EDD took my federal tax refund but never returned it after winning appeal - what now?

I'm going crazy trying to get back my federal tax refund that EDD incorrectly intercepted! Timeline: Last summer EDD determined I was ineligible for some benefits I'd already received ($8,200) and started the overpayment process. While my appeal was pending, they swooped in and took BOTH my state and federal tax refunds through tax intercept (about $2,100 state and $4,700 federal). Good news - I won my appeal in October! EDD acknowledged I was actually eligible for those benefits all along and returned my state tax refund by December. But here's the problem - it's now been over 9 MONTHS since winning my appeal, and I still haven't received my federal refund back! I've called EDD at least 15 times (impossible to get through), sent 4 messages through UI Online, and even visited an office in person where they just told me to "be patient" and that "federal returns take longer." But an entire YEAR?? Has anyone dealt with this? How do I actually get my money back? I need that $4,700 desperately!

Unfortunately, this is a common issue with EDD tax intercepts after successful appeals. The state refund comes directly from California, so that's why it was returned faster. For federal returns, EDD has to notify the IRS to release the funds, and that process has a ton of bureaucratic red tape. In my experience working with others on this, you need to specifically request an "overpayment balance adjustment letter" from EDD. This document officially confirms your appeal was approved and your balance is zero. Once you have that, contact the IRS directly with this documentation. This is EXACTLY why I always tell people to NEVER certify for benefits if there's ANY question about eligibility!!! Once EDD decides you're ineligible, they unleash hell on your financial life - tax refund intercepts, wage garnishments, bank levys, etc. Even when you win your appeal, getting your money back is another nightmare entirely. The system is DESIGNED to be this difficult!!!

i had a similar problem but with state refund not federal. took 5 months to get back. edd is just super slow with everything lol. have u checked ur account balance in UI Online? sometimes it shows as a credit there before they actually send it.

Yes, I check my UI Online account almost daily! The overpayment balance shows $0 now (after the appeal), but there's no indication of a credit or pending refund for the federal tax intercept. It shows my state refund was processed, but nothing about federal.

It was a formal appeal hearing with an Administrative Law Judge. I had to submit evidence, participate in a phone hearing, and then received the official decision about 2 weeks later ruling in my favor. EDD then sent a notice saying they accepted the judge's decision.

The in-person offices (America's Job Centers) often don't have direct access to the tax intercept systems. You specifically need to reach the Benefit Overpayment Collection Section (BOCS).
