EDD says employer needs more time after interview - Do they really only have 48 hours to respond?

Just had my eligibility interview yesterday after waiting THREE WEEKS since filing my claim. The EDD interviewer told me they need to get more info from my former employer before making a decision. I was let go from my retail job because I accidentally processed a customer's card twice for $232 (honest mistake during a rush). My manager gave me a 'write-up' one day, then the very next day they suspended me, and then fired me the following week. The EDD rep mentioned something about my employer having a deadline to provide information. Is it true they only have 48 hours to respond to EDD's request? I'm stressing about bills and need to know when I might get a decision. Has anyone dealt with this 'employer needs more time' situation?

EDD says 48 hours but in reality employers can take FOREVER and nobody does anything about it!!! I waited 6 WEEKS because my former employer kept 'needing more time' and EDD just let them. They're supposed to make a decision based on available info if employer doesn't respond but they rarely do. Keep certifying every two weeks even while waiting!!

6 WEEKS??? Omg I can't wait that long! Did you call EDD during that time or just wait it out?

The 48-hour deadline isn't as strict as it sounds. What actually happens is that EDD requests information from employers, and while they should respond within 48 hours, there's a longer period (typically 10 business days) before EDD moves forward without their input. In your case of accidental overcharge, they're trying to determine if this qualifies as misconduct. Since there wasn't a clear warning period between write-up and suspension, you might have a decent case. Make sure you continue certifying for benefits every two weeks while waiting for the decision.

Thanks for explaining! That makes sense but still frustrating. I'm definitely certifying each week. Do you think the quick suspension after the write-up helps my case?

Yes, it could help. For a termination to be considered misconduct, they typically need to show you violated a known policy and had warnings/opportunities to correct the behavior. The quick progression from write-up to suspension to termination might work in your favor since you weren't given reasonable time to improve after the warning.

same thing happend 2 me last yr... my boss took like 3 week to respond and i was freaking out the hole time lol. they fired me for till shortage but i got approved eventually cuz it was just a mistake not stealing

That gives me some hope! My situation was definitely a mistake too, not intentional at all. Was your claim status

I used to work for a company that processed unemployment claims for employers. The 48-hour thing is more of a courtesy timeline. In reality, employers have around 10 days to respond, and even then, if they ask for an extension, they often get it. Since this was a single mistake (processing card twice), not willful misconduct or pattern of negligence, you have a good case even if they respond. Keep certifying and make sure UI Online shows your phone number is correct for when they need to call you with questions.

This is helpful but I hate how the system favors employers so much. They can take their sweet time while we're struggling to pay bills. It's ridiculous that someone can get fired for ONE MISTAKE and then have to wait weeks for benefits that they've earned!

If you're tired of waiting and need to speak with an EDD representative about the status of your claim, I recommend using Claimyr. After my employer delayed responding for weeks, I was desperate to get answers. Claimyr helped me get through to an EDD agent when I couldn't get past the 'max callers reached' message for days. They'll call EDD for you and connect you when an agent is on the line. I watched their video demo (https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km) and the service worked exactly as promised. The EDD agent I spoke with was able to see notes on my account and gave me more info than the website showed. Check out claimyr.com if you're stuck waiting.

I've never heard of this service before! I'll check out the video. Did the EDD rep you reached actually give you useful information or just tell you to keep waiting?

The rep actually told me what was happening with my claim - there were notes in the system I couldn't see online. They told me exactly what info they were waiting on from my employer and gave me a realistic timeline. Way better than checking UI Online obsessively and seeing no updates.

Honestly the timeline stuff is all over the place depends who ur interviewer is. Mine was super nice and just approved me on the spot even tho my employer hadnt responded yet. She said since it was a first-time mistake with no prior issues they usually rule in the employees favor unless the employer proves gross negligence or something.

Wow, you got lucky with your interviewer! Mine seemed nice enough but definitely wasn't making any decisions on the spot. Really hope they rule in my favor too.

UPDATE?????? Did you get approved yet????????

Just got the decision letter today - I was APPROVED! The EDD determined it was not misconduct since it was an isolated mistake and the company didn't follow their own progressive discipline policy. All those weeks of stress for nothing! Thanks everyone for your help and support through this.

Congratulations!! That's such great news! I'm so happy it worked out for you. This gives me hope for my own case that's been pending for weeks. Did you get backpay for all the weeks you were waiting?

That's amazing news @Chloe Green! So relieved for you - I've been following your story and was rooting for you the whole time. It's such a relief when common sense prevails and they recognize that honest mistakes shouldn't disqualify someone from benefits they've earned. Definitely shows that fighting for your case is worth it even when the wait feels endless!

Congratulations Chloe! 🎉 This is such a relief to read after following your story. Your case is a perfect example of why it's so important to keep fighting even when the process feels hopeless. The fact that they recognized it was an honest mistake and that your employer didn't follow proper disciplinary procedures shows the system can work when it's supposed to. I'm sure getting that backpay will help with all those bills you were stressing about! Thanks for updating us - stories like yours give hope to others going through similar situations.

This is such wonderful news to hear! I just joined this community and seeing success stories like yours really gives newcomers hope. I'm currently dealing with my own EDD situation and was getting discouraged by all the horror stories online. Your case proves that persistence pays off and that the system does work for honest mistakes. Congratulations on your approval and thank you for sharing the outcome - it means a lot to those of us still waiting! @Chloe Green

Congratulations Chloe! This is such fantastic news and really shows that the system can work when it's supposed to. Your case gives me so much hope as someone who's currently dealing with my own EDD appeal after being terminated for what I believe was an unfair reason. The fact that they recognized your termination didn't follow proper progressive discipline is huge - that seems to be a key factor in these decisions. I've been stressed out of my mind waiting for weeks, but seeing your success story reminds me to stay patient and keep certifying. Thank you for taking the time to update everyone, especially us newcomers who are just learning how this whole process works. Stories like yours are exactly what we need to hear when we're feeling overwhelmed by the system!

Welcome to the community! Your message really resonates with me as someone who just went through this whole stressful process. @JacksonHarris I totally understand that overwhelming feeling - I was checking my UI Online account multiple times a day and losing sleep over it. The progressive discipline angle definitely seems important in these cases. My employer went from write-up to suspension to termination in just a few days, which worked in my favor. Keep documenting everything about your situation and don't give up! The waiting is brutal but it sounds like you're doing everything right by continuing to certify. Wishing you the best with your appeal! 🤞

Just wanted to jump in as someone new to this community - Chloe, your story is exactly what I needed to read right now! I'm currently going through a similar situation where I was terminated for what my employer called "performance issues" but I believe was really just one bad day during a particularly stressful period. I've been waiting 3 weeks since my interview and checking UI Online obsessively with no updates. Reading through all the advice here about the 48-hour rule (that's apparently not really 48 hours) and seeing your successful outcome gives me so much hope. It's frustrating how the system seems to favor employers with all these delays, but knowing that honest mistakes and improper discipline procedures can work in our favor is encouraging. Thank you for sharing your journey from start to finish - it really helps newcomers like me understand what to expect and reminds us to stay patient even when the stress feels overwhelming. Congratulations again on your approval! 🎉

Welcome to the community @Javier Torres! Your situation sounds really similar to what I went through - that obsessive checking of UI Online is so relatable! I was doing the same thing multiple times a day and it was driving me crazy. The "performance issues" angle sounds frustrating, especially if it was really just one rough day. That's exactly the kind of thing that shouldn't disqualify someone from benefits they've earned. Three weeks feels like forever when you're waiting, but based on what I learned here, that's unfortunately pretty normal. Keep certifying every two weeks no matter what, and don't lose hope! If your employer can't prove it was willful misconduct or gross negligence, you have a good shot. The community here was so helpful during my wait - everyone's advice about the timeline expectations really helped manage my stress. Hang in there and keep us posted on how it goes! 🤞

As someone who just joined this community after getting laid off from my restaurant job, reading through Chloe's entire journey from the initial stress to the final approval is incredibly reassuring! I'm currently in week 2 of waiting after my eligibility interview and have been panicking about every little detail. The way everyone here supported each other and shared real experiences (not just generic advice) shows what an amazing resource this community is. @Chloe Green your case gives me hope that honest mistakes and unfair employer practices do get recognized by EDD eventually. The progressive discipline aspect seems super important - my employer also seemed to rush through their "process" before letting me go. Thank you for updating us with the good news and congratulations on getting approved with backpay! Stories like yours are exactly what newcomers like me need to see when we're feeling lost in the system. 🙏

Welcome to the community @Katherine Shultz! I'm so glad Chloe's story is giving you hope during what I know is an incredibly stressful time. Week 2 feels like an eternity when you're waiting, but you're still in the early stages based on what I've learned from reading through all these experiences. The restaurant industry can be particularly tough with how they handle terminations, so it's great that you're documenting the rushed process your employer used. That detail about them rushing through their "process" could definitely work in your favor - it sounds similar to how Chloe's employer went from write-up to termination in just days. Keep certifying every two weeks no matter what, and try not to check UI Online too obsessively (easier said than done, I know!). This community really is amazing for getting real experiences rather than generic government website advice. Hang in there and keep us posted on your progress! 🤞

Just found this community after being in unemployment limbo for over a month! @Chloe Green your success story is exactly what I needed to read today. I was terminated from my retail job for what they called "cash register discrepancies" but it was really just a few small mistakes during my first month - nothing intentional. Been waiting 4 weeks since my interview and getting more anxious every day. Reading how your employer's rushed discipline process worked against them gives me hope since mine did something similar - they went straight from "verbal warning" to termination with no written documentation or improvement plan. The advice here about continuing to certify and not obsessing over UI Online is so helpful. Thank you for sharing your entire journey and congratulations on the approval with backpay! This community seems like such a lifeline for people navigating this confusing system. 🙏

Welcome to the community @Amelia Cartwright! Your situation sounds so frustrating - being terminated for small mistakes during your first month when you're still learning is exactly the kind of unfair treatment that should be overturned. The lack of proper documentation and improvement plan from your employer actually sounds like it could work strongly in your favor, just like it did for Chloe. Four weeks of waiting feels endless, but based on everything I've learned reading through these discussions, you're still within the typical timeframe unfortunately. The "cash register discrepancies" terminology sounds like they're trying to make honest mistakes sound more serious than they were. Keep documenting everything you remember about your termination and the rushed process they used. This community has been such a great resource for understanding what to expect and getting real advice from people who've been through it. Hang in there and definitely keep us updated on your progress! 🤞
