Employer delaying W-2s due to HR medical leave - What are my rights?

My employer (local government) is refusing to issue W-2s until March because the HR person is on medical leave. They claim no one else can access the system. They acknowledged they'll pay IRS fines but that doesn't help me file my taxes. What are my options? This cant be legal right?

Tax pro here. Your employer is required by law to provide W-2s by January 31st. Contact the IRS at 800-829-1040. They'll reach out to your employer. If you don't receive it by late February, you can file Form 4852 (substitute W-2) using your last pay stub of 2024 to estimate your wages and withholdings.
