EDD changed my status from disqualification to appeal - can I still avoid judge hearing?
I'm super stressed right now about my unemployment situation. I was on disability for a while and when I tried to switch back to regular UI, EDD disqualified me because I didn't provide a doctor's note confirming I was cleared to return to work. Totally my fault - I didn't realize I needed that documentation. So I submitted an appeal with a detailed explanation letter and included my doctor's note (better late than never I guess). The rep I spoke with mentioned something about a "pre-appeal review" where EDD might just reverse their decision without sending it to an actual appeal judge. Checked my portal today and noticed my claim status changed from "disqualification" to "appeal" - does anyone know what this means? Did my case already go through that pre-appeal review and get rejected? Or is this just the normal status change when they're processing my appeal? Really hoping to avoid a formal hearing if possible!

The status change from "disqualification" to "appeal" is actually normal - it just means your appeal has been acknowledged and entered into their system. The pre-appeal review (also called a reconsideration) still happens behind the scenes, but the status won't necessarily reflect that specific process. If they reverse the decision during pre-appeal review, your status would typically change directly to "paid" or something similar. So right now, your appeal is probably in the queue for review, but no determination has been made yet. Keep checking your UI Online account daily and your physical mail for updates.

same thing happnd to me last year!! took FOREVER to get resolved. my status also said "appeal" for like 2 months before anything happned. keep checking ur mail cuz they might send u hearing date. good luck!

The EDD system is such a nightmare to navigate! I went through something similar when transitioning from SDI to UI and got disqualified for the exact same reason. The "appeal" status just means they received your paperwork, but don't get your hopes up about that pre-appeal review actually happening. In my experience, they SAY they do reviews but almost EVERYTHING goes to a judge regardless. They're so backed up that it took over 3 months before I got my hearing date. And guess what? The judge immediately approved my claim when he saw I had the doctor's note, even though it was late. Such a waste of everyone's time and meanwhile I was broke waiting for benefits!

Have you tried calling EDD directly to ask about your appeal status? I know it's nearly impossible to get through on those phone lines (I spent WEEKS trying), but I finally found this service called Claimyr that helped me connect with an EDD rep without the endless redial nightmare. The rep I talked to was able to tell me exactly where my appeal was in the process and gave me an estimated timeline.
