Fired from job, NY unemployment claim stuck in review for 10 weeks with no payments
My benefits were supposed to start on April 15th, 2023 but here I am more than 2 months later with nothing to show for it. Finally got through to someone on the phone after countless attempts and they told me my case was transferred to a specialist on May 20th because I was terminated from my position. I wasn't even notified about this until the beginning of June! The agent basically said there's nothing they can do and I just have to wait. Meanwhile I've got rent, car payment, insurance, and utilities all piling up. 10 weeks without income is absolutely insane - has anyone else dealt with this kind of delay after being fired? Any advice on how to actually get someone to look at my claim?

Same boat - fired in March and my claim has been "under review" for 11 weeks now. I call every day and get nowhere. Sometimes they say they'll "expedite" it, other times they just tell me to keep waiting. Meanwhile I'm drowning in bills. The whole system is broken.

•I was skeptical too but was desperate after weeks of trying. It seriously worked. They just automate the calling/waiting process so you don't have to sit on hold forever. Talking to an actual person got my claim unstuck immediately.

•No catch that I found. You pay for the service, they call and wait on hold, then connect you once someone answers. My benefits were released 2 days after I finally got to talk to someone. After 7 weeks of nothing, that was huge.

Pro tip: when you do get through (and I know that's a BIG if), ask specifically for a SUPERVISOR. Regular agents seriously have no power to do anything. Supervisors can actually push claims forward in the system.

If your claim is pending because you were fired, they're conducting what's called a misconduct review. They have to contact your former employer and get their side of the story, which can take forever especially if the employer doesn't respond quickly. Make sure you have documentation ready about why you were terminated and that it wasn't misconduct (if that's your situation).

Been dealing with ny unemployment for 20+ years through various layoffs. Here's what you need to know: unemployment claims where you were fired are ALWAYS investigated and ALWAYS take longer. This is normal but the timeframe has gotten worse since covid. They're severely understaffed. When you do finally get approved (assuming your firing wasn't for misconduct), you'll get backpay for all those weeks. Small consolation when you can't pay bills now, I know.

I've worked in HR for 15 years. When an employee is fired and files for unemployment, we get a request from NYSDOL to provide details about the termination. Here's what you need to know: 1. If your employer doesn't respond within a certain timeframe, NYSDOL should approve your claim by default 2. If your employer is contesting your claim by saying it was for misconduct, you need to be proactive 3. Call every single day and note the date, time, and who you spoke with 4. Contact your state rep - they can often speed things up 5. Document EVERYTHING - all communications with your former employer 6. If you're truly desperate to speak with someone, check out claimyr.com - I've had multiple former employees tell me this service got them through when nothing else worked 7. Send a written appeal letter through the message center in your account The backlog is real, but being persistent is key. Once resolved, you'll get all back payments in a lump sum.

•Employers generally have 10 business days to respond to the initial request, but NYSDOL often gives extensions if requested. The problem is NYSDOL is so backed up that even if your employer doesn't contest or doesn't respond, your claim can still sit there.

Ugh why does ny unemployment take so long when ur fired??? my roommate got laid off and got benefits in 2 weeks. I got fired (not for misconduct, just "performance issues" which my boss never documented) and I'm on week 9 of waiting. This is BS.

Yo I literally just got my benefits yesterday after waiting since March 30th!!! What worked for me was using claimyr.com to get through to an agent, then when i finally talked to someone I asked for a supervisor and refused to get off the phone until they gave me a clear timeline. Squeaky wheel gets the grease and all that. Dont give up!

•Not a jerk, just firm. I said something like "I understand this isn't your fault personally, but I've been waiting X weeks with no income and need to know exactly what's happening with my claim and when it will be resolved." When they gave me a vague answer I asked to speak to a supervisor.

Not to make things worse but you need to be prepared for the possibility they might deny your claim if your employer is fighting it. Make sure you appeal immediately if denied! You only have 30 days to appeal and the hearings are backlogged too.

•Unfortunately not until they make a determination. But if it's taking this long, there's a good chance they are. Gather any evidence now - emails, performance reviews, etc - anything showing you weren't fired for misconduct.

Just throwing this out there - if you're struggling financially while waiting, check with your county DSS about emergency assistance. Also local food banks and community action agencies sometimes have funds to help with utilities and rent while you're waiting for unemployment to come through.

this exact thing happen to me last year. waited 13 weeks. tried everything. finally what worked was getting my cousin who works for the governors office to make a call. I no everyone dont have that connection but maybe try reaching out to local officials or state representatives?? worth a try

KEEP CALLING EVERY DAY!!!!! srsly. i know its hard but i finally got through after 57 calls in one day. the person who finally helped me said my claim had just been sitting there with no activity for weeks. they pushed it through and i got paid the next day.

•Call right when they open (8:30am), press 1 for English then 1 for existing claim issues, then 1 again. If you get the "we're experiencing high call volume" message, hang up and try again. It's a numbers game.

Check if your company is actually contesting your unemployment. My claim was stuck for weeks, and when I finally got through, turns out my employer never responded to NYSDOL's inquiry. The agent was able to push it through once I explained it had been X weeks.
