Can I keep claiming NY unemployment after moving to Maryland?

So I've been collecting NY unemployment since I lost my job at a marketing firm in April. Last week I had to suddenly relocate to Maryland to help take care of my elderly parent who had a fall. I'm still job hunting but now from Maryland. When I logged in to do my weekly certification yesterday, I realized I don't know if I'm allowed to keep claiming my NY benefits while physically living in Maryland. Has anyone dealt with this? Will NY unemployment find out and stop my benefits? I'm planning to move back to NY when I can, but might be here for a few months. Really concerned about losing my only source of income right now since the job market is still brutal in my field.

Yes you can still claim NY benefits if you worked in NY. I moved to Pennsylvania last year and was still able to claim my NY unemployment. You just need to keep looking for work and be available to work. They don't care where you live as long as you earned wages in NY and are eligible for benefits.

Oh thank god, I was freaking out about this! Did you have to notify them about your move or change your address in the system?

0 coins

You should definitely update your address in the system. It doesn't affect your eligibility, but they need your current address for tax forms and other communications.

I think you also have to be willing to commute back to NY if you get a job offer there. At least that's what they told me?

I was in this exact situation but I was stuck on hold for HOURS trying to get through to someone to confirm. Finally found this service called Claimyr (claimyr.com) and they got me a callback with an actual agent who confirmed I could continue claiming while out of state as long as I was still actively job searching. Talking to an agent got my anxiety resolved so fast - best money I ever spent after wasting days trying to get through on my own. They have a helpful video explaining how it works: https://youtu.be/Rdqa1gKtxuE

Is this for real? Sounds too good to be true. How does it actually work?

0 coins

It actually does work! They basically call the unemployment office for you and stay on hold, then when a real person picks up, they connect the call to your phone. Saved me literally hours of hold time.

another day, another company promising to fix the unfixable unemployment system lol

I was skeptical too, but my benefits were on hold for 3 weeks and I was desperate. They got me connected to someone who fixed my claim in minutes. Wish I'd known about it sooner.

Do they require any of your personal info to do this?

0 coins

They just need your phone number to forward the call to you. It's actually super simple. Check out their website claimyr.com if you're curious

You need to update your address with NY unemployment. Log into your account and there should be an option to change ur contact info. You're still eligible since you worked and earned wages in NY. I moved to Jersey and still collected my NY benefits for like 4 months no problem.

Make sure you're following Maryland's work search requirements, not NY's. Different states have different rules about how many job contacts you need to make each week. I think NY requires 3 job contacts per week but idk about Maryland. You don't want to get flagged for not doing enough work searches.

0 coins

Actually that's wrong. You follow NY requirements since thats where ur claim is from. You dont have to follow Maryland rules if ur not claiming Maryland unemployment.

Oh my bad, I thought it went by where you physically are. Thanks for correcting me! 👍

IMPORTANT: Make sure you continue to do your work search activities and keep detailed records! NY unemployment has been doing random audits and if they ask for proof of your work search activities and you don't have it, they can make you pay back all the money. This happened to my cousin and she had to repay like $7,800 because she couldn't prove she was looking for work.

This ⬆️ Can't stress this enough!! Document EVERYTHING

Thanks for the warning! I've been keeping a spreadsheet of all my applications but I'll make sure it's extra detailed now.

Remember that your benefits are based on where you WORKED and paid unemployment insurance, not where you currently live. You earned those benefits by working in New York. Moving doesn't change that. Just make sure to update your address and continue to meet all the other eligibility requirements (actively seeking work, available to work, etc).

The ny unemployment system is so broke I doubt they'd even notice if you moved to mars lmaooo 👽

FR tho 💀 They still sending me letters to an address I moved from 2 years ago despite updating my info online like 5 times

0 coins

This is actually terrible advice. They do interstate cross-checks now and will absolutely catch this eventually if you don't update your address

Here's what you need to do (I went through this exact situation last year): First, yes you can continue claiming benefits from NY while living in another state. Your benefits are based on where you worked, not where you live now. Update your address in the NY unemployment system right away. This is crucial because they send important documents that might require quick responses. Continue following NY's work search requirements (currently 3 work search activities per week). Be aware that if you get a job offer in NY, you must be willing to accept it or commute back, otherwise you could be disqualified. Keep detailed records of all your job search activities - employer names, positions, application dates, follow-ups, etc. If you run into any issues or have your benefits suddenly stopped, don't waste days trying to call. Use claimyr.com to get a callback from an actual unemployment rep who can help sort things out. I moved to Ohio for 6 months while on NY unemployment and had zero issues as long as I kept following all the rules. Good luck!

Thank you so much for this detailed response! This is exactly what I needed to know. I'll update my address in the system today.

Have you tried that Claimyr thing they mentioned? Does it actually work?

0 coins

Yes! It saved me when my payments randomly stopped and I couldn't get through on the phone. They got me connected to a real person in about 2 hours when I had been trying for days on my own.

Side note: be prepared for tax season to be annoying. You'll have to file part-year resident returns in both states depending on how long you stay in MD. NY taxes unemployment benefits but some states don't - not sure about MD. Just something to keep in mind.

This! I moved from NY to PA and had to deal with this. Get a good tax person who understands multi-state filing.

From someone who works in HR: You are 100% allowed to continue claiming NY benefits while living in another state. Your claim is based on your employment history and wages earned in NY, not your current residence. Make sure to update your address and phone number in the system so you don't miss any important communications.

Thank you for confirming! It's such a relief to hear this from someone with expertise.

I went thru the same thing moving to florida. You HAVE to call and tell them ur new address. Their website says u can update online but it never works right. I spent 5 days trying to get thru to someone on the phone. Ended up using claimyr.com to get a callback and fixed it in 10 mins. Trust me don't waste days of your life on hold.

0 coins

You'll be fine but definitely update your address. What you CAN'T do is claim benefits in both states at the same time - that's fraud and they will catch you. But claiming NY benefits while living in MD is totally legal as long as you're still looking for work.

Why is it literally impossible to get a straight answer from the actual unemployment website? Had to come to reddit to figure this out when I moved too. The NY unemployment website is hot garbage 🔥🗑️

0 coins

Fr! It's like they deliberately make it confusing so people give up and don't collect what they're owed 🤦‍♀️

0 coins

The website hasn't been updated since like 2002 I swear

Are you still looking for jobs in NY or only in MD now? If you're only applying to jobs in Maryland, that might be an issue since NY unemployment requires you to be available for work in NY.

0 coins

I'm applying to remote jobs and jobs in both states actually. My industry has a lot of remote positions available.

0 coins

That's good! Remote jobs definitely count for your work search requirements. You should be fine then.

0 coins

wait are u permanently moving to MD or just temporarily? If temporary then just keep ur NY address on file and dont worry about it. If permanent then yah update ur address but continue claiming NY benefits until they run out.

0 coins

It's kind of in between - I need to help my parent recover from surgery which could take 2-3 months, but I'm planning to return to NY after.

0 coins

In that case I'd still update the address to be safe, especially if u need to receive any physical mail from them. Better to have everything correct.
