Back to California Unemployment

Dylan Wright

Do you get unemployment if you get fired in California EDD?

Ok so I got fired from my job last Tuesday and I genuinely don't know if I can even file for unemployment. My manager said I was being let go due to 'performance issues' but honestly the whole thing felt really unfair and came out of nowhere. I never got any written warnings or anything, just a meeting and then they handed me a box. I've been reading stuff online and some places say you can't get UI benefits if you were fired and other places say you can? I'm so confused. I live in California and I've been at this job for almost 2 years so I definitely have enough work history. Do I even qualify to file a claim with California EDD or am I just out of luck?

Yes you absolutely should still file! A lot of people don't realize this but being fired doesn't automatically disqualify you from California EDD unemployment benefits. The key thing is WHY you were fired. California EDD will look at whether you were fired for what they call 'misconduct' - and the legal definition of misconduct is actually pretty specific and narrow. Things like honest mistakes, performance issues, or just not being a great fit for a job usually do NOT count as disqualifying misconduct. You have to have done something like intentionally violating company policy, committing theft, or deliberately ignoring safety rules. So 'performance issues' with no warnings is honestly a really good sign for your claim. File right away because there's a waiting period and you don't want to lose any weeks.

0 coins

Wait seriously?? I thought if you got fired you just couldn't get it. So I should still go ahead and file even though I got fired for performance?

0 coins

This is correct. The burden is actually on the employer to PROVE misconduct to California EDD. If they just say performance issues without documented evidence, EDD usually sides with the claimant. File immediately.

0 coins

yep same thing happened to my brother they fired him said it was performance and he got approved no problem

0 coins

The way California EDD handles fired vs. quit is really different from what most people expect. When you're fired, EDD starts from the assumption that you may be eligible - they investigate and give the employer a chance to show you committed misconduct. When you QUIT, it's the opposite - YOU have to prove you had a good reason to leave. So being fired actually puts you in a slightly better starting position than quitting in some ways. File your claim online at UI Online as soon as possible, don't wait. The one week unpaid waiting period starts from when you file, not when you were fired.

0 coins

Oh wow I had no idea it worked that way. I was literally about to not even bother filing because I assumed I'd be denied automatically.

0 coins

This is such important info that nobody tells you. I waited like 3 weeks before filing after getting fired because I thought I wasn't eligible and ended up losing those weeks of benefits completely.

0 coins

same. wish someone had told me this when i got fired 2 years ago, i never even filed

0 coins

File the claim TODAY if you haven't already. Go to edd.ca.gov and start the UI Online application. You'll need your last employer's info, your work history for the past 18 months, and your Social Security number. After you file, California EDD will send both you and your former employer questionnaires asking about the reason for separation. Just be honest and specific - explain that you received no written warnings, no formal performance improvement plan, nothing documented. That's really important context for the adjudication process. The fact that you had no warnings works heavily in your favor.

0 coins

I just started the application. It's asking about the reason I was separated - should I say 'discharged/fired' or is there a better way to phrase it?

0 coins

Select discharged/fired - always be honest on the application. Then in the explanation box describe exactly what happened: you were called into a meeting unexpectedly, told it was performance issues, given no prior written warnings, and handed your belongings. The more specific detail the better.

0 coins

definitely be honest, trying to spin it can backfire during the adjudication interview if EDD calls you

0 coins

I went through almost this exact situation six months ago. Got fired, thought I had zero chance, almost didn't file. A friend pushed me to file anyway and I got approved. The whole adjudication process took about 3 weeks but I eventually got all my back weeks paid. One thing I'll say - getting through to California EDD by phone when they had questions about my claim was an absolute nightmare. I kept calling and either getting a busy signal or sitting on hold for 2+ hours and getting disconnected. Eventually someone on a forum like this told me about a service called Claimyr. It basically gets you in line to talk to an actual EDD agent without you having to sit there hitting redial all day. I used it when my claim was in adjudication and needed to speak to someone - you can check it out at claimyr.com or watch how it works at https://youtu.be/JmuwXR7HA10. Honestly saved me so much stress.

0 coins

Good to know about the phone thing, I was already dreading having to call them. I'll look into that Claimyr thing if I run into issues.

0 coins

The EDD phone situation is genuinely horrible. I've been hung up on so many times. Will have to look into that service.

0 coins

Adjudication can sometimes require a phone interview with EDD so having a way to actually reach them is super useful. Good tip.

0 coins

Yeah contacting EDD by phone is brutal. That service sounds useful for when you actually need to talk to someone about your claim status.

0 coins

ok wait I'm confused about something - if they say it was performance issues does that count as misconduct?? because i always thought misconduct meant like you did something bad at work

0 coins

Great question and honestly a lot of people mix this up. 'Misconduct' in the California EDD legal sense is very specific - it generally means a willful or deliberate violation of the employer's reasonable expectations. Just not performing well enough, making mistakes, or struggling with the job duties does NOT meet that legal threshold. Misconduct is more like intentionally stealing, deliberately ignoring a direct order, or repeatedly violating known policies after warnings.

0 coins

ohhhh ok so like doing a bad job isn't misconduct but like doing something on purpose that you knew was wrong would be

0 coins

Exactly right. The intentional/willful element is key. Accidental poor performance is not misconduct under California UI law.

0 coins

I got fired 'for cause' from a restaurant job last year saying I violated food safety procedures. I was SO sure I'd be denied. Turned out EDD looked at it and since I'd never been formally warned about it in writing and it was my first offense they approved me anyway. The employer actually submitted a rebuttal and EDD still sided with me. Don't assume the employer wins just because they have a reason - EDD does actually investigate both sides.

0 coins

This is really reassuring honestly. My employer never gave me anything in writing at all.

0 coins

Yeah no documentation is a big deal. EDD basically needs the employer to show a paper trail to prove misconduct. No warnings usually means the employer has a weak case.

0 coins

documentation is EVERYTHING with EDD claims. keep every email text message anything related to your employment and termination

0 coins

one thing nobody mentioned - after you file your initial claim you STILL have to file weekly certifications every week to keep receiving benefits. A lot of people file their claim and then wait thinking they're done but you have to log back into UI Online each week and certify. You also have to be actively looking for work and keeping a record of your job search activities - at least one job search contact per week I believe, though EDD may ask for more. Don't miss a week of certifications or you could have gaps in your payments.

0 coins

Oh I had no idea about the weekly certifications!! Thank you for mentioning that, I would have definitely missed that step.

0 coins

Yeah it trips a lot of people up. Set a weekly reminder. You can certify anytime Sunday through Saturday for the previous week.

0 coins

Also just to add - the job search requirement is real, you need to keep a log of where you applied with dates and contact info because EDD can audit you on it

0 coins

Does anyone know how long the whole adjudication process takes if EDD decides to investigate? My cousin is in a similar situation and her claim has been pending for like 2 weeks already.

0 coins

Adjudication timelines vary a lot - it can be anywhere from a couple weeks to 6-8 weeks depending on how backlogged EDD is and how complicated the case is. During adjudication, keep filing your weekly certifications even though you won't receive payment yet. Once approved, those weeks you certified during adjudication are back-paid to you.

0 coins

The 2 week mark is still pretty early. Encourage your cousin to keep certifying every week and to respond quickly to any EDD mail or phone calls. Missing a scheduled interview or not responding to mail can delay things further.

0 coins

ok thank you, I'll let her know to keep certifying and watch her mail carefully

0 coins

CALIFORNIA EDD IS AN ABSOLUTE JOKE. I got fired 4 months ago filed immediately and I'm STILL fighting with them. My employer lied on the employer questionnaire said I committed misconduct and now I'm appealing and it's been a nightmare. The phone lines are impossible, they send mail to the wrong address, and when you actually get someone on the phone they give you different information every time. I really feel for OP I hope your experience is smoother than mine has been but just be prepared for it to be a long road.

0 coins

Ugh that sounds so awful, I'm sorry you're going through that. Did you file the appeal yourself or get help?

0 coins

Filed it myself. You have 30 days from the determination notice to appeal. I just had my hearing scheduled finally. Make sure if you get denied you file that appeal IMMEDIATELY and gather every piece of evidence you have.

0 coins

If the employer actively lied on their questionnaire you can potentially challenge that during the appeals hearing. Bring documentation of everything and consider contacting a legal aid organization if you can't afford an attorney - many offer free help with EDD appeals.

0 coins

Something worth knowing: California EDD will send a Notice of Determination after they investigate your claim. If they approve you, great. If they issue a disqualification, you have EXACTLY 30 days from the date on that notice to file an appeal - not 30 days from when you receive it, 30 days from the date printed on the notice. Missing that deadline can be devastating so watch your mail every single day once you file.

0 coins

30 days from the DATE on the notice, not when I get it? That seems like it could sneak up on you fast if the mail is slow.

0 coins

Exactly, and EDD mail can sometimes take several days to arrive. So realistically you might have 24-25 business days by the time you receive it. Don't wait to read your mail, open everything from EDD immediately.

0 coins

This is why I always recommend creating a myEDD account online too - sometimes you can see notices there before the physical mail arrives

0 coins

just wanna add for OP - when you're doing your weekly certifications they will ask you questions like 'did you look for work this week' and 'did you refuse any work' and 'did you earn any money.' Answer honestly. A lot of people think they need to say they looked for work even if they didn't that week or they'll lose benefits but if you lie and EDD finds out that's an overpayment situation which is way worse than just missing a week.

0 coins

What counts as looking for work exactly? Like does applying on Indeed count?

0 coins

Yes, applying online counts. You need to keep a record of each application - the company name, position, date, and how you applied. EDD calls this your job search log and can request it at any time during your benefit year.

0 coins

Also networking contacts, attending job fairs, submitting resumes directly to employers all count. The key is just keeping documentation of whatever you do.

0 coins

Wanted to share that I actually called California EDD last week about my claim and after spending literally 4 hours across two days trying to get through I finally tried Claimyr. Got connected to an actual EDD agent within a reasonable wait time without having to sit there continuously redialing. For anyone dealing with adjudication questions or claim status issues where you really need to speak to a live person it's worth looking at claimyr.com - they also have a demo video at https://youtu.be/JmuwXR7HA10 that explains how the whole thing works.

0 coins

4 hours trying and still nothing? That's exactly my experience. EDD's phone system is just fundamentally broken. I'll check that out for my appeals questions.

0 coins

does it actually work? seems too good to be true tbh

0 coins

I was skeptical too honestly but it delivered for me. Made a really stressful situation a lot more manageable when I actually needed answers about my claim.

0 coins

quick question - does it matter how long you worked there? like does the 2 years make a difference or could someone who only worked somewhere 3 months also qualify

0 coins

Great question. California EDD eligibility is based on wages earned during a base period (the first 4 of the last 5 completed calendar quarters before you file). You need to have earned enough wages during that period - the minimum is around $1,300 in your highest quarter, or $900 in your highest quarter plus total base period earnings of 1.25 times that high quarter amount. So length of employment matters less than total wages earned. Someone who worked 3 months at good pay could qualify while someone who worked a year part-time at very low hours might not.

0 coins

ohh ok so it's about the money you earned not just how long you were there. that makes sense

0 coins

Correct. And your weekly benefit amount is calculated as roughly 60-70% of your average weekly wages during the base period, capped at a maximum. For 2025 the max weekly benefit amount in California is $450.

0 coins

I want to offer some reassurance from the other side of this - I got fired 'for cause' from a tech company 8 months ago, went through adjudication, got approved, collected benefits for 5 months while job searching, and just started a new job last week. The system worked for me even though I was really scared at first. The thing that helped most was responding to EVERY EDD communication immediately and being very factual and specific in my written explanations. Don't editorialize, don't vent about your boss, just state the facts clearly.

0 coins

Thank you for this!! I really needed to hear a success story. Congrats on the new job!

0 coins

Thank you! It'll be okay. Just stay on top of your certifications and correspondence and you'll get through it.

0 coins

The 'just state the facts' advice is so underrated. EDD adjudicators are reading hundreds of these things, clear factual statements work way better than emotional descriptions

0 coins

my friend told me you can't get unemployment if you get fired anywhere but that's totally wrong right?? i feel like that's just something people say

0 coins

Totally a myth! It's one of the most common misconceptions about unemployment. Being fired makes you potentially eligible - it's only disqualifying if you were fired for legally defined misconduct. California EDD actually has a pretty employee-friendly standard for this.

0 coins

yeah i figured it was wrong, people act like getting fired means you're just on your own

0 coins

The myth probably comes from the fact that some people DO get denied after being fired - but that's because their specific situation involved actual documented misconduct, not simply because they were fired

0 coins

I'm in almost the same boat as OP and reading this whole thread is making me feel so much better. Filed 10 days ago after getting let go from a warehouse job. No warnings, just said my productivity wasn't meeting standards. Claim is showing 'pending' and I got a questionnaire in the mail asking for my side of the story. Filled it out and sent it back, now just waiting. The waiting is killing me honestly.

0 coins

Pending with a questionnaire sent and returned is actually a normal and healthy stage in the process - it means EDD is actively reviewing your claim. Keep certifying weekly and try not to check your account obsessively (easier said than done I know).

0 coins

Lol the obsessive checking is real. I think I've logged into UI Online like 6 times today.

0 coins

The status doesn't usually update in real time so daily checking is the most you really need. But I get it, the uncertainty is really stressful when you're waiting on that income.

0 coins

Productivity not meeting standards with no formal warnings is a really solid position to be in for your claim. That's not misconduct, that's just business performance and EDD knows the difference.

0 coins

one thing i'll add that nobody mentioned - be careful about what you post on social media while your claim is under review. i know it sounds paranoid but employers have been known to submit social media screenshots to EDD if they're fighting the claim. if you're posting about how you hated the job or partying while claiming you're looking for work it could theoretically come up

0 coins

Oh wow I hadn't even thought about that. Good warning.

0 coins

Probably not common but not unheard of either. Just keep a low profile online, it doesn't hurt.

0 coins

UPDATE: My cousin I mentioned earlier just got her determination letter and she was APPROVED!! Employer claimed misconduct, EDD investigated, found in her favor. It took about 5 weeks total from filing to determination. She said the key was she had saved old text messages from her manager that contradicted what the employer wrote on their questionnaire. So definitely save any documentation you have people!!

0 coins

This is so great to hear, congratulations to your cousin!! And yes saving those texts was smart.

0 coins

Excellent outcome and a great reminder about documentation. Those text messages essentially proved the employer's questionnaire wasn't accurate, which is exactly the kind of thing EDD weighs in adjudication.

0 coins

Happy for her. This is what I'm hoping for in my appeal too. Employers lie on those questionnaires more often than people realize.

0 coins

For anyone who ends up getting denied and needs to appeal - the EDD appeals process goes to the California Unemployment Insurance Appeals Board (CUIAB), not back to EDD itself. You get a real hearing with an Administrative Law Judge where you can present evidence and testimony. It's way more formal than the initial EDD review but the ALJs are actually pretty thorough and fair in my experience. I had a hearing last year and won my appeal even though EDD had initially denied me.

0 coins

Good to know the appeals process exists if the initial determination goes against me. Hoping it doesn't come to that but it helps to know there's another step.

0 coins

Exactly, it's not over if you get denied initially. A lot of initial denials get reversed on appeal especially in borderline misconduct cases. Just don't miss that 30 day deadline.

0 coins

The CUIAB hearings are held over the phone now for the most part which makes them more accessible. You can also request a continuance if you need more time to prepare your case after getting the hearing notice.

0 coins

OP how are you doing, did you end up filing? Curious how it's going for you

0 coins

Yes I filed the same day I posted this! Claim is currently in adjudication - I got the questionnaire, filled it out right away describing exactly what happened with no written warnings or documentation from the employer. Now I'm waiting. Filing my weekly certifications every week like everyone said. Fingers crossed. This thread has been SO helpful and honestly made a really scary situation feel a lot less overwhelming.

0 coins

That's the right move on all counts. Answering the questionnaire promptly and continuing to certify weekly are exactly what you should be doing. Good luck - the lack of any written warnings really does give you a strong position here.

0 coins

Rooting for you! And remember if you ever get stuck trying to reach someone at EDD by phone during the process, claimyr.com is worth bookmarking. The adjudication period is exactly when you might need to actually speak to an agent and EDD phones are notoriously hard to get through.

0 coins

Good luck to both of us then! We're in similar situations. Hope we both get good news soon.
