Can I keep claiming NY unemployment while attending school out of state?
I'm currently receiving unemployment benefits in New York but I got accepted to a college program in Pennsylvania starting in September. I'm planning to move to a dorm there but my permanent address will still be at my parents' house in NY. I'll still be actively looking for work while in school (taking mostly evening classes). Has anyone dealt with this situation before? I've tried calling the ny unemployment office like 20 times but can't get through to an actual person. Getting conflicting info online - some say you can keep claiming as long as your permanent address stays in NY, others say you have to physically be in the state. Don't want to accidentally commit fraud but really need these benefits to continue while I'm in school.

When I was on unemployment last year they asked if I was available for work full time. If you're going to school, they might question your availability. You should definitely talk to them before making any moves.

I was having the same issue trying to reach someone at unemployment. Yes, you can claim from out of state IF you maintain your NY residence as your permanent address AND you're still able to accept work in NY if offered. You need to be ready to return to NY for interviews and potential jobs. They can track your IP address when you certify so make sure you're honest about your location.

ok but what everyone is missing here is that if ur a FULL-TIME student, u might not qualify for unemployment AT ALL regardless of where you live!!! they consider u not available for work if ur schedule is full of classes. happened to my roommate last year and they had to pay back like $4000 😱

I moved to Florida for 3 months last winter and kept claiming in NY (where my apartment still was). They never said anything but when I had an issue later and called, the rep mentioned they could see I had been certifying from Florida IP addresses. No penalty but she said I should've notified them.

I tried going to school while on unemployment and it was a nightmare. Had to do an interview with unemployment to prove my availability and then they reduced my benefits because of my school schedule. Just be prepared for that possibility.

Technically you can but they might flag your account for review if you're certifying from another state for multiple weeks. If you're only gone for a short time should be fine but a whole semester might raise flags.

Everybody talking about rules but nobody mentioned they barely enforce any of this unless you get randomly audited. I traveled for 2 months while on UI and certified from 5 different states. As long as you're actually looking for work in NY, nobody cares.

the real question is if you're going to school are you REALLY available for full time work? that's what they care about most. if your answer is honestly yes then you should be fine wherever you physically are.

I couldn't get anyone on the phone either until I used claimyr.com - had someone on the phone in like 30 mins after trying for days. The agent told me you can be temporarily out of state as long as you're still looking for work in NY and able to start if offered.

Listen, if you want a real answer instead of these guesses, you HAVE to talk to someone at unemployment directly. Try calling right at 8:00am when they open or use that service someone mentioned above (claimyr.com) - my friend used it last month when she had payment issues and said it was the only way she finally got through.
