IRS Audit questioning HOH status & dependent claims for non-biological children - what documentation do we need?

The IRS is auditing my partner's return over his head of household status and dependent claims. He's been claiming my three children (two aren't biologically his) plus our baby who was born last November. I haven't been employed for about 4 years now. He supports all of us financially - pays for housing, food, clothes, everything. We're confused about what documentation we need to provide to satisfy this audit. The biological father of my two older kids has never been involved and has no contact with them. We've never had problems before - TaxSlayer didn't flag any issues when filing last year, and when we used FreeTaxUSA this year, we honestly answered that he wasn't the biological father of two kids but that I gave permission for him to claim them. Key thing here is that the rules for claiming non-biological children as dependents are different from claiming your own kids. Your bf needs to show he provided more than 50% of their support AND that they lived with him for more than half the year. Since you haven't worked, he's probably covered on the support part, but you'll need documentation for everything. School records showing your address are golden for proving residency.

Here's what worked for me: - School records showing kids at my address - Medical bills I paid for them - Notarized letter from my gf giving me permission to claim her kids - Utility bills in my name - Receipts for major purchases (clothes, school supplies, etc) - Bank statements showing regular grocery purchases The IRS denied my first response because I didn't include enough evidence. Second time with all this documentation they approved it. Don't skimp on what you send them!

You can get a letter notarized now - doesn't have to be from when you filed. Just write up something simple saying you give him permission to claim them as dependents since he provides their support and they live with him full time.

The form your looking for is 8332 'Release of Claim to Exemption for Child by Custodial Parent' - if the bio father ever had custody, this form should be filled out. If not, a notarized statement from you should work. Don't forget lease/mortgage showing both your names at same address too.

Serious question - why doesn't your bf just file as Single instead of HOH if you're the bio parent? Wouldn't that avoid this whole mess? HOH gets you a better tax bracket but seems like a lot of headache to prove.
