EDD Appeal deadline today - can I mail it or must I hand-deliver to Irvine office?
I'm in a tight spot with my EDD appeal and need urgent advice! My disqualification letter says I have until today (5/12/25) to submit my appeal. I finally got the supporting documents from my previous employer (took them forever!) but now I'm confused about the submission process.\n\nThe instructions on my notice say:\n1. Complete the appeal form\n2. Mail the form/letter to the address listed (Irvine office)\n3. File your appeal within 30 days (by 5/12/25)\n\nWhat's throwing me off is the wording - it mentions both "mailing" and "filing" the appeal. Does postmarking it today count as meeting the deadline? Or do I need to physically drive to Irvine and hand-deliver it before they close?\n\nI planned to just send it certified mail today, but now I'm panicking that might not be enough. Has anyone dealt with appeal deadlines recently? Is mailing it today sufficient or am I going to have to make the drive? Really appreciate any quick responses!

You're fine mailing it today! The postmark date is what counts for EDD appeals, not when they physically receive it. Just make absolutely sure you get it postmarked TODAY - take it to the post office counter and get it sent certified mail with tracking and the receipt showing today's date. Keep that receipt forever!\n\nFor future reference, you can also fax appeals which gives you immediate proof of submission. The fax number should be on your disqualification notice.\n\nGood luck with your appeal! Make sure your letter clearly explains why you believe the determination was incorrect and include all supporting evidence.

Thank you so much! That's a huge relief. I'll definitely get it certified mail with tracking. I didn't even think about the fax option - that would've been smarter but I've already got everything printed and ready to mail. Really appreciate the quick response!

I went through this exact situation last month! I was also freaking out about my appeal deadline. The EDD rep I spoke with clarified that \

8 weeks?! That's insane. Did you continue certifying while waiting for the appeal decision? I'm worried about doing something wrong during this limbo period.

YES! Keep certifying! That was the one thing the EDD rep drilled into me. Even though I wasn't getting paid during the appeal period, she said if I stopped certifying and then won my appeal, they'd only backpay for weeks I properly certified. Don't make that mistake!

I learned this the hard way - PLEASE make sure you keep a complete copy of EVERYTHING you send them! I sent my appeal with all my evidence and they somehow \

Oh wow, that's a great tip. I'll definitely make copies of everything before I send it. That sounds like a nightmare situation!

That's honestly terrifying. I'm unable to drive to Irvine today due to work, so I'll have to risk the mail option. Definitely doing certified mail with tracking though based on these horror stories!

Just to add some clarity - California Unemployment Insurance Code Section 1328 specifies that an appeal is considered filed \

Just wondering - did you try calling EDD to ask this question? I tried for WEEKS to get through on the phone to ask about my appeal and never once got through. Always \

i gave up on calling EDD directly. Total waste of time. I used Claimyr.com to get through to an agent when I had my appeal issues. They connected me within 15 mins after I spent 3 days trying on my own. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km - not free but worth it when you're desperate to talk to a human at EDD.

I did try calling yesterday but got the same automated message about high call volume. I spent 2 hours redialing before giving up. If I have questions after mailing my appeal, I might try that Claimyr service - thanks for sharing!

Sidebar to your original question - just a helpful tip for the actual appeal. Make sure your letter is SUPER clear about which determination you're appealing (include the case number, date of determination, and specific reason). My appeal almost got rejected because I didn't properly reference the right determination letter. Also, if your employer is fighting your claim, be prepared for them to show up at the hearing!

That's really good advice. I made sure to include all the reference numbers and dates on my appeal form. And yes, I'm definitely expecting my former employer to fight this - they've been difficult throughout the whole process. I'm gathering as much evidence as possible for the hearing.

One last thing to be aware of - if your appeal is successful, it can still take 2-3 weeks AFTER the judge's decision for your payments to start coming through. I won my appeal but then had to call multiple times because the payments weren't being released automatically. The whole system is so inefficient!

Thanks for the heads up! This whole process has been so much more complicated than I expected. I'm trying to prepare myself mentally for a long wait. Really appreciate everyone's advice here - feeling much more informed about what to expect.

Just wanted to share my recent experience with EDD appeals to help anyone else in this situation. I submitted my appeal via certified mail and it worked perfectly - the postmark date was absolutely what counted. The key things that helped me were: 1) Getting it postmarked on the deadline day, 2) Using certified mail with return receipt, and 3) keeping detailed copies of everything I sent. My appeal took about 6 weeks to get scheduled for a hearing, but the whole process went smoothly once I had that postmark proof. Don't stress too much about the mailing vs hand delivery - the postal service date is legally sufficient according to California law. Good luck to everyone dealing with these appeals!

•This is super helpful! I'm in a similar situation right now with an appeal deadline coming up next week. Can I ask what type of evidence you included with your appeal that helped your case? I'm trying to figure out what documentation will be most convincing for the judge. Also, did you have to deal with your former employer showing up to contest your appeal during the hearing?
