NY unemployment BYE date approaching - can I refile as a student?
My benefit year end (BYE) date for NY unemployment is 9/19/2025 and I'm starting classes next week. The system won't let me certify this week for some reason (keeps giving an error). Do I have to wait until 9/19 to refile a new claim? And the bigger question - will they approve my claim if I'm taking college classes? I'm only taking 9 credits but I need the unemployment to pay bills while I'm in school. Anyone deal with this student situation before?

For your BYE date question: Yes, you need to wait until the day after your BYE date (so 9/20) to file a new claim. The system won't let you file early. As for being a student, NY unemployment generally considers you eligible if you're available for full-time work while attending school. i was a student last yr while on UI and it was fine. just make sure when they ask if anything is preventing you from accepting work you say NO. as long as ur willing to quit school for a job ur good

Be VERY careful with how you answer their questions about school!!! I was taking just TWO classes last year and they suspended my benefits for 3 weeks while they "investigated" whether I was available for work. Had to do a phone interview and everything. They eventually approved me, but it was really stressful having no income during that time. Also, for the BYE date, you literally cannot file until the day after. The system physically won't let you.

When I was on unemployment I was also taking classes and they did approve my claim BUT I got called for this interview thing where they asked about my school schedule and if I would quit school for a job. I said yes (even though I probably wouldn't have lol) and they approved me. Just make sure your class schedule doesn't make it look like you can't work normal hours.

Just to clarify on the refiling process: Mark your calendar for September 20th. Not the 19th (your BYE date) but the day after. Log in early that morning to file your new claim. Have all your employment information from the past 18 months ready, including any part-time work. For the student question, the most important thing is to show that school doesn't interfere with your ability to search for and accept suitable full-time work. Online classes are definitely viewed more favorably since they offer flexibility. Night classes are also generally acceptable since they don't conflict with typical business hours. Don't volunteer too much information about your student status unless directly asked. Answer honestly but concisely.
