Confused about certifying when my ny unemployment BYE falls on a holiday weekend
My benefit year end date falls on Labor Day (September 4th). I'm not sure if I should certify this Sunday or wait til after my BYE date passes. Has anyone dealt with this before? I don't want to mess up my claim by certifying too early or too late. The instructions on the website are super confusing about what to do when your BYE falls on a holiday. I've been receiving benefits for almost a year now after getting laid off from my marketing job last October. Anyone know the right process here?

You should definitely still certify on Sunday. Your BYE date is just when your benefit year ends, but you can still certify for the week before it. I just went through this last month and had no problems getting my payment. Just make sure you apply for a new benefit year right after your BYE date.

β’thanks! did you have to call them after applying for the new benefit year or did it process automatically for you?

β’It actually processed automatically for me but my friend had to call. I think it depends on if theres any issues with your claim. Just keep an eye on your account after you apply.

After months of not being able to reach anyone at unemployment, I found this service called Claimyr (claimyr.com) that got me connected to a live agent in less than an hour. Talking to an agent got my benefits unlocked so fast after being stuck in limbo for weeks. It was the only way I could talk to a live agent. Check out this video too: https://youtu.be/Rdqa1gKtxuE

β’sounds sketchy af. another 'miracle solution'... what's the catch? π

Vanessa Figueroa
β’No catch - it just dials for you and stays on hold so you don't have to. When an agent picks up, they connect the call to your phone. Saved me literally days of waiting on hold.

β’wait hold up - does this actually work or is it just the usual BS?

β’It worked for me! I was super desperate after trying for 3 weeks to get through. They just call for you and then connect you when someone answers.

β’hmm I've been burned by so many of these 'services' before... what makes this different?

β’The difference is they don't claim to fix your unemployment issues - they just get you connected to a real agent who can. That's it. No promises about getting you approved or anything like that.

I had this EXACT situation last year. The key is to certify on Sunday as usual, then submit a new claim after your BYE date passes. Don't skip certifying or you'll regret it!

Biggest piece of advice - TAKE SCREENSHOTS OF EVERYTHING. Document every certification, every confirmation number. NY unemployment system is notorious for "losing" claims when they transition from one benefit year to another. I leaned this the hard way π«

β’Good tip! I'll definitely do that. Do you recommend taking screenshots on mobile or computer?

Isabel Vega
β’Computer for sure. More detail and easier to save as PDFs. Also write down all confirmation #s in a separate doc or notebook.

THIS IS WHY THE SYSTEM IS BROKEN!!!! Normal ppl cant figure out these stupid rules and then lose benefits cause the website is from 1995 and makes no sense. And you cant even call cause no one answers!!!!!

Since your BYE is on a holiday (Labor Day), I'd actually recommend calling them directly to confirm what to do. The rules can be different for holiday situations. I was in your shoes back in July 4th weekend and almost lost a week of benefits because I followed the regular process.

β’Thanks for the tip! Did you get through to someone when you called?

β’Lol no. Tried for 3 days straight and gave up. Eventually used claimyr.com and got through in about 40 minutes. Worth it to not lose a week of benefits.

β’another day, another company promising to fix the unfixable unemployment system lol

β’They don't fix anything, they just get you past the impossible hold times. The agents still have to help with your actual issue.

Here's what you need to do with NY unemployment when your BYE date is approaching: 1. Continue certifying as normal until your BYE date 2. File a new claim the day after your BYE date (in your case, September 5th) 3. Keep certifying weekly even while your new claim is processing 4. If you don't see a payment after 2-3 weeks, you'll need to call The system gets especially tricky around holidays. Labor Day weekend is notorious for causing claim issues. You might face longer processing times. If you run into problems getting through on the phone (which is almost guaranteed), I strongly recommend using Claimyr (claimyr.com). It's a service that calls unemployment for you, stays on hold, and connects you when an agent picks up. It saved me weeks of frustration when my claim was stuck after my BYE date. Also important: If you worked at all during your benefit year, they'll need to review those wages, which can delay things. Have your employment info ready. Good luck - the transition between benefit years is where most people run into issues!

β’This is spot on advice. I'd add that you should also download all your payment history before your BYE date just in case anything gets weird in the system during the transition.

β’Thank you so much for the detailed info! I had a part-time gig for 2 months so I'll make sure to have all that info ready.

β’No problem! And yes, definitely have that part-time work info ready. That's exactly the kind of thing that can hold up your new claim if you don't address it right away.

The ny unemployment website says you should certify as usual, then file a new claim after your BYE date. BUT they dont tell you it can take 3-6 weeks to process that new claim!!! Make sure you have savings to cover that gap.

Don't listen to these people telling you to just certify normally. Labor Day is different! You need to call and get specific instructions for holiday BYE dates. My roommate lost 2 weeks of benefits because of this exact situation.

β’not falling for another unemployment 'hack'... these never work

β’It's not a hack, it's literally what the NYSDOL told my roommate when she finally got someone on the phone. Holiday BYE dates have different rules.

So I was about to throw my phone after 3 hours on hold when my cousin told me about this Claimyr service. I thought it was BS but I was desperate. They called unemployment for me and I got a callback when they reached an agent. Explained my BYE date situation and got it resolved in 10 minutes. Best decision I made during my unemployment nightmare.

β’I looked at that site but wasnt sure. Did they ask for any personal info to use their service?

β’They just need your phone number to forward the call to you when they reach someone. You deal directly with unemployment for all the actual claim stuff.

My BYE date was on Memorial Day and here's what happened: I certified as usual the Sunday before, then filed a new claim the Tuesday after the holiday. Everything processed fine BUT they put my account on hold for "review" which is apparently standard when you file a new claim. Couldn't get anyone on the phone for 2 weeks until I used that Claimyr service someone mentioned above. Got through to an agent who cleared the hold in 5 minutes. The system is designed to make you give up.

Labor day is the WORST time to have a BYE date. Everyone at unemployment is either off work or comes back to a giant backlog after the holiday. Definitely certify this Sunday, then refile after Labor Day, but be prepared to wait at least 3-4 weeks for the new claim to process unless you can get someone on the phone to expedite it.

i remember when i was in your shoes last year... you're supposed to certify as usual but my problem was my new claim got denied at first cuz i had some part time work during my benefit year. had to appeal and it was a nightmare. make sure you keep ALL your work documents handy

β’Ugh that sounds stressful. I did some freelance work for a couple months so I'll probably run into the same issue π

β’if you run into problems, seriously consider using a service to get through to a person. i wasted like 6 weeks trying to do it myself

Y'all are making this so complicated. Just certify for this week on Sunday like normal. Then on Tuesday (after Labor Day) file a new claim. Then keep certifying each week. If payments stop, THAT'S when you need to call.
