Finishing last 4 days on NY unemployment claim - when to start new claim?

I'm about to claim my last 4 days of benefits this Sunday. My benefit year isn't over yet, but my available days are almost used up. I'm confused about what happens next - do I need to wait until the following week to file a new claim, or can I just call NYSDOL on Monday right after claiming my final days? I don't want to mess anything up or delay getting benefits. Anyone know the proper procedure here?

Thanks for replying. So I should wait until like Wednesday or Thursday after I certify those last days? I'm worried about having a gap in payments.

The most important thing is to understand the difference between your benefit year ending and running out of benefit days. If your benefit year is still active but you've used all available days, you typically need to wait until after your final certification is processed before filing a new claim. I would recommend: 1. Certify your final 4 days on Sunday as normal 2. Wait 2-3 business days for that certification to process completely 3. Then file a new claim online through your NY.gov account If you try to file a new claim while your current one is still actively processing your final days, it could create conflicts in the system that might delay everything.

This is really helpful, thank you! So my benefit year doesn't end until June, but I'm out of days now. I'll wait until Wednesday after certifying to start the new claim process.

When this happened to me last year, I tried calling right away on Monday and it was a HUGE mistake!! The system got all confused and I ended up with both claims being investigated which delayed EVERYTHING by almost 6 weeks!!! Definitely wait until the last payment actually shows as PAID in your payment history before doing anything else.

Oh wow, that's scary! I definitely don't want to wait 6 weeks for benefits. I'll make sure the last payment shows as paid before doing anything.

I've been through this exact situation twice in 2024. You need to wait until your final certification is fully processed (shows as "paid" in your payment history), which typically takes 2-3 business days after you certify. But here's the important part - when you DO file your new claim, you'll likely hit endless busy signals trying to speak with someone. I wasted days trying to get through before I found Claimyr (claimyr.com). They got me through to an agent in about 20 minutes when I had been trying for days. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE Without that, I would've probably had a several week gap between claims because you really do need to speak with someone to get everything processed smoothly when transitioning between claims.

is that service actually legit? sounds kinda sketchy tbh

Yes, it's completely legitimate. I was skeptical too, but it worked exactly as promised. They don't handle any of your personal unemployment information - they just connect your call through to NYSDOL. Once you're connected, you're talking directly with the unemployment office, not with Claimyr.

I'm actually in the middle of this EXACT situation RIGHT NOW!!! I certified my last days on Sunday and tried filing a new claim on Monday morning and the system gave me some weird error saying I already had an active claim!!! So I tried calling and of course couldn't get through to ANYONE!!! Now I'm completely stuck with NO MONEY coming in and BILLS DUE NEXT WEEK!!! Does ANYONE know how long I need to wait exactly???? Will my online account tell me when I can file a new claim???

I understand it's stressful, but try not to panic. Your online account won't specifically tell you when to file a new claim, but you need to wait until your payment history shows your final days as "paid" rather than "pending." This typically takes 2-3 business days. Once that happens, you should be able to file a new claim without the error message. If you continue having issues, you'll need to speak with a representative.

There's a lot of misinformation here. To clarify the process for NY unemployment when you exhaust your benefit days but your benefit year hasn't ended: 1. Certify for your final days as normal 2. Wait for the payment to process (status will show "paid" in your payment history) 3. File a new claim through your NY.gov account 4. You'll likely need to complete a phone interview for the new claim The confusion happens because the system won't let you file a new claim until the final payment from your previous claim is fully processed. This is why people get error messages when trying to file too soon. Important: There will likely be a 1-2 week gap between your final payment from the old claim and your first payment from the new claim. This is normal and happens due to the new claim processing time.

Thank you for the clear explanation. I was hoping there wouldn't be a gap, but at least now I can plan for it. Is there anything I can do to make the phone interview happen faster once I file the new claim?

Unfortunately, there's no way to expedite the phone interview scheduling - they assign those based on their internal queue. The best approach is to make sure all your information is completely accurate when filing the new claim to avoid any unnecessary flags that might delay processing. Also, keep your phone nearby and answer all calls, even from unknown numbers, as NYSDOL often calls from blocked or unfamiliar numbers.

The waiting week policy was suspended during COVID, but was partially reinstated in 2023. However, that's different from what we're discussing here. The gap between claims when you exhaust benefits isn't an official "waiting week" - it's just the administrative processing time for a new claim. The system needs time to verify your eligibility, employment history, and calculate your new benefit rate.

my cousin just did this last month and he said you gotta wait til the payment shows up in ur account before you can do anything else. he waited 5 days just to be safe.

Thanks! That's probably the safest approach. I'll wait until I actually see the money for those last days before trying to file anything new.

One additional point that might be helpful: Once you do file your new claim, make a note of your confirmation number and take a screenshot if possible. The NY unemployment system occasionally loses new applications during peak filing periods, and having proof of your submission date and confirmation number can help if you need to follow up.

Thank you everyone for the advice! To summarize what I'll do: I'll certify my final 4 days this Sunday, wait until I see the payment status change to "paid" in my account (probably Wednesday or Thursday), and then file a new claim online. I'll also prepare for a possible 1-2 week gap before the new payments start coming in. It's frustrating that there's a gap, but at least now I can plan for it.

Good plan! Just be prepared to spend HOURS trying to reach someone by phone once you file the new claim. Pretty much everyone I know who's filed recently had to talk to a representative to complete the process, and the phone lines are still crazy.
