EDD appeal mailed near deadline - will postmarked date count?

I'm freaking out about my EDD appeal timing! I got disqualified after my eligibility interview (they said I didn't provide sufficient work search records), and I had until February 14th, 2025 to file my appeal. I wrote up my appeal letter, dated it February 10th, and mailed it that same day. But now I'm worried... what if my appeal doesn't arrive at the EDD office until after the February 14th deadline? Does anyone know if they go by the postmark date or the actual received date? The appeal instructions weren't clear about this, and I'm worried they'll just automatically reject it for being late. Has anyone else cut it this close with their appeal timing?

You're fine! EDD goes by the POSTMARK date, not when they receive it. As long as you have proof you mailed it before the deadline (like a receipt from the post office), you're good. I went through the same panic when I filed my appeal last summer. My appeal was postmarked on the 29th day of my 30-day window, but didn't arrive until 5 days after the deadline. The judge specifically mentioned at my hearing that my appeal was timely filed based on the postmark.

Oh thank goodness! I do have the receipt from the post office with the Feb 10th date. Such a relief to hear that worked for your situation too!

No...I just sent it regular mail. I didn't think about certified mail. Now I'm worried again!

The law specifically states that an appeal is considered timely if it's postmarked within the appeal period. According to the California Unemployment Insurance Appeals Board (CUIAB), \

This happened to me! The post office took forEVER to deliver my appeal and I got so nervous. But when I finally got my hearing scheduled they didn't even mention anything about the timing.

I've tried calling the EDD 86 TIMES in the past 3 days just to check on an appeal I sent in LAST MONTH and can't get through to anyone!!! Their system is a JOKE. I've been disqualified for \

Try using Claimyr to reach EDD. I was in the same boat, couldn't get through after days of trying. I used their service and got connected to a real person at EDD in about 20 minutes. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. Their website is claimyr.com - saved me so much frustration when I needed to check on my appeal status.

I think your fine as long as it was pstmarked before deadline but be prepared for a long wait. My appeal took 4 months to get scheduled for a hearing!!! The whole time i was stressing about paying rent. Make sure you keep certifying every two weeks even while your appeal is pending. If you win the appeal you'll get backpay for all those weeks but only if you kept certifying.

4 MONTHS?? Wow, I didn't realize it would be that long! Thanks for the tip about certifying - I wasn't sure if I should keep doing that while appealing. Did you win your appeal?

Yeah I won! The judge was actually really nice and listened to my side of the story. My employer didnt even show up to the hearing which helped. The whole thing took like 15 minutes over phone. Got all my backpay about 2 weeks after the hearing - was like $7800 all at once which saved me from getting evicted honestly.

That's encouraging! I'm hoping mine goes smoothly too. I've been documenting everything related to my work search efforts after I learned my lesson about not keeping detailed enough records.

Can someone explain WHY the EDD website doesn't clearly state this postmark rule? It would save everyone so much anxiety! Their communications are deliberately confusing.

It's actually mentioned in the fine print of the appeal instructions, but I agree it should be more prominent. On page 2 of the DE 1000M form (the appeal form), it states that the appeal deadline is based on the postmark date. The problem is most people only look at the highlighted deadline date on the disqualification notice and panic.

Quick tip: If you're worried about your appeal status in the future, you can check it online through the CUIAB portal. Go to cuiab.ca.gov and click on

Thank you! I didn't know about this portal. I'll definitely keep checking it.

I went through a similar situation last year! The postmark date is definitely what counts - I actually called the CUIAB office directly and they confirmed this. What helped me was also sending a follow-up email through their online portal with a copy of my appeal letter and the postal receipt showing the postmark date. That way I had digital proof they received it. Don't stress too much - you did everything right by mailing it on February 10th. The system is slow but they do honor the postmark rule. Just make sure to keep that postal receipt safe in case they ask for proof later during your hearing!

That's such great advice about emailing through the online portal too! I didn't even think about creating a digital backup like that. I'm definitely going to do that today - better safe than sorry. It's reassuring to hear from someone who actually called CUIAB directly to confirm the postmark rule. I've been losing sleep over this but hearing all these success stories is really helping calm my nerves. Thanks for sharing your experience!
