Can I still claim NY unemployment on my BYE Sunday for the previous week?

My Benefit Year End date is this coming Sunday. I'm a bit confused about the timing - can I still submit my weekly certification on Sunday for the previous week before I file a new claim? Or does the system automatically lock me out on my BYE date? I don't want to miss getting paid for my final week. Anyone dealt with this timing issue before?

Yes, you can and should still certify on Sunday for the previous week. Your BYE date means that's when your benefit year ends, but you're entitled to claim for any eligible weeks through that date. The system won't lock you out from claiming for the final week. Just make sure you submit your new application promptly after certifying for that last week.

Thank you! That's a relief. So I'll certify as usual this Sunday and then immediately file my new claim after that?

Good to know it worked out for you! Did you have any gap in payments between your last payment from the old claim and the first one from the new claim?

Just to clarify the exact process for 2025: You should certify for your final week as normal on Sunday. After that, you need to file a new claim right away - don't wait. There will be a 1-week waiting period for your new benefit year (unless NYS changes this policy). Make sure all your employment information for the last 18 months is accurate on your new application. Any delays in filing your new claim will just extend the gap between payments.

Wait, is the 1-week waiting period ALWAYS required for a new benefit year? I thought that was waived now? Ugh the NY unemployment system is SO CONFUSING!!! Every time I think I understand something the rules change again!

When my BYE date hit in March, I tried to certify on Sunday and the system gave me an error message. NOBODY could explain why! I called for THREE DAYS straight and couldn't get through to anyone. Eventually found Claimyr.com which got me connected to an agent in about 40 minutes. They fixed something on their end - apparently my account had a flag on it or something. Check out their video demo at https://youtu.be/Rdqa1gKtxuE - saved me so much frustration! Agent told me this happens to lots of people at their BYE date because the system sometimes gets confused.

To address the confusion about the waiting period: In 2025, New York State *typically* requires a one-week waiting period for new benefit years. However, this requirement can be waived during certain circumstances. Currently, for claims filed after March 2025, the standard waiting week is being enforced. Always check the DOL website for the most current information as these policies can change.

Thanks for clearing that up! I'll definitely plan for the waiting week just to be safe. Really appreciate everyone's help with this.

My cousin had this exact question last month when his benefit year was ending. He was worried about it too but it worked out fine. The whole unemployment thing is stressful enough without having to worry about these little timing details. Good luck with your new claim!

OK BUT what if your benefit balance is ZERO before your BYE date?? Mine ran out last week but my BYE isn't til May 2nd. Nobody ever explains THAT scenario!!! Do I reapply now or wait?? sorry to hijack your thread but its kinda related

That's actually a different situation. If your balance reaches zero before your BYE date, you should file a new claim immediately, don't wait until your BYE date. Your eligibility will be based on your work history in the last 18 months. If you wait, you're just delaying potential new payments.

OMG the NY unemployment system makes everything so complicated!!! When I had my BYE date in February I was so stressed out about doing everything right. I ended up certifying for my last week and then the system prompted me to file a new claim right after. I think they've updated the system to make it more clear what to do. But definitely don't skip certifying for that last week!

One more important tip: Take screenshots of your claim information before your BYE date, including your payment history and current benefit rate. Sometimes during the transition to a new benefit year, accessing your old claim information becomes more difficult. Having those records could be important if there are any discrepancies with your new claim.

That's a great suggestion! I'll definitely take screenshots of everything. Better to have the records and not need them than the other way around.
