢This sounds like an ad... does this actually work? I've been trying to reach a human for weeks.

ā¢I get the skepticism but it worked for me. Was desperate after trying to call for 3 days straight. Worth every penny to get my issue resolved in one day.

ā¢wait so u just pay them and they call for u? seems too easy š¤

ā¢Yeah they basically call repeatedly for you and then when they get through, they connect the call to your phone. No more spending all day redialing!

THE SYSTEM IS SO BROKEN OMG. I had to FIGHT to get my last week paid after my BYE date. They make everything confusing on purpose I swear š¤

You should be fine certifying for the last week. But make sure you file your new claim ASAP after your BYE date. Don't wait or you might end up with a gap in payments. And be prepared for the new claim to take some time to process - mine took 3 weeks back in October.

ā¢Three weeks?! Ugh, I can't afford that kind of wait. Did you have to call them during that time?

ā¢Yeah I ended up having to call because they needed additional info. The wait is ridiculous, had to call like 30+ times

Let me clear up some confusion about BYE dates and final certifications based on my experience working with many claimants: You CAN and SHOULD certify for your final week even after your BYE date has passed. The system allows a grace period specifically for this purpose. Here's what you need to know: ā¢ The certification system will still let you claim that final week - it's designed to recognize this situation ā¢ After certifying for your final week, THEN file your new claim - do these in the correct order ā¢ Be aware that your new claim will take time to process (typically 2-3 weeks) ā¢ If you worked at all during your benefit year, they'll need to verify those wages ā¢ You may see a message about "break in claim" - this is normal during the transition If you do run into issues with the final payment or the new claim, don't waste days trying to call repeatedly. I've seen many claimants have success using claimyr.com to get through to an agent quickly. They stay on hold so you don't have to. Hope this helps clear things up! The transition between benefit years is always confusing for everyone.

i messed this up when my bye date came in august. certified like normal but then waited a week to file new claim. big mistake! got stuck in pending limbo for like a month. definitely file new claim immediately after certifying for final week!!

Just to add to what others are saying - I think the timing actually matters. Like certify early Sunday morning for the previous week, then immediately do your new application. DON'T wait even a day or the system gets confused. At least thats what the lady told me when I finally got through on the phone.

ā¢This! The system processes things in batches and if you time it wrong it can cause issues.

OK so here's my experience from last month with this EXACT situation. When you certify on Sunday it'll work fine for claiming that last week. But when I filed my new claim right after, it took FOREVER to process. I had to call multiple times because my claim got stuck in review. Finally used Claimyr.com after my friend recommended it and got through to someone who fixed it in 5 minutes. The ny unemployment phone system is literally the 7th circle of hell.

ā¢How long did your claim get stuck for? I'm trying to plan my finances accordingly.

ā¢Mine was stuck for 16 days before I called and got it fixed. Some people wait longer, some shorter. Total crapshoot tbh

I remeber my BYE date last April. You can certify for the previous week no problem. But watch out - if you worked at all during your benefit year (even part time) they're gonna need to verify those wages for your new claim and that can slow things down.

They really need to make this whole process clearer on thier website. I had to ask the same question when my BYE came up in December! But yeah, everyone is right - certify first, then immediately file new claim.

Not to freak you out but I'd recommend calling before your BYE hits. My account got all messed up and I couldn't certify for my last week until I talked to a rep. Better safe than sorry.

ā¢Well that's concerning... did you use the regular certification system or try to do it over the phone?

ā¢I tried online first, got some error message. Then tried phone system, same problem. Finally had to reach a human to fix it.

i've been through 2 BYE transitions now (covid layoff still going strong š). heres the deal: you gotta certify for that last week first, then file new claim. BUT expect at least 2-3 weeks before the new claim kicks in. if u need $ faster definitely call them after filing new claim. they can sometimes expedite.
