honestly the whole unemployment system is such a pain... i filed when my company just stopped paying everyone and it took forever to get anything sorted out. but yeah you should definitely file, they cant expect you to work for free!!!
The NYS Department of Labor system is so slow right now!! I've been waiting 3 weeks for my approval and every time I call they just say to wait longer. It's ridiculous that they can't give you a straight answer about timing.
Just want to clarify something important - even if your initial claim is still pending, you should start filing your weekly claims as soon as you're able to. You can file weekly claims even before your initial application is fully processed. This ensures you don't lose any benefit weeks while waiting for approval. The weekly claims will just sit there until your main claim gets approved, then they'll process all the back weeks.
The whole system is messed up!! They expect people to report from jail when you can barely make a phone call and the phones cost like $5 a minute. Then they want their money back like you planned to get arrested. My brother went through this and it took months to sort out the overpayment even though he reported it right away.
I work in a law office and see this all the time. The data matching between correctional facilities and NYS Department of Labor usually catches incarceration within 1-3 weeks, but the person is still responsible for any overpayments during that delay period. Your friend should absolutely have someone report this ASAP to minimize the overpayment amount.
I've been on unemployment for 6 months now and honestly the whole system is a mess. Good luck getting consistent answers from different NYS Department of Labor reps about anything. My neighbor got approved for benefits immediately while my claim sat in adjudication for weeks with no explanation.

Just want to add that unemployment benefits in NY also come with job search requirements. You need to make at least 3 job contacts per week and keep a log of your search activities. The NYS Department of Labor can ask to see this log at any time. Benefits aren't just free money - there are responsibilities that come with them.
