NY unemployment benefits ran out during maternity leave but BYE isn't until June - can I reapply now?
I'm currently on maternity leave after giving birth in February. My unemployment benefits just ran out last week, but my benefit year ending date isn't until June. I've been trying to reach someone at the unemployment office for 3 days straight with no luck. Does anyone know if I can reapply for benefits now or am I stuck waiting until my BYE date in June? My employer knows I'm coming back in July but I really need some income until then. Really appreciate any help since I can't get through to anyone on the phone.

You don't reapply until your BYE date. Once your benefits exhaust thats it for the benefit year. You can try calling to see if there are any extensions available but I doubt it.

Shoot, that's what I was afraid of. There's no other programs I can apply for in the meantime?

You might qualify for SNAP or TANF depending on your household income. Worth looking into while you wait for your BYE date.

I was in a similar situation last year and could NOT get anyone on the phone for weeks. Finally found this service called Claimyr (claimyr.com) that got me connected to an actual human at unemployment. Talking to the agent got my situation sorted in like 10 mins after weeks of stress! They called for me and connected me when someone picked up - best money I've spent to get my benefits situation fixed. Check out this video about how it works: https://youtu.be/Rdqa1gKtxuE

Is this an actual thing that works? Sounds too good to be true tbh

Yeah it actually works! I was super skeptical too but was desperate after trying to call for 3 weeks straight. It got me through to someone who fixed my claim that same day.

Hmm another 'miracle solution'... what's the catch? 🙄

No catch - they just call repeatedly and use tech to detect when a human answers. Then they connect you. Saved me from losing my apartment last year when my benefits were stuck.

wait wait hold up - does this actually work or just another unemployment hack that never works?

Sadly when your benefits exhaust during your benefit year thats it - you have to wait until your BYE date to reapply. Its one of those stupid rules that makes no sense for people on maternity leave but thats how ny unemployment works 🤷♀️

If ur on maternity leave, can you apply for NY state disability? Might be worth looking into since unemployment is probably a dead end until your BYE date.

I'll look into that. Didn't even think about disability as an option.

Yeah check it out. Also look at ny paid family leave too - might be another option depending on your situation.

I ran into the EXACT same issue. If benefits exhaust before BYE date, you're SOL until the BYE date comes. It's ridiculous but that's how the system works. NY unemployment system is designed to be frustrating...they make these rules to discourage people from collecting. Try 211 for emergency assistance resources in the meantime.

Thanks for confirming. This system is so broken! I'll try 211.

The system is freaking DESIGNED to be confusing. Let me explain the whole thing because i've been through this hell: If you exhausted your benefits but BYE date hasn't hit yet, you cannot get more regular UI until after BYE date. HOWEVER, if you're on maternity leave, you might qualify for NY Paid Family Leave or disability. Also, contact local community organizations - many have emergency funds for situations exactly like yours. But the most important thing is getting someone on the actual phone who can look at your specific case. I tried for 2 weeks straight with no luck. The unemployment phone system is a joke. I finally used claimyr.com and got through to someone who explained all my options. Turns out there was a special exemption in my case I never would have known about. Don't give up! The system is designed to make you quit trying.

Thank you for this detailed explanation! I'm going to look into NY Paid Family Leave right now.

This is solid advice. The system is literally designed to be as difficult as possible.

Hate to be the bearer of bad news, but once benefits are exhausted during a benefit year, thats it until ur BYE date. The system sucks.

This happened to me after my paternity leave. I called unemployment for 2 weeks with no answer. Finally got through using claimyr.com - got connected to someone who explained I had to wait til my BYE date BUT they were able to direct me to other programs I qualified for in the meantime. Worth the call just to know all your options.

I thought the same thing but it actually worked. I wasted 2 weeks trying to call myself before trying it. You do you though 🤷♂️

Have you received a monetary determination letter? Sometimes there are extensions but it depends on total wages in your base period. Either way youll need to talk to someone which is the hard part.

If your regular UI is exhausted, check if you qualify for any shared work programs through your employer. Also since you're on maternity leave, definitely apply for Paid Family Leave if you haven't already!

My company is too small for the shared work program but I'm definitely looking into Paid Family Leave now. Thanks!

This is one of those situations where talking to a rep is actually necessary. They might be able to see options in your account that aren't obvious. I know its almost impossible to reach anyone tho 😩

I was literally in ur same position 4 months ago. Here's what I learned: 1. You can't reapply until BYE date if benefits are exhausted 2. BUT you should still call because sometimes they make exceptions for special circumstances 3. Check local charities for emergency assistance 4. Apply for SNAP if you haven't 5. Apply for HEAP if it's still open Good luck, hang in there! ❤️

The BYE date rules are so stupid. They dont account for real life situations like maternity leave at all. The system is built to be frustrating on purpose.

Facts. The whole unemployment system needs to be rebuilt from scratch.

Anyone telling you to wait until June is only partially right. There ARE sometimes exceptions but you NEED to talk to a tier 2 agent (not just the first person who answers). I was in a similar situation and got an extension due to hardship but only after speaking to a supervisor.
