Was a bit nervous or untrusting at first, but my calls went thru. First time the wait was a bit long but their customer chat line on their page was helpful and put me at ease that I would receive my call. It's not automatic denial. NYS Department of Labor looks at each case individually to determine if the attendance issues constitute misconduct or were due to circumstances beyond your control.

File ASAP and be honest about everything. The adjudication process will review all the facts. If you can show the car problems were legitimate and you tried to address them, you have a good shot at approval.

Wait, can they really just take your tax refund without warning?? I thought they had to go through some kind of legal process first. This is making me nervous because I got an overpayment notice too but it was only for like $400.

Yes, they can offset tax refunds for unemployment overpayments. It's called Treasury Offset Program (TOP). They're required to send notice before doing it, but the timeframe is usually pretty short - often just 30-60 days.

been there! you should also look into requesting a hardship waiver if the overpayment wasn't your fault. NYS Department of Labor has provisions for waiving overpayments in certain circumstances especially if it would cause financial hardship

The job search thing is no joke - you need to keep detailed records of every application, networking contact, job fair etc. NYS Department of Labor can audit your job search log at any time and if you don't have proper documentation they can disqualify you and make you pay back benefits. I learned this the hard way.

The WHOLE SYSTEM is designed to make you jump through hoops and deny you benefits! They'll find ANY excuse to delay or deny your claim. I've been fighting with NYS Department of Labor for months over a simple separation issue. They make it so complicated on purpose to discourage people from applying. Just be prepared for frustration and bureaucratic nonsense.

While the system can be frustrating, most straightforward claims do get processed without major issues. Don't let horror stories scare you from applying if you're eligible.

It depends on how much you earned in those 3 months. If you made enough to meet the minimum wage requirements in your highest quarter, you might still qualify. But 3 months of work typically isn't enough unless you were making really good money.

The whole system is ridiculous honestly. I worked for 2 years straight and when I finally needed unemployment they found some technicality to deny me initially. Had to appeal and everything. NYS Department of Labor makes it so unnecessarily complicated just to get benefits you've earned.

I've been trying to update my tax withholding for weeks but the my.ny.gov website keeps timing out when I try to access payment preferences. Has anyone else had this issue? I really don't want to deal with calling NYS Department of Labor because the wait times are insane.

Wait, so if I'm getting $400 a week and I elect for tax withholding, they'll take out $40 each week? That seems like a lot when you're already struggling financially.

It's 10% for federal taxes only. You'll still owe state taxes when you file your return, but at least the federal portion is covered. It's better to have it taken out gradually than to owe hundreds or thousands all at once.
