NY unemployment BYE date on September 5th - do I still certify this Sunday?
So I just realized my Benefit Year End (BYE) date is September 5th, which is next week. I'm confused about whether I should still certify for benefits this Sunday or if I have to wait until after my BYE date passes to file a new claim. The NYSDOL website isn't clear about what to do when you're this close to your BYE date. Has anyone dealt with this before? Will certifying right before my BYE mess anything up with my claim?

yea u should still certify. BYE date means the end of ur benefit year, not that u cant claim anymore. keep claiming til u get a message saying u need to file a new claim

Thanks! So even though my BYE date is just a week away, I should keep certifying as usual? I was worried the system might reject it since it's so close to the end date.

Yes, you should absolutely continue to certify each week, including the Sunday before your BYE date. The Benefit Year End date marks when your current benefit year expires, but you're entitled to claim all eligible weeks up until that date. After your BYE date passes, you'll need to file a new claim if you still need benefits. Missing a week of certification could mean losing that week's benefits permanently, so don't skip your weekly certification regardless of how close you are to your BYE date.

That makes sense, thank you for the clear explanation! So after September 5th passes, that's when I'll need to file a completely new claim if I still need benefits, right?

Continue certifying as normal right up until your BYE date. After September 5th, you'll need to file a new claim. The system is designed to handle certifications right up to the BYE date, so you won't mess anything up. If you're still unemployed after your BYE date, make sure to file your new claim promptly to avoid any gaps in payment. The system might automatically prompt you to file a new claim when you try to certify after September 5th.

I had my BYE date back in March and there was about a 3 week gap before I got paid again on my new claim. Just prepare for that possibility!

I'm actually in the EXACT same situation!!! My BYE is Sept 3rd and I've been freaking out about what to do. I tried calling NYSDOL like 37 times yesterday and couldn't get through to anyone!!! Do we need to do anything special when we certify this Sunday since it's so close to the BYE date?? I'm so worried I'll mess something up and lose my benefits!!!

There's nothing special you need to do for this week's certification. Just certify normally. After your BYE date passes, that's when you'll need to file a new claim if you're still unemployed.

Listen, I went through this in April. Keep certifying like normal until your BYE date. But be prepared - there WILL be a gap when you file your new claim. Took me almost a month to get my first payment on the new claim year, and NYSDOL was impossible to reach by phone. I finally used this service called Claimyr (claimyr.com) that got me through to an agent in about 20 minutes after days of failed calling. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE - completely worth it when I was panicking about my delayed new claim.

Omg thank you for mentioning this!!! I'm definitely going to need to talk to someone after my BYE date. Is this service legit? Did they actually get you through to a real person?

Yes, it's legit. It connected me to a real NYSDOL agent who fixed my claim issue. After my BYE date, my new claim was stuck in pending and I couldn't get through on the phones for days. Claimyr got me through to someone who could actually help.

I remember back in my day unemployment was way simpler than all this BYE date nonsense lol. My son had to deal with this last year and he just kept certifying right up until the day and then they made him file a whole new claim after that. The system is just designed to make things complicated if you ask me.

Yeah, it does seem unnecessarily complicated. Did your son have any gaps in his payments when he filed the new claim?

Oh yes he sure did! About 3 weeks with no money coming in while they

Literally JUST went through this last month. Yes certify this Sunday. And every week. Then after your BYE date you'll need to file a completely new claim. But heads up - there will probably be a gap of 2-3 weeks while they process your new claim. DON'T STOP CERTIFYING during this time even if you're not getting paid. Once they approve the new claim, they'll pay you for those weeks you certified.

Thanks for the heads up about continuing to certify during the gap! I wasn't sure if I should keep certifying if I wasn't getting paid after filing the new claim. That's really helpful advice.

One more important thing to note: When you file your new claim after your BYE date, they'll review your work history for the past 18 months again. If you worked at all during your previous benefit year, those wages might qualify you for a new claim. If you didn't work at all during that time, you might need to reapply under different provisions. Be prepared to provide documentation of any work you did during your previous benefit year when you file your new claim.

I did work for about 3 months last fall before being laid off again. So it sounds like I should definitely gather my W-2 and paystubs from that job before filing my new claim. Thanks for the heads up!

theres a buncha misinformation here tbh. if u didnt work enough during ur benefit year (like earn 10x ur weekly benefit) u might just get auto-extended n not have to file new claim. system tells u what to do

This is partially correct but not entirely. Whether you need to file a new claim depends on several factors, including if you worked during your benefit year and if you qualify under current eligibility requirements. The system will typically prompt you with next steps, but it's always best to be prepared to file a new claim after your BYE date.
