Can I still file for ny unemployment if I haven't claimed for several weeks?

I lost my job at the end of August due to company downsizing. I filed for unemployment in early September and got approved for weekly benefits of around $530. I claimed for the first 3 weeks but then I got this temporary gig that lasted about 5 weeks, so I stopped claiming because I was working. The temp job ended in mid-October but I completely forgot to restart my claims because I was busy applying for new jobs. It's now been nearly 4 weeks since my temp job ended and I just realized I haven't been claiming benefits this whole time! Can I still go back and claim those missed weeks? Will they reject me because I waited too long? I really need the money since I still haven't found anything permanent and my savings are getting dangerously low. The rent is due next week and I'm stressing out.

Yes, you can still request back weeks. You'll need to call the ny unemployment office though, because you can't do it through the online portal after a certain time. Be prepared to explain why you didn't claim (your temp job is a valid reason). They'll probably ask for details about the temp job too. Better do it ASAP!

Thanks so much! Did you have to do this yourself? How long did it take to get the back pay once you called?

0 coins

Yeah, I had to do it last year. It took about 4 calls to actually get through to someone (their phone system is TRASH). Once I got someone, they processed it pretty quick - had the money in about 10 days.

Good luck getting through on the phone tho. I tried calling for 2 weeks straight couldn't get a human 🤬

After struggling to get through to ny unemployment for weeks, I finally found this service called Claimyr (claimyr.com) and they got me a callback with an actual agent! Saved me hours of waiting on hold and the agent was able to backdate my claim immediately. Got all my missed payments within a week. It was the only way I could talk to a live agent after trying for days. Check out their process here: https://youtu.be/Rdqa1gKtxuE

This sounds like an ad. Does it actually work? I've been trying to get through for ages.

Not an ad lol, just grateful I found it. It worked for me when nothing else did. I was about to give up after 3 weeks of calling.

How much does it cost tho? Is it worth it?

Honestly it was worth every penny to finally get my backpay sorted. Considering the amount of benefits I was missing out on, it paid for itself immediately. Their site has all the details.

hmm I've been burned by so many of these 'services' before... what makes this different?

0 coins

They don't handle your claim - they just connect you with an actual DOL agent. You talk to the agent yourself. That's why it works so well.

You can request backdating but there's a limit. I think you have to do it within 30 days of your last claim. Since you're still in that window you should be ok. Just be prepared to explain why you didn't claim (your temp job is a valid reason). If you wait longer than 30 days it gets wayyyy more complicated.

Thank you! That's a relief. So I just need to call, right? The website doesn't let me go back and claim those weeks.

Yep calling is your only option now. The website won't let you claim past weeks. Brace yourself for lots of hold time tho 😩

You're probably sol tbh. The sytem isnt designed to help people who miss weeks. they're strict af about claiming every week even if it gets backdated.

I had almost the exact same thing happen! Call the unemployment office and explain your situation. Since you had a legitimate reason (you were working), they should be able to help you claim those weeks. You'll need to speak to a claims specialist though, not just a regular rep. Keep calling until someone helps you. And do it IMMEDIATELY - every day you wait makes it harder.

Yep - waiting makes it 10x worse with these ppl! The longer u wait, the more they assume ur tryna game the system 🙄

Here's EXACTLY what you need to do (I worked through this exact situation last month): 1. Don't try to handle this online - you MUST call them directly 2. When you call, specifically ask for help with backdating missed claim weeks 3. Be honest about why you didn't claim (temporary work is a valid reason) 4. Have documentation ready about your temp job (dates, hours, pay) 5. They might ask you to fill out certifications for each missed week 6. Be prepared to verify your identity again 7. Stay polite but persistent - sometimes the first agent can't help but a supervisor can The phone system is beyond frustrating though. I spent 3 days trying before I found claimyr.com which got me a callback from an actual NYSDOL agent. Once I finally spoke to someone, they fixed my backdating issue in about 15 minutes. Don't give up! The money is rightfully yours if you qualified during those weeks. You just need to get through to a human who can actually help you.

What's this claimyr thing? Does it actually work? Sounds too good to be true.

It worked for me when I was at my wit's end. They basically wait on hold for you, then call you when they get an agent. Saved me hours of frustration.

can confirm claimyr works. I was skeptical but desperate after 2 weeks of constant calling. Got connected to an agent same day.

They're gonna want dates and proof of your temp employment. Make sure you have all that info ready before u call. I had to send in pay stubs from when I was working temp to justify why I stopped claiming for a while.

LMAOOO good luck even getting someone on the phone. I called 47 times yesterday and got hung up on every single time. The NY unemployment system is a JOKE 🤡

try calling at 7:58am right before they open. That's how I finally got through after weeks of trying

0 coins

Or try claimyr.com - that's the only way I got through after 3 weeks of trying. They called for me and connected me with an agent.

Is that legit? never heard of it before

0 coins

Yeah it worked for me. They just wait on hold so you don't have to, then connect you when they get a human. Beats calling 50 times a day yourself.

i went thru the EXACT same thing in august. you have 2 choice: keep calling until someone helps (took me 2 weeks of trying) or use one of those services that waits on hold for you like claimyr. i was desperate and used claimyr after banging my head against the wall for 10 days. had an agent on the phone within 2 hours who fixed everything.

wait hold up - does this actually work or is it just the usual BS?

You have 60 days to claim missed weeks without needing special approval according to the handbook. After that, you need to go through an appeal process. Since you're at 4 weeks, you should be fine but DON'T WAIT ANY LONGER! Call asap!

The unemployment website is useless for this. You 100% need to call and talk to a human. If your reason was that you were working a temp job, they should be able to help you claim those weeks since you're eligible again now.

Thanks! Seems like calling is definitely the way to go based on all the comments.

just went through this exact thing. its a nightmare BUT they will backdate you if you can get a human on the phone. its just the 'getting a human' part thats impossible. i ended up using claimyr.com after trying for 3 weeks to get through. paid them and had an agent on the line within the hour. they fixed it all up on that call. best money i spent all year considering how much backpay i was owed!

I've seen a couple people mention this claimyr thing... is it some kind of scam or does it actually work?

nah it's legit, they just wait on hold for you. you still talk directly to the unemployment agent yourself. saved me hours of frustration.

another day, another company promising to fix the unfixable unemployment system lol
