EDD appeal decision confusing - one disqualification, one eligibility reversal - did I win?
I'm totally confused by the appeal decision I just received yesterday. Had my hearing on Tuesday and got the decision in the mail today, but it has TWO different rulings? It says: Case #25749631: "Claimant is disqualified pursuant to section 1256 of the UI code..." THEN right below it says: Case #25749632: "The determination is reversed. Claimant is eligible for benefits beginning 5/16/25..." Wait what??? Did I win or lose my appeal? Does this mean I'll get backpay for all those weeks since May? My rent is due next week and I've been waiting on this decision for almost 2 months. Has anyone else gotten this kind of split decision before? So stressed right now!

•OMG really?? That's such a relief! Do you know how long it usually takes for them to start releasing payments after a decision like this?

It looks like you had two separate issues that were appealed. Based on your decision letter, the first case was denied but the second case was approved. The important part is that the determination was reversed and you were found eligible for benefits starting 5/16/25. What typically happens is that your claim had multiple issues flagged. The first might have been about your separation reason (misconduct, voluntary quit, etc.) and the second about something else (ability/availability for work, reporting requirements, etc.). Since the second decision makes you eligible for benefits, you should start receiving payments for the weeks claimed after 5/16/25, assuming you've been certifying correctly this whole time.

•Thank you for explaining! Yes I've been certifying every two weeks since I filed. Do I need to call EDD to make sure they start processing my payments or will it happen automatically?

This is actually pretty common with EDD appeals. You likely had two separate issues on your claim that were being appealed at the same time. What matters most is that the eligibility determination was reversed in your favor for Case #2, which means you WILL receive benefits from the date specified (5/16/25). The system should automatically begin processing your payments within 7-10 business days, but in my experience, it often takes them longer because they're backed up. I'd recommend checking your UI Online account daily to see if your payment status changes from "Appeal" or "Pending" to "Paid." If you don't see movement within 10 business days, you'll need to contact EDD directly. That's when I'd recommend using Claimyr (claimyr.com) to get through to an EDD rep quickly. They have a service that connects you with EDD without the endless busy signals. You can see how it works here: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km - it saved me hours of frustration when I had a similar situation after winning my appeal.

•Thank you! I'll keep an eye on my UI Online account and give it about 10 days before I try to call. I've heard trying to get through to EDD is a nightmare so I might check out that service if nothing changes by next week.

Let me tell you, THE EXACT SAME THING happened to me last year and it drove me CRAZY trying to figure out what it meant!!! The EDD system is DELIBERATELY CONFUSING and they do this ON PURPOSE to discourage people from getting the benefits they DESERVE!!! In my case, I had to call them 47 TIMES before I got through to someone who could explain that I had two separate issues. One was about my reason for separation (which they denied) but the second was about my availability for work (which they approved). And guess what? THE APPROVAL IS ALL THAT MATTERS FOR GETTING PAID!!! Just be prepared for them to take FOREVER to actually release your money. The system is BROKEN BY DESIGN!!!

I'm a bit confused about something in your post - you mentioned you got the decision yesterday but your eligibility starts from 5/16/25? That date is in the future (assuming you posted this in 2025 before May 16). Are you sure you read the date correctly? Or maybe I'm misunderstanding something about how EDD backdates eligibility?

•Sorry for the confusion! I filed my initial claim in May, was denied, then filed an appeal. So that date (5/16) is when my eligibility should have started. I've been waiting since then with no payments while the appeal was pending.

•Ah that makes sense! So you should get retroactive payments dating back to May. That's going to be a nice lump sum!

So I had something similar last year when I got laid off from the restaurant I was working at. My boss contested my unemployment saying I voluntarily quit (WHICH WAS A LIE) and I had to go through the whole appeal process. I also got two different decisions in my letter because apparently they had filed two separate issues against me? Anyway, the important thing is that after I got that letter saying I was eligible, it took like 2-3 weeks for my payments to start showing up on my Money Network card. Just keep certifying and be patient. The system works eventually, just moves at a snail's pace.

One important thing to remember: continue certifying for benefits every two weeks while you wait for your payments to process. If you stop certifying, you'll only get paid for the weeks you properly certified for, even if you won your appeal.

•Yes, I've been certifying religiously every two weeks! Thanks for the reminder though - that would be terrible to win the appeal but miss out on payments by forgetting to certify.

hey i had this happen too! one denied one approved. the approved one is what matters for getting paid. took about 12 days for my money to show up tho. ui online still said pending for like a week after i got the letter.

Congratulations on winning your appeal! This is actually great news - you'll be getting backpay from May which should be a substantial amount by now. I went through something similar last year and the split decision thing is confusing but totally normal when you have multiple issues on your claim. Just wanted to add that when your payments do start processing, they might come in chunks rather than all at once. Don't panic if you don't get the full backpay immediately - EDD sometimes releases it in batches. Also, make sure your address is updated in UI Online because they'll mail you a notice when payments are released. The waiting is the hardest part but you're almost there! Keep checking your account daily and you should see movement soon.

•Thank you so much for the reassurance! I had no idea payments might come in chunks - that's really good to know so I don't freak out if I don't see everything at once. I'll definitely double-check my address in UI Online too. This whole process has been such a rollercoaster but hearing from people who've been through the same thing really helps!

Hey Ellie! First off, congrats on winning your appeal! 🎉 I know how stressful that whole process can be. The split decision is totally normal - it just means you had two separate issues flagged on your claim that both went through the appeal process. The good news is that the eligibility reversal (Case #25749632) is what really matters for getting your payments. Since you've been certifying consistently since May, you should be getting a nice chunk of backpay once EDD processes everything. In my experience, it usually takes 1-2 weeks after getting the decision letter for payments to start showing up, but sometimes longer because their system is ancient. One tip: screenshot or save a copy of that decision letter because you might need to reference it if there are any issues with your payments later. And definitely keep certifying every two weeks while you wait! You've got this - the hardest part is behind you now! 💪

•Thank you Sean! 🙏 That's such great advice about screenshotting the decision letter - I definitely wouldn't have thought of that but it makes total sense to keep a record. And yes, this whole process has been incredibly stressful but I'm feeling so much more hopeful now after hearing from everyone here. It's amazing how much better I feel just knowing other people have been through the same confusing situation and come out okay on the other side!

Congratulations Ellie! You definitely won your appeal! 🎉 I know exactly how confusing those split decisions can be - I got one last summer and it took me forever to figure out what it actually meant. The key thing is that Case #25749632 reversed the determination and made you eligible for benefits starting 5/16. That's the one that matters for getting paid! The first case (disqualification) was probably about a different issue on your claim, but since the second decision makes you eligible, you're good to go. Based on my experience, you should start seeing payments within 7-14 business days, and since you've been certifying since May, that backpay is going to be substantial! Just keep an eye on your UI Online account - once your payment status changes from "Pending" to "Paid," you'll know the money is on its way. The relief you're feeling right now is so valid - this process is incredibly stressful and you made it through! Your rent situation should be sorted out soon. Hang in there! 💪

•Thank you Arjun! This community has been such a lifesaver - I was seriously panicking when I first read that decision letter because I had no idea what those two different rulings meant. It's such a relief to know that other people have dealt with the exact same confusing situation and that the second case approval is what actually matters. I'm definitely going to be obsessively checking my UI Online account every day now! Can't wait to finally get some financial breathing room after months of stress.

Hey Ellie! This is actually really common - I went through the exact same thing about 6 months ago and was just as confused by the split decision! What happened is you had two separate determinations on your claim that both went to appeal. The first case (disqualification under section 1256) was probably about your separation reason - like if your employer claimed misconduct or that you quit voluntarily. The second case was likely about a different eligibility issue, and that's the one they reversed in your favor. The GREAT news is that the reversal on Case #25749632 is what matters for getting paid! Since it says you're eligible starting 5/16, you should get backpay for all those weeks you've been certifying. In my experience, it took about 10 business days after getting the decision letter for payments to start showing up in my account. The system should process everything automatically, but definitely keep checking your UI Online daily. If nothing changes after 2 weeks, that's when I'd call EDD (good luck with that though lol). You won your appeal - congratulations! That backpay is going to be a huge relief when it hits. Just stay patient, the EDD moves at its own pace but you're definitely getting paid! 🎉
