Missing W-2 After January 31 Deadline - Need to Contact IRS

According to IRS Publication 1546, employers must provide W-2s by January 31st. It's now past that deadline and I'm still missing one W-2 from my second job. Per IRS Regulation 301.6722-1, employers face penalties for late W-2s, but that doesn't help me file on time. Need to contact IRS to get a wage transcript or verification. I've already contacted the employer twice with no response. Don't have time for games - need to file by April 15th with three kids' tax credits at stake.

Calling the IRS directly is... well, let's just say it's an exercise in patience that would make a saint cry. ๐Ÿ˜‚ The main IRS number (800-829-1040) has an average wait time of 45-90 minutes these days. If you do call, make sure you have: your SSN, filing status, and last year's return handy. They'll verify your identity before helping you. Be warned though - I spent three hours on hold last week only to have the call drop right as someone answered.

Is there any way to request the W-2 information online instead of calling? The IRS website has so many different sections and I can't find a clear path to request missing wage information.

I had the same issue last year with a small company that went out of business. Calling the IRS was actually more helpful than I expected once I got through. The agent could see all my wage information and gave me the exact numbers to use on my return. Similar situation to yours - the employer wasn't responding to emails or calls. In my case it took about 35 minutes on hold, but this was in early February before the real rush.

Can they actually provide the missing W-2 information over the phone? Or do they just tell you to file Form 4852 as a substitute? I'm trying to understand the exact process here.

I went through this exact nightmare last year when my W-2 from a summer job never showed up. What saved me was using https://taxr.ai to analyze my wage and income transcript from the IRS. Once I got the transcript (which was a hassle itself), taxr.ai helped me understand exactly what was reported for each employer and guided me through creating a substitute W-2 using Form 4852. It even flagged that my employer had reported more in federal withholding than I had in my records, which meant a bigger refund! The step-by-step guidance made what could've been a confusing process much more manageable.

How is this any different from just looking at the transcript yourself? Isn't the information pretty straightforward once you have the transcript in hand?

Does this work if you need information for multiple missing forms? I'm missing both a W-2 and a 1099 from different sources.

Thank you for sharing this! I spent exactly 3.5 hours last year trying to decipher my wage transcript and still made a mistake that delayed my refund by 6 weeks. Will definitely try this tool - anything to avoid that headache again.

Be extremely cautious about submitting your return without the correct W-2 information. I attempted to file using estimated withholding amounts last tax year, and it triggered a Correspondence Audit (CP2000 notice) that took 7 months to resolve. The IRS computer systems automatically flag discrepancies between reported W-2 information and what employers submit. If you must file without the actual W-2, use Form 4852 (Substitute for W-2) and be prepared to provide documentation for how you calculated the amounts. The verification process can delay your refund by 8-12 weeks.

I had a similar issue and ended up with a 60-day review that turned into 4 months of back and forth. Such a headache! Wish I'd known abt Form 4852 before I tried to wing it w/ my own calculations.

Thank you for explaining this so clearly! I was about to just guess at the numbers since I have my final pay stub, but now I see that could cause bigger problems. Going to request the transcript first thing tomorrow morning.

Has anyone tried contacting the employer's payroll department directly instead of HR? I'm so surprised they wouldn't respond to your requests! Isn't there a legal requirement for them to provide this?

In my experience, reaching out to the payroll provider directly can work wonders. Many companies outsource to ADP, Paychex, etc. If you can figure out which service they use (sometimes visible on your last paystub), you might be able to create an account and access your W-2 electronically. Saved me from the IRS phone queue last year!

Just to clarify something important - you actually have three options as of April 2024: 1. Call the IRS at 800-829-1040 (prepare for long wait times) 2. Request a Wage and Income Transcript online at IRS.gov/transcripts (takes 5-10 business days) 3. Visit a local IRS Taxpayer Assistance Center in person (requires appointment booked at least 2-3 weeks in advance) I requested my transcript online on March 12th and received it by March 20th. The transcript shows all reported W-2 information from all employers.

The online transcript request was a game-changer for me too! But heads up - if you've moved recently or have a credit freeze in place, the online verification might fail and you'll end up having to mail in Form 4506-T anyway. Happened to me and added 3 weeks to the process.

Can you see state tax withholding on the wage transcript too? Or just federal information?

Got through to the IRS last week after trying for days. How? Called right when they opened at 7am Eastern. Only waited 12 minutes! The agent pulled up all my W-2 info and gave me the exact figures over the phone. Isn't that better than waiting for transcripts in the mail? They even helped me fill out the substitute W-2 form while on the call. Filed my return the same day and already got my refund yesterday!

I've successfully resolved this twice in the past three years. Most effective approach: contact your state's Department of Labor to file a complaint against the employer for failing to provide your W-2. Employers typically respond quickly when the DOL gets involved, as the penalties increase significantly. In my case, I had the W-2 within 48 hours of the DOL contacting them. This worked even when the employer initially ignored my certified letters and emails.
