EDD appealing doctor evaluation - what's the timeline for disability benefits continuation?
I'm freaking out about my disability benefits being cut off! My claim has been approved for about 4 months, but EDD just made me see one of their doctors last week (I guess they call it an 'independent medical examination'). This doctor spent maybe 15 minutes with me, barely looked at my medical records, and declared I could return to work immediately - completely contradicting my treating physician who says I need at least another 3 months of recovery from my back surgery complications. My regular doctor is furious and told me we need to file an appeal right away. She's preparing additional documentation about my condition, but I have no idea how long this appeal process takes or what my chances are. Has anyone gone through this appeal process after an EDD doctor evaluation? I'm terrified about losing my income while I physically can't work yet. Will my benefits continue during the appeal or am I just screwed until they make a decision?

Ugh, those EDD doctors are the WORST!! I had almost the exact same thing happen to me in 2024. They love to cut people off. The doctor spent like 5 minutes with me and decided my chronic pain was magically cured. My appeal took almost 2 MONTHS and my benefits were suspended the entire time!! I had to borrow money from family to survive. Make sure your doctor writes a VERY detailed report contradicting every point the EDD doctor made. Good luck, the system is totally rigged against us!

ive been thru this twice. first time i lost the appeal, second time i won. big difference was having my doc write a letter that specifically said why the edd doc was wrong. also helps if u have xrays or mri to back it up. sometimes they'll give u benefits during appeal if u can prove hardship but dont count on it

My cousin went through something similar with his back injury! The EDD doctor said he was fine but his real doctor said he needed another surgery.
