EDD response deadline - Is postmark on 10th day acceptable for paperwork?

Hey everyone! Just had a mini heart attack when I checked my mail today. I received an EDD notice that was dated January 31, 2025, but I didn't actually receive it until February 3rd. What's freaking me out is that I completely forgot about it until TODAY and it says I have to respond within 10 days of the mail date. By my count, today would be the 10th day since the mail date (Jan 31). If I get it postmarked today, am I still within the deadline? Or am I already too late? I've had my claim disqualified once before for missing paperwork and I really can't afford another problem. Has anyone dealt with this deadline situation before? Will EDD still accept it if the postmark is exactly on the 10th day?

You're cutting it close but you should be fine. The 10-day deadline refers to the postmark date, not when they receive it. Just make sure you get to the post office TODAY and get it postmarked before they close. I had something similar happen with my eligibility verification form and they accepted it when I mailed it on the last day. Take a picture of the envelope with the postmark as proof just in case you need to reference it later.

Thank you so much! I'm literally grabbing my keys to head to the post office right now. Should I send it certified mail or is regular first class enough? I'm so nervous about this.

It's for income verification from my part-time gig last quarter. They're saying I need to send proof of the hours I worked during the weeks I certified. Definitely reading everything three times before sending!

I STRONGLY urge you to call EDD directly to confirm they received your paperwork!!! The postmark might be fine but sometimes things get "lost" in their system. I mailed something back on time last year and they still disqualified me because they claimed they never got it. Took WEEKS to resolve and my payments got held up. Their system is a NIGHTMARE. Don't just assume they'll process it correctly!!!

Excellent point about following up. Based on my experience, I recommend waiting at least 7-10 business days after mailing before calling to verify receipt. You can try calling EDD directly, but many people have trouble getting through on their phone lines. I recently discovered a service called Claimyr (claimyr.com) that helps you bypass the busy signals and connect with an EDD agent quickly. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. It saved me hours of frustration when I needed to confirm my eligibility interview documents were received.

The 10-day deadline is actually confusing because sometimes they count business days and other times calendar days. I had a similar notice and called to clarify. For most verification documents, it's 10 calendar days from the mail date, and yes, the postmark on the 10th day is acceptable. Make sure you're using the return envelope they provided (if they gave you one) and write your claim ID number on every page you send back.

That's not true about business days vs calendar days. It's ALWAYS calendar days unless the notice specifically says business days (which is rare). I've been on unemployment three times and it's always been calendar days for the standard notices. Don't confuse the person more lol

You're right - I should have been clearer. Most notices use calendar days, but I had one special circumstance notice that used business days, which is what confused me. Thanks for the correction!

this happened to me but i waited too long and got disqualified :( had to file an appeal and it took forever. definitely mail it today!!! also you should probably include a note explaining why it's coming in on the last day just to be safe

Adding a note won't hurt, but it's unnecessary if it's postmarked within the deadline. The postmark is what matters legally. I wouldn't recommend drawing attention to the fact that it's the last day - just get it in the mail with today's postmark and you're following their requirements exactly.

Update: I made it to the post office! They postmarked it and I sent it certified mail with tracking. The postal worker confirmed that as long as it's postmarked today, it meets the 10-day requirement. Thanks everyone for the quick responses - you saved me from a lot of stress and potentially losing benefits!

Great job! For future reference, you can also submit many EDD documents online through your UI Online account, which eliminates mail delays and gives you an instant confirmation. Not all forms can be submitted this way, but it's worth checking for next time.

Good to hear you got it sent in time! I've been through similar deadline scares with EDD paperwork. One tip for anyone else reading this - if you ever receive an EDD notice again, check if there's a DE number on it and see if you can submit it through UI Online instead of mail. It's way faster and you get immediate confirmation. Also, for income verification like yours, make sure you include paystubs, timesheets, or any other documentation that clearly shows the dates and hours worked. EDD can be picky about what they accept as "proof" so more documentation is usually better than less.

Thanks for the additional tips! I actually didn't even think to check UI Online for this particular form. I'll definitely remember that for next time. For the income verification, I sent copies of my paystubs and a letter from my employer confirming the exact hours worked during those weeks. Hopefully that's enough documentation - I tend to overthink these things but better safe than sorry with EDD!
