Do I qualify for California EDD unemployment if I was fired from my job?
So I got fired from my job at a logistics company about two weeks ago and I'm honestly not sure if I even qualify for unemployment benefits. My manager said I was let go due to 'performance issues' but honestly the whole situation felt really unfair - they kept changing my schedule without notice and then wrote me up when I couldn't accommodate last minute changes. I worked there for about 14 months full time. I've heard mixed things from people - some say if you're fired you automatically don't qualify, others say it depends on the reason. I finally went ahead and filed a claim on UI Online just to see what happens, but now I'm stressed about whether California EDD is going to deny me and whether I need to do anything to prove my side of the story. Has anyone been fired and still managed to get approved for unemployment? What actually determines whether you qualify or not when you're terminated?

Yes you can absolutely still qualify for unemployment even if you were fired. The key thing California EDD looks at is whether you were fired for 'misconduct' as defined under California unemployment law - not just because your employer called it a performance issue. There's a big difference between being fired for misconduct (like intentionally violating company policy, theft, insubordination) versus being fired because you couldn't meet expectations or there were scheduling conflicts. The latter typically does NOT disqualify you. File your claim and make sure you explain your side clearly when California EDD contacts you for the fact-finding interview.

AuthorThat's actually really reassuring. So the fact-finding interview - does that happen automatically after I file, or do I have to request it somehow? I didn't see anything about it in my UI Online account yet.

It happens automatically. California EDD will contact both you and your former employer to get both sides of the story before making a determination. Just make sure your contact info is current in your account and watch for calls from a 1-800 number - those are often the EDD calling for the interview.

Also worth noting - even if you get an initial denial you can appeal within 30 days. Don't give up just because the first determination goes against you.

went through this exact thing last year. fired for 'attendance issues' which was really just me dealing with a family emergency they refused to accommodate. got approved no problem. EDD sided with me after the phone interview because my employer couldn't prove i had been warned properly or that i willfully violated any policy. document EVERYTHING on your end

AuthorDid you have to gather like pay stubs and documentation before the interview or just explain verbally what happened?

mostly verbal for the interview but i did have text messages from my manager showing they knew about my situation. saved my butt honestly. screenshot everything you have

I was in a similar boat a few months back and spent literally days trying to get through to California EDD on the phone to ask about my eligibility before I even filed. Kept getting the 'we're experiencing high call volume' message and getting hung up on. A friend told me about Claimyr (claimyr.com) which basically gets you connected to an actual EDD agent without sitting on hold for hours. There's a video demo at https://youtu.be/JmuwXR7HA10 that explains how it works. I used it to ask my eligibility questions before filing and the agent confirmed that my termination situation would likely not be considered misconduct. Saved me so much anxiety.

I was skeptical too but it genuinely connected me to an agent same day. Way better than the alternative of calling 50 times and getting nowhere.

Here's what California EDD actually considers 'misconduct' that would disqualify you from benefits: it has to be a willful or wanton disregard for your employer's interests. Simple mistakes, poor performance, inability to meet quotas, or even attendance issues related to circumstances outside your control generally don't rise to that level. If your employer is claiming performance issues related to scheduling changes THEY made, that's going to be very hard for them to defend as misconduct on your part. Make sure during your fact-finding interview you explain the timeline - that they changed your schedule, you couldn't accommodate it, and they wrote you up as a result.

AuthorThis is incredibly helpful. Should I proactively reach out to EDD with this info or just wait for them to contact me?
0 coins
Andre Moreau
Wait for them to reach out. Trying to call in proactively is difficult given EDD call volume and they'll initiate the process. Just make sure your phone is on and you answer unknown numbers - EDD often shows up as a blocked or 1-800 number.

they also send letters so watch your mail too. sometimes they mail the interview appointment and you only get a few days notice

I got denied the first time after being fired and panicked completely. Thought I had no options. But I appealed and won at the hearing level. The whole process took about 3 months from filing to final approval but I did eventually get all my back payments. Don't lose hope if the first determination isn't in your favor!!

Author3 months is a long time to wait without income. Did you have anything to fall back on during that period? I'm really stressed about covering rent.

It was really tough not gonna lie. I borrowed from family and picked up some gig work which I reported on my weekly certifications. You can work part time and still receive partial benefits which helped.

same here, appeals process takes forever but it's worth doing. i almost didn't appeal because i thought it was pointless

wait so if your fired does that mean you automatically have to do an interview with edd?? i thought only people who quit had to explain themselves
0 coins
Andre Moreau
Actually both situations require fact-finding in many cases. When you quit, EDD needs to verify you had 'good cause' to leave. When you're fired, they need to determine whether the termination was for disqualifying misconduct. Both the claimant and the employer get contacted.

oh wow i had it completely backwards this whole time. good to know

Yeah it's a common misconception. Being fired doesn't automatically mean denial and quitting doesn't automatically mean approval. The reasons behind both matter a lot.

CALIFORNIA EDD IS A JOKE. I was fired from my job in 2024 for absolute nonsense reasons and they sided with my employer without even properly reviewing my documentation. The fact-finding interview lasted literally 8 minutes and the interviewer seemed like she had already made up her mind. Then I appealed and the whole thing dragged on for MONTHS. I eventually won but the stress nearly broke me. The system is designed to make you give up.

I feel this deeply. The fact-finding interviews can feel very rushed and one-sided. That's part of why having your key points written down in advance is so important - you only have a short window to make your case.

exactly. i wish someone had told me to literally script out my main points before the call. i rambled and probably didn't come across well which cost me the first round

One thing I want to clarify since there's some back and forth here - you also need to meet the base period earnings requirement to be eligible regardless of the reason you were fired. California EDD looks at your earnings over a 12-month base period to determine if you earned enough to qualify. For most people with 14 months of full-time employment the earnings threshold won't be an issue, but it's worth knowing that eligibility has two separate parts: the monetary requirement (did you earn enough?) and the non-monetary requirement (was your separation from work for a qualifying reason?).
0 coins
GalaxyGazer
AuthorI didn't even think about the earnings side of it. I was making about $22/hour full time for 14 months so hopefully that's enough?
0 coins
Mateo Sanchez
That should be more than sufficient. The weekly benefit amount California EDD pays is based on your highest earning quarter in the base period. With full-time earnings at that wage you're looking at or close to the maximum weekly benefit amount.
0 coins
Zoe Stavros
yeah the earnings requirement is rarely the issue for people who worked full time for over a year. the separation reason is usually the main hurdle

Carmen Vega
so wait do you have to be actively looking for work even while waiting for your claim to be approved? like during the adjudication period?
0 coins
Andre Moreau
Yes. You need to be able and available to work, actively seeking employment, and completing your weekly certifications every week regardless of whether your claim is in adjudication. Missing weekly certifications can cause big problems even if you're eventually approved.
0 coins
Carmen Vega
ugh ok i did not know that. i took a week off from certifying because i thought i had to wait for the determination first. that was a mistake wasn't it
0 coins
Aisha Mahmood
You may be able to backfill those certifications by calling EDD directly and explaining the situation. It's worth trying rather than just losing those weeks.

Carmen Vega
ok gonna try to call today. wish me luck getting through lol

For anyone who needs to reach EDD to ask about their specific situation - whether you're trying to understand your eligibility, check adjudication status, or ask about missing certifications - Claimyr really did change the game for me. The EDD phone lines are brutal and claimyr.com routes you past the hold queue. I know it sounds like an ad but I genuinely spent four days getting disconnected before I tried it. Check out the video at https://youtu.be/JmuwXR7HA10 if you're skeptical like I was.

Can I ask a side question - does it matter what state you were employed in? Like if the company was based in a different state but I worked remotely in California?
0 coins
Andre Moreau
Generally for remote workers, unemployment is filed in the state where you physically performed the work - so if you were working from California, you'd file with California EDD. The company being headquartered elsewhere typically doesn't change that.
0 coins
Zoe Stavros
ok good that's what i figured. just wanted to confirm before i file

Mateo Sanchez
There can be some edge cases depending on the specific employment arrangement but what was described above is the general rule for most remote workers.

fired from tech company last year after layoffs disguised as performance terminations (classic move btw). took about 6 weeks from filing to approval. the key was being really specific in the interview about the sequence of events - that performance concerns were suddenly raised right before a company-wide restructuring. EDD agent connected the dots.
0 coins
GalaxyGazer
AuthorThat's a good point - the timing of everything probably does matter. My termination also came pretty suddenly after they restructured my department.
0 coins
Mei Chen
document the timing. if performance was truly a problem you'd have a paper trail of PIPs and warnings over time. sudden terminations often signal something other than genuine performance issues and EDD knows this
0 coins
Jamal Harris
This is really solid advice. The lack of prior documentation and warnings is often what sinks an employer's misconduct claim during fact-finding.

my cousin got fired and was told flat out by his employer that they would fight his unemployment claim. can employers actually block you from getting benefits??
0 coins
Mateo Sanchez
Employers can contest claims and provide their side of the story to California EDD, but they cannot simply block you from receiving benefits. EDD makes the determination independently after hearing from both sides. An employer saying they'll fight it is just posturing - it means they'll respond when EDD contacts them, not that they have veto power over your claim.
0 coins
QuantumQuester
ok good. my cousin has been scared to even file because of what his former employer said. gonna tell him to just go ahead and file.
0 coins
Aisha Mahmood
Tell your cousin to file ASAP. There's a one-week waiting period after you stop working and then delays start adding up fast. The sooner you file the sooner any approved benefits start.
0 coins
Liam Sullivan
and while you're waiting for the determination KEEP FILING YOUR WEEKLY CERTIFICATIONS. i cannot stress this enough. so many people stop certifying because they assume they'll be denied or because they're confused about what adjudication means. adjudication just means your claim is under review - you still need to certify every week or you lose those weeks permanently.

honest question - if you lie during the fact finding interview does edd ever actually find out? asking for a friend lol
0 coins
Andre Moreau
Not advice anyone should follow. California EDD cross-references information from both you and your employer, and inconsistencies are a red flag. Beyond the claim denial, making false statements to EDD can result in disqualification for future benefits, overpayment notices requiring repayment of any benefits you received, and in egregious cases, fraud charges. It's genuinely not worth it.
0 coins
Amara Okafor
yeah ok fair enough. just curious. my 'friend' will tell the truth
0 coins
Aisha Mahmood
The truth usually works out better anyway especially in termination cases. EDD sees a lot of employer claims of misconduct that don't hold up under any scrutiny.

One practical tip nobody mentioned - write down your timeline BEFORE the fact-finding call. Like literally: - When you were hired - When the schedule change happened - Who told you about the change and how (email/text/verbal) - When the write-up happened - When you were terminated Having that in front of you during the call means you won't blank out or give inconsistent answers if the interviewer asks follow-up questions.

AuthorThis is exactly what I needed, thank you. I'm going to make this list tonight. Should I also mention that I have text messages from my manager?
0 coins
Ethan Moore
Yes mention that you have documentation. They may or may not ask you to submit it but having it ready shows you're prepared and credible. Sometimes just mentioning you have supporting messages shifts the tone of the interview.

Jamal Harris
Agreed. I also wrote down the names and job titles of anyone relevant - my direct manager, their supervisor, HR contact - just so I could reference them specifically if asked. Details signal credibility.

how long does it usually take to get a determination after the fact finding interview? i've been waiting 3 weeks and nothing in my UI online account has changed
0 coins
Mateo Sanchez
Typically 3-5 weeks after the fact-finding contact is completed for a determination to appear in your UI Online account. That said, California EDD timelines vary a lot depending on claim volume. If it's been 3 weeks since YOUR interview but they may still be waiting to contact your employer, which extends the timeline.

If you're really anxious about it and want an update from an actual person rather than just staring at UI Online, that's exactly the situation where getting through to an EDD agent helps. claimyr.com helped me get through on a day when I was going crazy waiting. They can at least tell you where your claim is in the process.

ok I'll check that out. at this point anything is better than refreshing ui online every hour

I want to add something about the job search requirement since nobody mentioned it yet - while your claim is pending and even after approval, California EDD requires you to be actively looking for work. Technically you need to make at least three job search contacts per week and be ready to document them. You certify that you're doing this on your weekly claims. Don't blow this part off because random audits do happen and if you can't show a job search log it creates problems.
0 coins
GalaxyGazer
AuthorThree contacts per week - does that mean applications submitted, or can it include things like networking or informational interviews?
0 coins
Aisha Mahmood
It's pretty broadly defined. An application counts, so does attending a job fair, connecting with a potential employer on LinkedIn, or using CalJOBS (EDD's job search platform). The key is being able to document the employer name, contact info, and date if asked.
0 coins
QuantumQuester
does using indeed count as a job search contact? like if you apply through there
0 coins
Aisha Mahmood
Yes applying through Indeed or any job board counts. Save confirmation emails or screenshots of applications just in case.

Jamal Harris
Just to close the loop for OP - from everything you've described (14 months employed, full-time, fired for performance issues related to scheduling changes your employer made) you have a reasonable case for qualifying. The misconduct bar is genuinely high under California law. File, certify weekly, prepare for your fact-finding interview, and keep documentation of everything. You've got this.
